지방자치단체의 공공은행 설립과 관련한 법률적 제언 — 미국의 North Dakota 은행을 모델로 하여 — = Legal Suggestions Relating to the Establishment of A Public Bank by A Local Government ― Modeled on the Bank of North Dakota in the U.S. ―

다국어 초록 (Multilingual Abstract)

A public bank in the U.S. is a financial institution, owned and operated by a local government on behalf of citizens or regional residents. This paper focuses on researching various legal issues in advance when a local government in Korea tries to establish a public bank in the near future and designing institutional reforms in depth. Precedent experiences and solutions by the Bank of North Dakota until now will be models and suggest precious lessons to Korea. In this country, relevant legal studies surrounding a public bank have not been submitted so far, and thus some contents of this paper are tentative and changeable. Now, however, may be a very adequate time to deal with this legal topic in Korea. Peoples around the world have sympathized with a social reform movement such as “Occupy Wall Street” since 2007 and have begun to keep their eyes on public interests rather than private interests when encountering with Covid 19 since 2020. In order to preserve a public good in each social community, peoples around the world have emphasized on the necessity and value of a public bank pursuing public interest rather than a private commercial bank going after revenues only. Thus, the introduction of a public bank modeled on the Bank of North Dakota and possible legal issues including the establishment, operation, management, oversight and et al of a public bank should be discussed in detail. Part Ⅱ summarizes advantages and disadvantages of public banks in general. Part Ⅲ considers some political and legal issues historically when opening, organizing, and operating the Bank of North Dakota in the U.S. Part Ⅳ suggests systemic reforms on a step-by-step basis by Korean local governments when introducing the Bank of North Dakota model. Part V is a conclusion part of this paper.

국문 초록 (Abstract)

미국에서 공공은행(public bank)이란 시민이나 주민 등을 대표하여 지방자치단체가 소유하고 운영하는 금융기관을 지칭한다. 이 논문은 우리나라의 지방자치단체가 공공은행을 설립하고자 할 때 발생할 수 있는 법적 쟁점을 미리 규명하고 제도적인 시사점을 강구하는데 초점을 맞추고 있다. 외국의 모델로서는 North Dakota주 공공은행 사례가 그 중심에 서게 될 것이다. 우리나라에서는 아직까지 법학 분야에서 이에 관한 선행연구가 없어서 이 논문이 다소 시론적인 가설로 구성될 수 밖에 없다는 한계가 있다. 그러나 여기서의 논의가 매우 시의적절할 수도 있다. 전 세계인들은 2007년 이후 탐욕에 치우친 기존의 금융권에 대항하여 “Wall Street를 점령하자(Occupy Wall Street)”란 사회개혁운동에 공감하여 왔고 2020년 초부터 확산된 코로나 바이러스의 위기를 맞으면서 공공의 이익에 주목하기 시작하였다. 이제 사회 공동체의 공공의 선을 위하여 기존의 수익성에 치중하는 사영 금융기관보다는 공익성을 추구하는 공공은행의 존재 필요성과 그 효용성이 강조될 수 밖에 없는 때인 것이다. 따라서 이 시점에서 공공은행의 도입과 그에 따른 법적 쟁점을 논의하여야 할 당위성은 매우 높다고 판단된다. Ⅱ는 공공은행의 장점과 단점을 간략히 개관할 것이다. 이후 Ⅲ은 역사적으로 미국의 North Dakota 은행의 설립과 조직상의 특징, 운영상의 특징, 주재정에의 기여도 등을 전반적으로 고찰할 것이다. IV는 North Dakota 은행 모델을 도입할 경우 우리나라 지방자치단체가 고려하여야 할 단계적인 제도적 시사점을 제시할 것이다. V는 이상의 논의를 마무리하는 결론 부분이다.
