의원입법에 의한 행정규제의 분석 = A Study on the Regulatory Policy by Assemblyman Legislation

Recently, it has been realized by most states that only increasing regulation cannot maintain the efficient social development. Therefore, deregulation is being carried out, and the regulatory reform has been changed in terms of quantity to quality and management. A successful reform must be based on legislative support.
In most democratic states, assemblyman legislation is the fundamental legislative form. In case of Korea, many regulations are made through assemblyman legislation. Therefore, assemblyman legislation is the main legislative source for regulation and meanwhile it is an important method of the regulatory reform as well. During the reform, either making rational regulation or abolishing irrational regulation must be approved by legislation, which shows that national assembly has played a core role in regulatory reform.
Compared with systematical governmental regulatory reform, there is no examining or approving process in the regulation made through assemblyman legislation, which has led to irrational regulation and become a barrier to the regulatory reform.
This study analyses dual-legislative system in Korea, and explains assemblyman legislation`s impact on regulation, and tries to search new methods of improving quality of regulation by assemblyman legislation.
