제헌헌법상 경제조항의 이념과 그 역사적 기능

다국어 초록 (Multilingual Abstract)

This paper tries to explain idea and characteristics of the economy-relating articles of the Korea Constitution of 1948 by the concept of 'Economic Donghwa-ism'(同和主義). Donghwa-ism is the term which I proposed in a previous paper to specify the ideology of the Korea Constitution of 1948, not the same as, but more similar to, communitarian republicanism than individualistic liberalism.
In sum, the economy-relating articles of the Constitution invested the government with the mission that it should persue the economic equality of nationals as well as the balance and growth of the nation economy. But it was open to the issue of harmony or priority of those goals, and did not determine any specific economic order such as liberal economy or controlled economy as means for achieving such goals. Only the minimum of the liberal democratic limits was set up: the formal principle of statutory reservation and the guarantee of comparable exchange value of private property in case of nationalization or establishing public ownership.
