家本位文化与婚姻家庭法移植的冲突 = The Conflict between Family Orientation Culture and Transplanted Marriage Law

국문 초록 (Abstract)

중국 전통농업사회는 가족만능문화를 형성하였는데, 전통법제에서 가족은 국가
와 동일한 구조를 가지며 정치사회윤리가 가족윤리의 기초 위에 형성되었고, 개
인은 가족에 통합되어 있으며, 혼인은 가족 내부에 편입된 것이었다. 근대에 이르
러 서구의 법률이 이식됨에 따라 개인주의가 같이 따라오게 되었고, 혼인은 가족
관계의 핵심이 되어, 부부재산이 가족재산을 덮어버렸다. 家本位와 개인주의는 현
재의 혼인가족법영역에서 충돌하는데, 그 예로 가족의 기능이 과도하게 부과되어
있고 개인의 인격이 과도하게 부풀려져 있으며 남녀평등에 허점이 존재하고 사법
해석이 현실과 유리되어 있다.

다국어 초록 (Multilingual Abstract)

The full‐function family was formed in the traditional agricultural society of
China, in which the family and state was co‐constructed in the traditional legal
framework, political and social ethics was based on the clan ethics, individual
was integrated into the family, and marriage was embedded into the family. The
legal transplantation from the West has brought the individual‐centered
mentality. Marriage has become the core of the family relationship and marital
property has superseded the family property. There is a conflict between the
family orientation and individual orientation in the area of marriage law.
Functions of family are overloaded. Individual personality is over‐emphasized.
The gender equality is for ornament. The judicial explanation is against the
reality.
