수형자 교정 프로그램의 분석과 개선방안 = The Approach to Improve Correctional Program for Prisoners

다국어 초록 (Multilingual Abstract)

In this article, I would like to explore a little further the right direction and problem of correctional program for prisoners under sentence who are confined in prison in Korea.
The concept of character building for prisoners under sentence who are confined in Korea is stipulated in the korean correctional related statute as correction or rehabilitation since education-penal paradigm which character building for prisoners under sentence who are confined in prison is expressly provided as aim of penal for them.
The character building for them as special educational public-service(goods) in Korea correctional related statute has been divided correction(rehabilitation) and education in prison.
Therefore, I asserted in this study the problem of the existing related study in my opinion and raised my objections against the existing study through interdisciplinary aspect inclusive of correctional social welfare and correctional psychology and so on.
As a consequence, I asserted the korean correctional program problem and educational one in view of the production ideology for correctional public service(goods) and the production regime and the production contents and the production technique against cognitive behavioral therapy through the path-breaking theory.
Therefore, form what has been discussed above, it seems reasonable to conclude that the character building for prisoners under sentence who are confined in prison should have the new path-breaking program and policy including production ideology of special educational public service and production regime and production contents.

국문 초록 (Abstract)

본고에서는 교도소에 구금된 수형자에 대한 교정 프로그램의 문제점과 개선방향에 대하여 탐구하였다. 교도소에 구금된 수형자에 대한 인격형성(교화)의 개념은 형벌의 목적을 교화라고 분명히 명시한 교육형이념부터 교정관련법에 규정되어 왔다.
우리나라의 교정관련법에서 특수교육공공재로서의 인격교육의 내용은 교정과 교육으로 구분되어 있다. 여기에서는 이에 관한 기존의 선행연구들의 문제점을 사견으로 지적하고 교정복지와 교정심리학 등 학제적인 관점에서 기존의 선행연구들에 맞서는 저자의 반론을 제기하였다. 따라서 여기에서는 교정공공재의 생산이념과 생산체제 및 생산내용과 기존의 인지심리적 치료기법에 맞서는 생산기법의 관점에서 교정 프로그램의 문제점과 개선방안을 주장하였다. 따라서 앞에서 언급하였듯이 구금된 수형자에 대한 인격교육은 특수교육공공재의 생산이념과 생산체제 및 생산내용을 포함하는 새로운 경로혁신적인 프로그램과 정책을 가져야 한다는 방향으로 본고의 결론을 내리게 되었다.
