법학전문사서의 교육과 육성에 관한 연구 = A Study on Educating and Training Law Librarians

Korea's legal education system has been changed dramatically, adapting U.S. style law school system, based on the “Act on Establish and Promote Law Schools”. The 25 law schools have been established and approved by Ministry of Education, according to the Act . However the Act has no provisions or clauses related to educating and training law librarians.
As you know law, librarians are professional experts, who have usually taught ‘legal research’ and ‘legal writing’ in the U.S. law schools. They shall have competition in researching legal materials and provide reference services to students, lawyers and faculty members. To be professional experts, they shall study very hard in Library Science and Law. According to recent survey, more than 53% of U.S. law librarians have dual degree in Master of Library Science and Juris Doctor(JD). American Bar Association's guideline on law librarian has required chief law librarian shall have JD degree. Almost all law schools shall prefer the reference law librarian to have JD degree.
However in Korea, the roles and responsibilities of law librarians have not identified. The librarians who work at law school were not educated or trained to be professional experts who can perform and support ‘legal research’ and ‘legal writing’ and who can provide well-researched reference services. Usually Korean law librarians, who had worked at same university libraries of law school, were just dispatched by the order of university authority.
In recent years, there have been some articles arguing to educate and train law librarians. However these articles are with the viewpoint from librarian science, just comparing degrees that law librarians shall have to take. There was no legal article which focus on these issues.
The purpose of Korean “Act on Establishing and Promoting Law Schools” is to educate qualified lawyers. As you know the education of qualified lawyers shall start with legal research, which shall be taught by well educated and trained law librarians. Therefore educating and training law librarians shall be a nationwide issued leading the success of law school in Korea. Ministry of Justice, Ministry of Education, Korea Bar Association, National Assembly Library shall cooperate to establish and fulfil their roles related to this project. Especially National Assembly Library, which has educated on ‘legal research’ to diverse governmental officers and provided reference services to members of National Assembly, shall establish an “law librarian education center” to train and educate law librarians.
To support these activities, we shall propose following amendment clauses of laws and regulations related to law librarians: Paragraph 2 of Article 6 of “Library Act” shall be amended to inserting that the entitlement of law librarian shall be regulated in “Act on Establishing and Promoting Law Schools”. The classification and entitlement of law librarians shall be inserted in newly proposed Article 17-2 of “Act on Establishing and Promoting Law Schools”. This proposed article shall also contain a provision, the state shall be responsible to educate and train law librarians. Following the proposed article, the physical requirements of the law library, the number of law librarians working in the libraries, the certification of the law librarians and the certified education center of law librarians shall be described in the proposed Article 10-2 of Presidential Decree of the Act. Following the proposed Article 10-2 of Presidential Decree, National Assembly Regulation on the National Assembly Library shall be amended to adapting the clause of the certified “law librarian education center”

국문 초록 (Abstract)

우리나라가 법학 교육 방법을 완전히 혁신하여 미국식 로스쿨 시스템을 도입하고, 법학전문대학원 교육을 실행한지도 5년이 되어가고 있다. 미국식 로스쿨 시스템의 가장 큰 특징 중의 하나는 법률정보조사와 법률문장론을 교육․지원하고, 회답 서비스를 제공하는 법학전문사서에 있다고 할 수 있다. 그럼에도 불구하고 로스쿨 시스템을 도입하면서, 법학전문사서의 교육과 육성에 대해서는 심각하게 고민하지 않았던 것으로 보인다. 미국의 경우 법학전문사서에 대한 학위 기준은 없지만, 최근 들어 문헌정보학과 법학학위(Juris Doctor : JD) 모두를 취득한 법학전문사서가 전체의 50% 이상을 차지하고 있다. 특히 미국의 경우 법학도서관장이나 회답업무를 수행하는 법학전문사서에 대해서는 법학학위의 취득이 요구되고 있다. 그런데 법학 관련 전문지식을 습득하고 법률정보조사의 교육을 지원하며 회답업무를 처리할 수 있는 법학전문사서를 단기간에 양성하는 것은 쉽지 않다. 그러므로 공신력 있는 국가기관에서 관련 교육기관을 설립하여 운영함으로써 실무에 적합한 맞춤형 법학전문사서를 양성하는 것이 필요하다. 이를 위해서는 관련 법령의 개정이 우선적으로 필요한바, 다음과 같이 개정(안)을 제시한다.
법학전문사서는 「도서관법」에 따른 사서가 아니라, 「법학전문대학원 설치․육성에 관한 법률」에 따른 사서라고 할 수 있으므로, 「도서관법」 제6조 제2항에 ‘다만, 법학전문사서의 자격요건 등에 대해서는 「법학전문대학원 설치․육성에 관한 법률」에 따른다.’는 단서를 추가할 필요가 있다.
또한 「법학전문대학원 설치․육성에 관한 법률」 제17조의2(법학전문도서관 및 법학전문사서)를 신설하여, 법학전문도서관에 대하여 규정하고 법학전문사서에 대한 구분과 자격조건에 대한 근거 규정을 도입하며, 동법 시행령에서 법학전문사서의 교육과 육성을 위한 공인교육기관을 지정하도록 할 필요가 있다. 나아가 「국회도서관법」에 따른 국회도서관 직제를 개정하여 국회법률도서관(국회도서관 법률정보실)의 업무 가운데 하나로 법학전문사서의 육성을 위한 교육의 실시에 관한 사항을 삽입할 필요가 있다. 이를 바탕으로 법학을 전공한 국내외 박사 및 변호사 등 법률정보조사와 관련된 전문인력을 운용하고 있으며, 법률정보 회답업무를 수행하고 있고, 법률정보조사에 대한 강의를 지속적으로 수행하여 온, 국회법률도서관이 “(가칭)법학전문사서교육원”을 설립하여 법학전문사서를 육성함으로써 국가 법률문화의 발전에 기여하도록 하여야 한다.
