국문 초록 (Abstract)

포즈너는 세계금융위기를 예측 못한 세계적 명성의 거시경제학자들이 “사상의 역사”에 무지하다고 하였다.(2009) 그는 또 거시경제학자들이 “이데올로기”에 영향 받아서 서양 여러 국민과 정치인들을 황무지에서 방황하게 하였다라고 하였다. 이 논문은 최근 한국 법철학회가 한국의 법체계(헌법)와 관련하여 자유주의를 중심 테마로 한 데 대한 재검토와 성찰의 계기로 쓰여진 것이다. 한국에 있어서의 “자유주의 대 공동체주의”는 “자유주의와 개인주의가 같은 내용이다”라는 선입견에서 출발한다고 보여지고, 초기자유주의의 개인주의적 인간관과 사회관과 근대 후기의 자유주의는 변용하고 있다는 것을 지적하는 것이다. 다른 한편, 2008년 가을 세계금융위기 이후 심각하게 문제되는 신자유주의와 자유지상주의 그리고 역사적 의미에서의 자유방임주의를 시대 정신을 중심으로 살펴보는 것이다. 논문 필자는 법철학 내지 법리학적 개념(Jurisprudence concept)을 시대 정신(Zeit-geist)의 산물로 보고, 근대 시민 사회를 제3기로 나누어 자유주의의 변용을, 세계대공황 이전의 현대까지 요약했다. 이 논문은 원래 근대에서 현대까지의 세계대공황기와 뉴딜 시대까지 포함하는 것이었다. 지면상 (1)에서는 세계대공황 이전의 자유주의까지 취급한다.

In Failure of Capitalism(2009), Richard Posner points out defects of Professions who have failed to predict financial crisis of 2008. He also points that macro-economists have been influenced by "Ideology" and they have let politicians and people wander around waste land. What kind of defects macro-economists have had? Posner answers, they do not care about "History of Thought" in financial economics. What kind of Ideology have let people & politicians in Financial Crisis(2008) wander around waste land? And How have those misunderstandings,
prepositions, stereo-types about liberty, freedom, liberalism(Classical and Modern) had in the process of history developed to form Neo-Conservatism beginning 1980' until the collapse of 2008 World financial mechanism?
