미국 대통령의 전쟁권은 미국 헌법상 대통령과 의회의 권력분립의 핵심적인 문제 중 하나이다. 미국 헌법은 전쟁권을 대통령과 의회에 분산하여 부여하고 있는데, 대통령에게는 전쟁수행권이, 의회에는 전쟁선포권이 부여된다. 그러나 이러한 분산된 권력은 현실적으로 대통령에게 유리하게 작용하여, 대통령은 의회의 동의 없이도 전쟁을 수행하는 경우가 많았다.
미국 헌법의 전쟁권 조항은 대통령에게 군통수권을 부여하는 제2조 제2항과 의회에 전쟁선포권을 부여하는 제1조 제8항에 규정되어 있다. 헌법제정자들은 대통령에게 전쟁수행권을 부여함으로써 대통령이 전시 상황에서 신속하고 유연하게 군사적 조치를 취할 수 있도록 하였다. 또한, 의회에 전쟁선포권을 부여함으로써 대통령의 전쟁권을 견제하고, 전쟁에 대한 국민의 의사를 반영하기 위한 장치를 마련하였다.
미국의 전쟁권은 미국 건국 초부터 논쟁의 대상이 되어 왔다. 초대 대통령 조지 워싱턴은 의회의 동의 없이도 독자적인 전쟁수행권을 행사하였으며, 이러한 행태는 이후의 대통령들도 이어받았다. 그러나 베트남 전쟁의 장기화와 패배는 미국 사회의 전쟁에 대한 인식을 변화시켰고, 1973년 의회는 「전쟁권 결의」(The War Powers Resolution)를 제정하여 대통령의 전쟁수행권을 제한하고자 하였다.

미국의 전쟁권은 여전히 의회와 대통령 간의 갈등의 주요 원인으로 남아 있다. 의회는 대통령의 전쟁수행권을 제한하고자 노력하고 있지만, 대통령은 헌법에 명시된 전쟁수행권을 행사하기 위해 노력하고 있다. 이러한 갈등은 미국의 외교안보 정책에 큰 영향을 미칠 것으로 예상된다.

The U.S. Constitution distributes the right to war to the president and Congress, and the president is given the right to wage war and the Congress is given the right to declare war. However, this decentralized power worked in the president's favor in reality, and the president often waged war without the consent of Congress.
The provisions of the right to war in the U.S. Constitution are stipulated in Article 2, Paragraph 2, which gives the president the right to command the military, and Article 1, Paragraph 8, which gives the Congress the right to declare war. Constitutional makers gave the president the right to wage war, allowing the president to take military action quickly and flexibly in wartime situations. In addition, by granting the Congress the right to declare war, the president's right to war was checked and a mechanism was prepared to reflect the people's intention to war.
The right to war in the United States has been a subject of debate since the beginning of the founding of the United States. George Washington, the first president, exercised his own right to wage war without Congress' consent, and this behavior was inherited by subsequent presidents. However, the prolongation and defeat of the Vietnam War changed the perception of the war in American society, and in 1973, Congress enacted the War Rights Resolution to limit the president's right to wage the war.
