Korea's rapid aging population and nursing workforce shortages in long-term care hospitals have created an urgent need for digital technology adoption, including care robots, digital twins, and AI monitoring systems. This study systematically analyzes legal issues arising from digital transformation in long-term care hospitals across three domains: healthcare law, data law, and liability law.
In the healthcare law domain, the Digital Medical Products Act enacted in 2025 represents progressive legislation with a software-centered regulatory paradigm, introducing component performance evaluation and change management plans for AI updates. However, limitations remain in the Medical Service Act's restriction of telemedicine to healthcare professional-to- professional interactions and ambiguous boundaries regarding non-medical personnel operating digital devices. Additionally, while the Integrated Care Support Act scheduled for 2026 implementation explicitly mentions AI and IoT-based integrated support information systems, specific guidelines remain insufficient.
In the data law domain, key issues identified include practical difficulties in applying strict consent systems for sensitive information under the Personal Information Protection Act to patients with cognitive impairment, technical complexities in pseudonymization and anonymization processes, and data silo phenomena due to inadequate data standardization. The absence of information blocking prevention legislation similar to the EU's EHDS or the US 21st Century Cures Act highlights the lack of balance between data utilization and privacy protection.
In the liability law domain, significant progress has been made with the AI Basic Act (effective 2026) establishing safety measures for high-impact AI and the Digital Medical Products Act enabling product liability application to digital medical devices. However, responsibility gaps arising from AI's autonomy and opacity remain unresolved.
The current legal framework reveals two fundamental limitations: lack of coherence between legal systems and structural contradictions in data governance. These issues cannot be resolved through piecemeal amendments to individual laws. Therefore, comprehensive Healthcare Data Act legislation is needed, covering the entire lifecycle from data definition to utilization, security, and liability, while legally guaranteeing enhanced patient data sovereignty, mandatory interoperability, and information blocking prevention.
