법적 냉소주의와 침입절도피해의 신고 = Legal Cynicism and the reporting behavior of burglary victims

국문 초록 (Abstract)

범죄피해의 신고행동은 범죄피해를 경험하는 사람이 많지 않고, 범죄피해를 경험하지 않은 사람은 표본에서 제외되므로, 범죄피해조사가 초대규모가 아니라면 사실상 신고행동에 대한 양적 연구가 매우 어렵다. 따라서 이 연구는 16명의 대학생에 대한 비표준화된 심층면접을 통해 주거침입절도 범죄피해의 신고에 영향을 미치는 요인들을 살펴본다.
이 질적 자료에 대한 분석결과는 침입절도피해의 신고여부에 두 가지의 중요한 요인들, 즉 범죄피해의 심각성과 법적 냉소주의가 주로 영향을 미친다는 것을 보여준다. 다시 말해서, 범죄피해의 물적, 심리적 규모가 클수록 신고를 더 많이 하며, 경찰의 활동이 정당하지 않고, 주민들에게 냉담하며, 그리고 공공안전을 위한 사명감이 적다고 느낄 때(법적 냉소주의) 시민들은 자신의 범죄피해를 잘 신고하지 않는 것으로 나타났다.
일반적으로 피해의 심각성 요인은 정책적으로 개입할 수 있는 여지가 거의 없지만, 시민이 느끼는 법적 냉소주의는 충분히 개선할 수 있는 것 이며, 경찰활동을 개선함으로써 신고율을 높일 수 있다.

다국어 초록 (Multilingual Abstract)

It is difficult to do a quantitative research on reporting behavior using a small- or a middle-sized sample, because the subjects of crime victimization survey hardly experience crime victimization and so they are excluded in a sample of reporting researches. So this study does an unstandardized depth interview on 16 university students. The results of analysis on this qualitative data show that two important factors have an effect on reporting behavior - the seriousness of victimization and legal cynicism. In other words, when their monetary or psychological size of victimization is bigger, citizens do more reports. And when citizens feel that law or police is illegitimate, unresponsive, and ill equipped to ensure public safety(legal cynicism), they do less reports. Generally, there are no room of an intervention in seriousness factor of victimization, but we can improve citizen's a legal cynicism and so we can increase the rate of reporting.
