유럽의 해운서비스의 자유에 관한 연구 = A Study On Freedom To Maritime Transport Services In European Community

The Treaty of Rome provides. basic rules for the functioning of the European Community. It contains provisions implementing four freedoms：movement of goods, movement of persons, provision of services, establishment, and circulation of capital. Freedom of services is one of the fundamental rules of the Common Market. In the Treaty of Rome, general rules on the provision of services are incorporated in articles 49-55. The Common Maritime Transport Policy was created on December 22, 1986, when the Council adopted a package of the following regulations：Reg. 4055/86 on the principle of freedom to provide services between Member States and between Member States and third countries, Reg. 4056/86 concerning detailed rules for the application of Art. 81 and 82 of the Treaty to maritime transport, Reg. 4058/86 on coordination of action to safeguard free access to cargos in ocean trades.Council regulation was a long awaited and important step in the liberalization of the maritime transport market. Three main issues were cargo-sharing agreement between Member States and Third countries, various forms of discrimination on the grounds of nationality, and cabotage.The market has been fully liberalized, but the most controversial liberalization has been that of cabotage. It has been liberalized with regard to mainland cabotage. Some restrictions in island cabotage are still upheld because of its public service aspects, Liberalization did not happen smoothly. The Member States could not reach an agreement as to ist time or limits. They did not want to hand over to the Community their traditional prerogatives regarding transport by sea, even when those were contrary to the objectives of the EC.

국문 초록 (Abstract)

EC 창설의 기본규칙인 로마조약은 상품, 사람, 서비스, 자본의 자유로운 이동을 규정하고 있다. 서비스 자유는 공동시장의 근본적인 규칙 중 하나다. 로마조약에서 서비스에 관한 규정은 제49조 내지 제55조에 규정하고 있다.공동해운정책은 1986년 12월 22일에 창설됐으며, 이사회의 경쟁규칙 집행권은 해상운송 부문에만 한정된다. 이사회는 해상운송에 영향을 미치는 다음과 같은 규칙을 채택했다.：회원국간 그리고 회원국과 제3국간 해운서비스 공급의 자유에 관한 규칙 제4055/86, 조약 제81조, 제82조에 해상운송을 적용하기 위한 세부규칙에 관한 규칙 제4056/86, 해상운송에서 불공정한 가격설정관행에 관한 규칙 제4057/86, 해상화물에 대한 자유로운 접근을 보호하는 조치에 관한 규칙 제4058/86. 이사회 규칙은 회원국과 제3국간 화물분담협정, 다양한 형태의 국기차별, 연안운송 등에 관한 문제를 주로 다루고 있다.
