One of the core goals pursued by the Green New Deal is to achieve carbon neutrality and green growth on a continuous and sustainable basis. The means of achieving these goals are shifting from being manually implemented by humans to being driven by Fourth Industrial Revolution technologies such as artificial intelligence (AI). This transformation marks the emergence of what may be termed the “Fifth-Generation Digital Green New Deal.” This paper analyzes, from an administrative law perspective, how cutting-edge technologies—particularly AI, big data, digital twin, and smart grids—are reshaping administrative functions and regulatory approaches in the implementation of Green New Deal policies.
Traditional regulatory frameworks alone are no longer sufficient to respond effectively to the climate crisis and to achieve sustainable development. As the digital platform government emerges, data-driven, real-time administration and predictive governance become indispensable. However, these transformations also give rise to new tensions with fundamental principles of administrative law, such as due process, legitimate expectations, transparency, accountability, and the protection of fundamental rights.
This study, first, examines how the Green New Deal has evolved into the Fifth-Generation Digital Green New Deal through convergence with digital transformation, and how this has altered the structure of regulatory administration. Second, it explores how AI and related technologies can serve as core tools for risk prediction, real-time verification, and emergency response in specific areas such as chemical substance regulation, carbon border adjustment mechanisms (CBAM), and flood disaster management. Third, the paper identifies the emergence of a new governance model characterized by a smart mixture of traditional authoritative regulation, self-regulation, co-regulation, and regulated self-regulation—referred to here as the “Flexible Steering State” or “Smart State.” Ultimately, the Green New Deal in the era of AI demands not merely a policy shift, but a paradigm transformation in regulatory governance. Korean administrative law must construct a new regulatory governance system within the steering state model, which embraces technological innovation while safeguarding individual rights and maintaining democratic legitimacy through the rule of law.
