If marriage is understood, in family law terms, as a form of contract, consensual divorce may be described as the termination of that contract by mutual agreement. While contracts are generally terminable by the parties’ consent, Korean civil law imposes procedural constraints on the consensual dissolution of marriage in light of its distinctive social and personal characteristics. This Article examines whether the current system of consensual divorce adequately respects the autonomy of parties who have decided to divorce and sufficiently protects their freedom to do so, as well as whether the courts are assigned an appropriate role throughout the divorce process. It argues that the existing framework—characterized by a lengthy and complex procedure—does not respond equally to all cases and raises particular concerns where the parties have no minor children and have reached full agreement on both divorce and its legal consequences.
In particular, although judicial confirmation of the parties’ intent to divorce lies at the core of the consensual divorce process, its legal effect remains ambiguous, as it is structurally separated from the moment at which divorce becomes legally effective through registration. Drawing on a comparative analysis of major foreign legal systems, this Article proposes the abolition of consensual divorce as a separate institution and the unification of divorce under a judicial framework, with differentiated procedures for (1) cases of full agreement, (2) cases of agreement on divorce but not on its consequences, and (3) cases lacking mutual intent to divorce. This approach seeks to reconcile respect for individual autonomy with procedural coherence and judicial responsibility in divorce law.
