풀뿌리민주주의의 실현을 위해 헌법상 보장된 제도로써 지방자치단체는 주민의 복리증진 차원에서도 필요한 제도이지만, 주민의 생명과 재산의 보호를 위한 치안서비스의 역할도 필요한 종합적인 행정체제를 갖추어야 할 필요성을 가지는 제도이기도 하다. 그러므로 자치경찰제는 경찰조직이나 작용의 근원을 지역주민이 형성한다는 민주주의의 본질을 보다 명확하게 나타낸다는 점에서 지방자치제와 더불어 풀뿌리민주주의를 실현하는 필수적인 제도가 된다. 이 자치경찰제는 대한민국 정부수립 이후 1980년대 이전까지는 그 도입에 대한 활발한 논의를 할 수 없었던 시대적 상황하에 놓여 있었으나 1980년대 이후 도입관련 추진논의가 활발하게 진행되고 참여정부의 대선공약으로 ‘자치경찰제’도입이 내세워짐으로써 정부차원에서 자치경찰제 도입과 관련한 노력이 시작되었다. 그리고 2004년 1월16일에는 국정과제로서의 분권의지에 대한 대국민 약속으로써 지방분권특별법을 제정하였고, 이를 계기로 실무추진기구로써 편성된 행정자치부장관 소속하의 「자치경찰제실무추진단」은 「자치경찰법(안)」을 마련하여 2005년 11월3일 정기국회에 제출하였다.
본 연구는 자치경찰제의 개념과 도입의 기본방향 그리고 자치경찰법안의 주요내용 및 문제점 등에 대해서 고찰해 보고 자치경찰법안의 문제점과 관련하여 나타난 대안으로서의 경찰법개정안이나 시도공동안 등 다른 법안에 대해서도 살펴보았다. 하지만 궁극적으로 살펴보려 하였던 것은 자치경찰제의 도입에 따른 기대효과 발전방안이었으며, 자치경찰제 도입·운영의 기대효과로는 시·군·구 실정에 맞는 맞춤형 경찰운영이 가능해진다는 것과 지방자치행정을 구현할 수 있다는 점, 경찰 상호간의 경쟁을 통한 치안서비스를 주민이 제공받을 수 있다는 점과 궁극적으로 안전을 통한 주민의 삶의 질이 향상된다는 점 등이 있었고, 자치경찰제의 발전방안으로서는 첫째, 광역치안서비스를 위한 시도공동안과의 절충이 필요하다는 것과 둘째, 자치경찰제의 원활한 시행을 위한 재원확보방안 셋째, 자치경찰제가 지방자치단체장의 권력에서 그 임무와 책임을 공정하게 운영될 수 있도록 하는 보장방안 넷째, 적극적인 홍보로 자치경찰의 인식을 개선해야 된다는 것으로 주민에 대한 홍보와 자치경찰관 대내·외적을 대상으로 하는 홍보전략이 있어야 한다는 것 다섯째, 다양한 지역치안서비스를 개발해야 한다는 것으로, 합리적이고 효율적인 순찰프로그램을 개발하고 다양한 신고 및 대응시스템을 마련하며 지역 치안정보의 데이터베이스화에 대한 방안 마지막으로 지구대와 치안센터를 활용하여 주민의 접근성을 향상시키는 방안을 제시하였다.

The local autonomy system guaranteed by the Constitution to realize the grass-root democracy also conduces to citizens'' welfare. The police services to protect citizens'' life and properties require a centralized administrative system. Therefore, the autonomous policy system may be essential to realize the grass-root democracy together with the local autonomy system, because the police organization or activities originate from local citizens only to enhance democracy. Since inauguration of the government in 1948 until 1980''s, the autonomous police system could not be even discussed due to the political situations. However, since 1980''s, introduction of the autonomous police system began to be discussed positively, and after all, the autonomous police was put up as one of Presidential candidate''s political commitments. Thus, as the Participatory government was inaugurated, the autonomous police system began to be discussed more actively. Later on January 16, 2004, the Participatory government had Decentralization Special Law enacted as promised for the people, and thereupon, "Working-level Task Force for Autonomous Police" was established to drafted "Autonomous Police Law" and put forward it before the National Assembly on November 3, 2005.
This study reviewed concept of the autonomous police and basic direction for its introduction and examined major contents and problems of Draft Autonomous Police Law and reviewed their solutions, while examining Draft Amendment of Police Law and Draft Local Autonomous Police Law suggested in common by metropolitan and provincial administrations. Anyway, this study aimed ultimately to analyze the expected effects of the autonomous police system introduced. The examples of such expected effects are customized police services to meet the conditions of cities, counties and wards, integration of local autonomous administrative services, improved police services due to competition among local police offices, and ultimately citizens'' improved life quality. The directions for development of the autonomous police system can be suggested as follows; first, it is necessary to compromise between Draft Autonomous Police Law and the common draft suggested by metropolitan and provincial administrations; second, it is essential to secure the financial resources for smooth operation of the autonomous police system; third, it is required of the autonomous police to perform their duties in a fair way, not being dominated by the local autonomous administrators; fourth, it is necessary to stage positive PR to improve citizens'' perception of the autonomous police, while helping autonomous policemen to maintain effective public relations; fifth, it is necessary to develop diversified local police services including reasonable and effective patrol programs, while operating diverse call and response systems and databasing the police information; finally, it is necessary to use the regional police stations and police centers to enhance citizens'' accessibility to police services.
