아동 보호를 위한 외국의 아동 학대 신고제도 연구 = Mandatory Reporting System for the Protection of Children's Rights in Major Countries

The purpose of this study is to examine mandatory reporting systems of seven countries such as America, Canada, Australia, United Kingdom, Taiwan, Japan, and Korea. To detect abused children easily, the system of UK focuses on improved information sharing and inter-agency cooperation. But most countries incrementally expand mandatory reporting requirements in legislation. Some of these countries adopt various ways to promote telephone reporting, in most countries the agencies of government are responsible for investigation of reported cases, and increase the number of the agencies for easy access. This paper discusses how these are likely to apply in the Korea situation.

국문 초록 (Abstract)

본 연구는 미국, 캐나다, 오스트레일리아, 영국, 대만, 일본, 그리고 한국 7개국의 아동보호서비스 관련법의 신고 조항과 관련 기관의 운영 현황을 비교 분석하였다. 피학대 아동의 발견을 위해 영국은 관련법을 개정하여 관련 기관의 협력과 모든 아동의 데이터 구축을 의무화하고 있는 것으로 나타났다. 그러나 대부분의 국가는 신고 대상이 되는 아동학대와 방임의 유형, 신고 사유, 그리고 신고의무자의 범위를 확대하거나 신고의무 불이행에 대한 처벌 규정을 강화하고 있다. 그리고 국가에 따라서 신고를 활성화하기 위한 다양한 방식의 신고 전화 운영과 더불어 대부분 정부기관을 중심으로 현장조사를 하고 기관수를 늘려 피학대 아동의 접근성을 높이고 있다. 이러한 연구결과를 바탕으로 신고의무 불이행에 대한 처벌규정 신설, 관련 기관 협력의 의무화, 상담원의 강제조사권 부여, 대폭적인 아동보호전문기관의 증설 등이 논의되었다.
