무용 저작권 정책 수립의 주요 쟁점 및 토대 구성 -케이팝 안무 저작물을 중심으로- = Key Issues in Establishing Copyright Policies for Dance: A Focus on K-pop Choreographic Works

다국어 초록 (Multilingual Abstract)

This study aims to identify key issues for the robust establishment of dance copyright policies and to construct the foundations to address these issues, with a focus on establishing such policies in a broader category that includes K-pop choreographic works. To achieve this goal, the trends in copyright policies in Korea, as well as the copyright laws and judicial precedents related to dance and choreography, were examined and analyzed. As a result, this study (1) establishes a comprehensive framework that outlines the basis, purpose, and direction for the development of such policies, and (2) attempts to thematically conceptualize dance copyright and related terms, as well as classify works based on the degree and depth of creativity. (3) In particular, the creativity of a choreographic work is defined here as “the extent to which it is transformed into a unique work of dance art or a continuous flow referred to as dance, regardless of how basic, traditional, public, or formal an element or movement may be.” (4) From this perspective, K-pop choreographic works fall into the category of pure creation, as a new work of art created by the choreographer, utilizing all elements and methods of dance creation. Specific examples of such rights and subjects of copyright are presented(A case of dance becoming a master : choreography works, secondary works, editorial works, video works, business works, A case where dance is not the master : Joint works, combined works). It is anticipated that these findings will serve as the basis for the establishment of dance copyright policies and align with the current copyright policies to a significant extent.
