군사분계선 일대 대북심리전의 적법성: 정전협정 및 남북합의서 위반 여부를 중심으로 = Legality of Psychological Operations Around the MDL: Focused on Whether to Violate the Korean Armistice Agreement and South-North Korea Agreement

Psychological operations carried out around the MDL in the forms of broadcastings do not violate the Korean armistice agreement of 1953 since broadcastings do not qualify as hostilities which means a specific act adversely affects the military operations or military capacity of the adversary or, alternatively, inflicts death, injury, or destruction on persons or objects. Sending leaflets via balloon across the MDL, which have been performed by South Korea`s civic groups, does not directly violate the armistice agreement, because the agreement does not prohibit objects from being made to cross the MDL, but prohibits people from crossing. However, sending leaflets across the MDL is against the purpose of the armistice agreement that prevents the events that might lead to recurrence of armed conflicts. Though the South-North Korea agreement over prohibiting psychological operations around the MDL has been reached in 2004, violation of the agreement is not technically illegal because it is a kind of gentlemen`s agreement that lacks legally binding effect.
