Among recent issues in regulation, punitive civil penalties are arguably the most controversial. Describing a civil penalty as “punitive” exposes its true nature as a penalty—a reality that has long been masked by the justification of “disgorgement of unlawful economic gains.” Although the prevailing academic view treats such penalties as a mere “means to ensure administrative effectiveness,” a major gap exists in practice, given that civil penalties are mostly sanctions for violations of statutory duties rather than administrative duties. As a sanction for violating statutory duties, the civil penalty sparks unconstitutionality debates because it infringes upon the inherent nature of the judiciary, which dictates that the imposition of penalties on citizens must be conducted through a judicial trial. In particular, it is difficult to escape unconstitutionality from the perspectives of the principle of statutory reservation (Vorbehalt des Gesetzes), the principle of due process, and the right to a trial.
Since establishing a precedent in 2003 that ruled the civil penalty constitutional, the Constitutional Court of Korea has not seriously re-examined its unconstitutionality. In contrast, the Supreme Court of the United States, the European Court of Human Rights, the European Court of Justice, and the supreme courts of European states have either declared the civil penalty itself unconstitutional or recognized its constitutionality only under certain conditions. The essence of this issue lies in setting the conditions under which the imperative validity granted to the administrative sanctioning act can be justified. Reflection on the fact that imperative validity cannot be unconditionally justified naturally calls for a reversal of the Constitutional Court's precedents regarding the constitutionality of civil penalties. Just as the Constitutional Court demands legislative improvement duties from the National Assembly and the executive branch, the Constitutional Court itself bears the duty to improve judicial precedents.
