도시개발사업 내 매장유산 보존조치 개선방안 연구 = A Study on Improvement of Local Preservation Measures For Buried Cultural Heritage in Urban Development Project

국문 초록 (Abstract)

본 연구는 도시개발사업 내 현지보존조치에 대한 문제점을 살펴보고, 실효적인 개선방안을 제시하는데 목적이 있다. 내용을 간략히 요약하면 아래와 같다.
첫째, 사업시행자에게 현지보존에 따른 과도한 책임과 비용부담을 요구하는 것에 대한 개선방안으로 매장유산부담금을 신설하여 매장유산 비용에 대한 국가부담 확대와 국토계획법 상 용적률 완화 적용대상에 현지보존 조치 토지를 포함시키는 방안을 제시하였다.
둘째, 발굴조사 완료 시점에 실시되는 보존조치 평가로 인해 개발계획 변경의 적절한 시기를 놓치는 것에 대한 개선방안으로 개발 초기단계인 시굴조사 완료 시점에 1차적인 보존조치 평가를 실시하여 개발계획을 조정할 수 있는 시간적 완충장치를 마련하는 방안을 제시하였다.
셋째, 현행 보존조치 평가가 평가위원들의 재량적 판단에 지나치게 의존하는 문제에 대해서 항목별 계량화된 평가기준 마련, 이의신청제도 신설하는 방안을 제시하였다.
넷째, 현재 문화유산위원 및 문화유산전문위원의 고고학 전공 편중되어 이해관계 조정에 한계가 있는 것에 대한 개선방안으로 문화유산전문위원 내 도시개발 전문가 비중을 확대하고 이들을 활용해 보존조치 평가를 강화하는 방안을 제시하였다.
다섯째, 이전 복원 유구의 관리 및 역사공원 효용성 문제에 대해서 강화된 관리체계 개편 등의 제도개선 및 보존유형에 맞는 공원 조성방안을 제시하였다.

This study examines the problems related to local preservation measures in large-scale development projects and presents effective plans for improvement.
A brief summary of the content is provided below.
First, to relieve the excessive responsibility and cost burden on project operators for local preservation, a new Cultural Heritage Excavation Fund will be established to increase national aid for cultural property costs and which will include local conservation land in the scope of mitigation under the National Territory Planning Act.
Second, there is a lack of timely adjustments in the development plans due to the fact that the preservation measure evaluation is conducted only at the completion of the excavation survey. To compensate for this, a temporary preservation measure evaluation was to be conducted at the completion of the trial excavation in the initial stage of development, which allowed a certain temporal buffer to better coordinate development plans.
Third, the following suggestions that address the issue of the current evaluation of preservation measures being excessively dependent on the discretionary judgment of the evaluation committee were presented: preparation of quantified evaluation criteria for each item, establishment of an objection system, and appointment of urban development experts to the preservation measure evaluation committee.
Fourth, as an improvement measure for the limited coordination of interests resulting from the current over-concentration of archaeology majors among cultural heritage members and experts, the weight of urban development specialists within the cultural property committee members will be increased to strengthen the assessment of preservation measures.
Fifth, regarding the management of previous restoration remains and the effectiveness of historical parks, a plan to improve the system and create a park suitable for the type of preservation, such as the reorganization of the reinforced management system, was proposed.
