해상보험계약의 해석 = The interpretation of the marine insurance contract

국문 초록 (Abstract)

해상보험계약의 해석에 있어서 법원의 가장 중요한 목적은 당사자의 의사를 발견하는 것이다. 우리의 해상보험계약은 영국의 표준해상보험약관을 보험계약의 내용으로 하는 것이 일반적이고, 우리 대법원이 표준해상보험약관에 삽입되어 있는 영국법준거약관의 효력을 인정하고 있으므로 해상보험계약의 해석에 있어서도 우리의 해상보험약관의 해석의 원칙과 영국실무상의 해상보험계약의 해석의 원칙을 함께 이해하는 것이 필요하다.
영국의 표준해상보험약관은 기업보험인 해상보험을 규율하므로 보험자와 보험계약자 사이에 대등한 협상력이 인정되고 있고, 그 작성과 개정에 있어서 영국의 해상보험실무자만이 아니라 유수한 해상보험학자들의 검토를 거치고 있을 뿐만 아니라, 전세계의 해상보험실무에서 작성자불이익의 원칙 등에 있어서 특유함이 인정된다.
또한 우리의 해상보험실무에서 보험자와 보험계약자 쌍방이 한국인인데도 불구하고 영국법준거조항에 따라 영국법을 적용하는데 따라 필연적으로 발생하기 마련인 영국법제와 우리법와의 차이점과 관련하여, 해상보험계약의 해석원칙에 있어서도 해상보험을 규율하는 용어 등의 해석과 관련하여 영국법상 특유한 의미가 인정되는 경우에는 비교법적 검토를 통하여 이를 수정하는 것이 허용된다.

다국어 초록 (Multilingual Abstract)

Recently Korean Maine Insurance Clauses are more inserted than before in our country, but so far the general tendency to insert English Standard Forms such as Institute Hulls Clauses is not changed.
Korean Supreme Court has recognized the effectiveness of English governing clause which is stated 'This insurance is subject to English law and jurisdiction'. And she applies the rules of the interpretation such as 'Rules for construction of policy' of English Marine Insurance Act 1906 First Schedule, etc.
But certain Anglo-american evidence rules such as parole evidence rule are unfamiliar with Korean legal system, and some words such as riots, barratry have the different meaning from Korean law.
And regarding the rule which words will be construed contra proferentem, it is for the economic weak against the stronger in negotiating the drafting of the contracts. But it can be said that Institute Clauses have achieved an institutional or quasi-statutory status such that they should receive simialr treatment.
In construing marine insurance contract between Korean policyholer and Korean insurer, although we recognize the supremacy of the English law and practice over Korean one, the adjustment of the English construction rule to Korean legal environment is essential.
