The principle of trust protection is based on legal stability derived from the second clause of Article 37 in the Constitution, and is defined in the second clause of Article 4 in the Administrative Procedures Act and in the third clause of Article 18 of the Framework Act on National Taxes.
The Courts is defined the principle of trust protection through judicial precedents. The requirements of the principle are as followed.
“In order to apply the principle of trust protection in the regal relation with anadministrative authority, firstly an administrative authority should officially express an opinion which can be a subject of trust; secondly there should be no causes attributable to an individual to trust the opinion expression of the administrative authority; thirdly a person concerned should do an action because of trusting the opinion expression; there should be an infringement of individual’s interests because the administrative authority did an opposite action of its previous opinion expression; finally there would be no remarkable harm to public interests or third party’s right interests ifthe authority takes an administrative measure according to its opinion expression.”
Looking into court’s precedents in connection with permission and license of real estate, the Constitutional Court seeks a judgment ground for the infringement of property rights in the second clause of Article 13 in the Constitution, saying that all citizens should not be deprived of their property rights by retroactive legislations. Therefore, in terms of revising laws, the Court excludes untrue retroactive legislations from an object of protection. True retroactive legislations also are strictly applied when public interests are bigger than private interests to protect. Moreover, the Constitutional Court is actually in passive position to apply principle of trust protection in the content of public expression, demanding that citizens should predict the possibility of changing laws according to social changes.
The Supreme Court strictly interprets the definition of public expression. Also, it excludes principle of trust protection when there is a remarkable infringement of public interests or when infringing public interests is bigger than infringing private interests. However, it is relatively generous when there are no public interests between a petitioner and an authority.
Although it is difficult to classify the position of the courts, it is clear that they are passive to acknowledge the importance of private interests in cases of permission and license of real estate. That is, the courts tend to consider that public interests are more important than private interests.
Therefore, I propose that the courts should closely examine and compare the interests of both parties when they apply the principle of trust protection in the cases that there are public interests despite of illegality in due process of law on the one hand, and there is unrestored loss of private interests on the other hand.
