제대군인 가산점제도에 관한 연구 - 미국의 법률과 판례를 중심으로 -

국문 초록 (Abstract)

미국의 현행 제대군인 우대조치는 미국 연방법전 제5장에 산재되어 있다. 제5장은 공직시험에서 가산점 부여, 임명 ․전직 ․승진 ․해고상의 유임 ․복직에서의 우대, 임용후보자명부에서 선순위 배치 등의 형태로 제대군인 우대조치를 규정하고 있다.
제5장에 의하여 당해 직위에 자격을 가진 제대군인이 공직시험에서 합격점수를 얻은 경우, 그가 속하는 제대군인의 범주에 따라 취득점수에 5점 또는 10점의 가산점수를 받을 수 있다. 그리고 우대권이 있는 제대군인은 제5장의 임용후보자명부에서 선순위 3배수에 등재되고 3명 중에서 우선적으로 임명될 수 있다.
제대군인 가산점제도는 군복무로 인한 희생에 대한 보상으로, 그리고 군생활에서 민간생활로 쉽게 전환할 수 있도록 한다는 목적을 가지기 때문에 그 정당성이 인정된다. 피니(Feeney) 판결에서 연방대법원은 절대적인 제대군인 가산점제도를 합헌이라고 확인하였다.
미국의 제도 중 가산점을 부여할 수 있는 제대군인과 군복무 제한, 일정한 가족에 대한 가산점 부여, 가산점 부여 절차에서 3배수 법칙 등은 우리에게 시사하는 바가 크다고 할 수 있다.

다국어 초록 (Multilingual Abstract)

Current veterans' preference is codified in scattered provisions of Title 5 of United States Code in America. It provides veterans' preference in the form of additional points being added to passing score in civil service examination, preference in appointments, transfers, promotions, retentions, reinstatements, and higher placement on employment lists of candidates.
Preference eligibles who are qualified for a position by Title 5 and achieved a passing score have 5 or 10 extra points shall add to their numerical rating depending on which of categories of preference provided Title 5 they meet in. And preference eligibles shall be selected for appointment to each vacancy from highest three eligibles available for appointment on employment lists of candidates under the Title 5.
Veterans' preference has been justified as a reward for veterans for their sacrifice for military service and to ease their transition from life in the military back to civilian life. In Feeney, The Court upheld an absolute preference for veteran constitutional.
This article draws the conclusion that we shall adopt the defined veteran, the awarding of preference points to the veterans' kin, the definite number of additional points, the specified period of service, and veterans' placement on the register.
