2024년 행정법(Ⅱ) 중요판례평석 = Analysis of Major Cases on Administrative Law(Ⅱ) in 2024

국문 초록 (Abstract)

본 연구는 2024년 행정법 각론 분야에서 선고된 대법원판결 가운데 법률실무나 학계에서 주목할 만한 판례를 선정하여 그 의미를 해석하고 평석하였다. 그 의의를 감안하여 총 9개의 판례를 선정하였으며, 이를 지방자치법, 공무원법, 개발행정법, 공용부담법, 보건의료행정법의 분야로 구분하여 살펴보았다. 평석대상 판례들의 개요는 다음과 같다. ① 시·군 및 자치구의 조례의 입법한계(대법원 2024. 6. 27. 선고 2022추5132 판결), ② 조례안에 대한 감독청의 직접제소의 법적 성격과 위법 판단의 기준(대법원 2024. 7. 25. 선고 2023추5177 판결), ③ 지방의회의 의결사항인 공유재산 매매계약의 법적 성질(대법원 2024. 7. 11. 선고 2024다211762 판결), ④ 공무원의 승진임용 및 징계에 관하여 임용권자에게 부여된 재량권의 한계(대법원 2024. 1. 4. 선고 2022두65092 판결), ⑤ ｢건축법｣상 내력벽의 판단기준과 집합건물 공용부분에 대한 대수선에 관한 처분의 취소를 구할 원고적격(대법원 2024. 3. 12. 선고 2021두58998 판결), ⑥ 민사소송의 판결과 공법상 규제의 관계(대법원 2024. 3. 12. 선고 2023두50349 판결), ⑦ 담배에 대한 폐기물부담금 등의 부과요건사실인 ‘제조장에서 반출’의 의미(대법원 2024. 5. 23. 선고 2021두35834 전원합의체 판결), ⑧ 공동개설 의료기관에 대한 ｢의료법｣ 제66조 제3항의 적용 범위(대법원 2024. 5. 30. 선고 2021두58202 판결), ⑨ ｢국민건강보험법｣상 피부양자인 ‘배우자’ 개념(대법원 2024. 7. 18. 선고 2023두36800 전원합의체 판결).

This study aims to review and analyze notable Supreme Court precedents from 2024 in the field of special administrative law. Given their significance, a total of nine cases were selected for examination. These cases are categorized under Local Autonomy Law, Public Officials Law, Development Administration Law, Public Burden Law, and Health and Medical Administration Law.
The overview of the cases subject to analysis is as follows: ① Legislative limitations of ordinances in Si, Gun, and autonomous Gu, ② The legal nature of the supervisory authority's direct filing of a lawsuit against ordinance bills and the standards for determining illegality, ③ The legal nature of the sale contract of public property, a matter for resolution by local councils, ④ The limits of discretionary power granted to the appointing authority regarding the promotion and disciplinary action of public officials, ⑤ Criteria for determining bearing walls under the ‘Building Act’ and standing to seek revocation of dispositions regarding substantial repairs to sections for common use in condominium buildings, ⑥ The relationship between civil litigation judgments and public law regulations, ⑦ The meaning of 'taking out of a manufacturing place' as a requirement for imposing waste charges and other fees on tobacco, ⑧ The scope of application of Article 66(3) of the ‘Medical Service Act’ to jointly established medical institutions, ⑨ The concept of spouse as a dependent under the ‘National Health Insurance Act’.
