다국어 초록 (Multilingual Abstract)

In pre-revolutionary Europe there was no mass conscription, widely regarded as an “instrument of tyranny.” However, as it became impossible to meet the military needs of France with volunteers, the National Convention issued the two decrees of 1793: the levée des 300,000 (in February) and the levée en masse (in August). It must be noted that each of these decrees was a one-off mobilization rather than a law advancing the establishment of a legal institution of military conscription, the first example of which is the loi Jourdan (or loi Jourdan-Delbrel) of 1798. The nascent French republic at war against the rest of Europe could maintain its forces because of the 1798 law of national conscription and the administrators’ pertinacious efforts to enforce it. Thus formed, the French revolutionary army became a symbolic figure during the 19th century as a “citizen army.” This article is an effort to enable reflections on this first legal institution of national conscription in Europe by introducing the reader to the mental world of politicians of the time, the parliamentary debate on the Jourdan Law, and its social impact.

국문 초록 (Abstract)

프랑스혁명 이전 수 세기 동안 유럽에서 대규모 징집은 거의 존재하지 않았으며 혁명 초기까지도 “폭정의 도구”로 간주되었지만, 혁명가들의 기대와 달리 자원병 제도로는 프랑스군의 병력 수요를 충족시킬 수 없게 되자 1793년 2월의 “30만 동원령”과 8월의 “총동원령”이 내려졌다. 그런데 1793년의 총동원령은 기실 일회성 동원령이며 법 제도로서의 국민개병제라 할 수 없다. 오히려 프랑스에서 국민개병제를 처음 제도화한 것은 흔히 “주르당 법” 또는 “주르당과 델브렐의 법”이라 불리는 1798년의 모집령이었다. 전 유럽을 상대로 전쟁을 치른 신생 공화국의 군대는 1798년의 국민징집 법제화와 그것을 강제하기 위한 집요한 행정적 노력 덕분에 겨우 전투력을 충원할 수 있었다. 이런 과정을 거쳐 형성된 프랑스 군대는 19세기를 지나면서 ‘시민군’으로서 상징적인 존재가 되었는데, 본고는 군대와 사회의 관계에 관한 당대 정치인들의 사유, 그리고 1798년의 주르당 법을 둘러싼 논의, 그것이 가져온 사회적 파장 등을 소개함으로써 근대 유럽 최초의 국민개병제법에 대한 고찰을 돕고자 한다.
