「사회보장기본법」 및 개정안의 문제점과 개선방안 = The problem and reformation for the Fundamentals of Social security Act

다국어 초록 (Multilingual Abstract)

The purpose of this study is to analyze the problem and to find the way of reformation the Fundamentals of Social security Act. For this analysis, German social security system, SGB (Sozialgesetzbuch) is useful resolution to the problem of the Fundamentals of Social security Act of Korea. It is stipulated specifically and systemic about general principles to regulate social security system. In conclusion, to make new clause for the definition of Social security, problem solving way and procedure like SGB model is necessary for the revision of the Fundamentals of Social security Act. Futhermore, the concept of social security of the Fundamentals of Social security Act have to include birth, infant care, children and juvenile education. Also, the right for social security is needed to stipulate specifically as actual effecting right. In the same context, that rights implicate preventive protection to the social security net. Especially, this study considered the bill of Park, Keun hye, which is composed changes of paradigm for social security, In result, there`re no clear legal points difference between bill and current law. However, above points from the SGB could compensate the defects of the concept life time social security net in the bill.
