저작인격권의 형사적 보호 = A Study on the Criminal Protection of Moral Rights

국문 초록 (Abstract)

본 고는 악곡의 일부분을 잘라서 웹사이트에서 휴대폰벨소리 등으로 판매하는 서비스 업체에 대한 저작인격권침해 주장 사례를 중심으로 저작인격권의 형사적 보호에 대하여 살펴본다. 우선 이론적으로 저작인격권에 대한 법적성격 및 입법례에 대한 논의를 검토하고, 실무적으로 현행 저작권법 해석을 둘러싸고 논의되는 성명표시권 문제점을 간략히 보며, 동일성유지권의 침해법리에 대하여 그 입법연혁과 입법례를 고려하면서 침해요건 등을 정리하여 디지털 시대에서의 역할에 관련된 논의를 살펴본다. 그리고 우리 저작권법이 특유의 형사처벌 요건으로 규정한 ‘명예훼손’ 부분에 대하여 학설과 판례의 경향에 따른 해석론을 살펴보며 이 사안의 경우 처리방향을 제시한다.
디지털기술의 발전으로 저작물의 개변이 용이하게 되었고 저작인격권의 침해도 용이하게 되었는바 향후 디지털 시대에서 저작물에 투영된 저작자의 인격적 특성을 보호할 수 있는 효과적인 방법인 저작인격권을 어느 수준까지 보호하여야 할지는 보다 실증적인 자료연구와 법률실무의 축적을 통하여 정립되어야 할 과제임이 분명하다.

다국어 초록 (Multilingual Abstract)

This article start at the website(online ‘digitalized music’ provider)’s ‘abridged’ Ring- tone, Ring-tune and Ring-back tone service case at which copyright holder insist his moral right. First, this article briefly introduce the historical development and nature of moral right and especially the problem of ‘right of paternity’. Second, this article explain the diversity of ‘right of integrity’ and discuss the legal problem and role of it at digital era. Third, this article try to construe the meaning and reason of ‘defamation’ condition that is necessary to criminal punishment. Lastly, this article concludes that moral rights can serve an im- portant social function in emerging information society and can expand authors into con- tinuing controls to a degree.
