헌법재판소 탄핵 결정의 정치적 의미 = Would Congressional-court Governance based on Judicial Review Enhance Democracy? Focusing on the Korean Constitutional Court’s Decisions on Presidential Impeachment

다국어 초록 (Multilingual Abstract)

This paper aims to examine the inter-connected relationship between politics and law through determining the presidential impeachment of 2004 and 2016. This study could be described as two dimensions: the political role of Constitutional Court of Korea and co-relationship between judicial review and constitutional democracy. This paper discusses the role that Constitutional Court of Korea can play in improving the conditions for democracy and playing an political role in defending constitutional law. The judicial review can be positively functioned under a dual democracy, which is broadened the definition of representation and overlapping majorities. This paper presents the dual democracy as an alternative frame for analyzing constitutional democracy.
