The Act on the Improvement of Urban Areas and Residential Environments(hereinafter referred to as “the Act”) designs an improvement project by combining public and private laws. In an improvement project, many entities appear under various names. However, it is not easy to distinguish whether each entity holds a public legal status or a private legal status. This problem is also evident in the names ‘owner of a plot of land or structure’ and ‘truster’ used in a trust-based improvement project. A trust-based improvement project refers to a situation where a trust business entity is designated as the sole project implementer to carry out redevelopment or reconstruction projects. In a trust-based improvement project, the public and private legal status of the owner of a plot of land or structure must be distinguished to determine the appropriate types of lawsuits.
The Owner of a plot of land or structure in a trust-based improvement project can acquire the public legal status of a member participating in the project at the stage of designating the project implementer. The term ‘owner of a plot of land or structure’ as used in the plenary meetings of owners of plots of land or structures refers to the members participating in the project(Article 48 of the Act). On the other hand, the truster is a private legal status acquired by the owner of a plot of land or structure through a trust contract. This applies to a ‘truster’ deemed to be the owner of a plot of land or structure(Article 2, Paragraph 9 of the Act). The Act equates the truster with the association member(Article 39, Paragraph 1, first sentence), where the ‘truster’ refers to the members participating in the project. Therefore, a lawsuit for confirmation of the status of a truster under the first sentence of Article 39, Paragraph 1 of the Act is a dispute concerning the confirmation of the status of a member participating in the project, and is to be conducted as a public law party suit. As such, the legal meaning of the owner of a plot of land or structure must be interpreted by considering the overall framework of the Act and the characteristics of a trust-based improvement project.
