디지털 샘플링은 컴퓨터 등을 이용한 디지털 방식으로 기존의 음악저작물을 녹음, 분석, 변조 및 재녹음하는 일련의 과정을 뜻하며, 또한 이러한 과정을 통해 기존의 음악저작물 중 일부를 새로운 음악저작물을 만들기 위해 사용하는 방식을 의미한다. 이러한 디지털 샘플링은 이전의 저작물 일부를 추출, 변조 및 재녹음하기 때문에, 작사 • 작곡및 녹음물에 대한 복제권과 2차적저작물 작성권 등을 침해할 소지를 지니고 있다. 이에 본 논문은 디지털 샘플링에관한 이론적 연구를 위하여, 미국 판례의 동향을 살펴보고자 한다.
미국에서 디지털 샘플링의 저작권 침해여부에 대한 법적 판결이 이루어진 최초의 대형 사건은 Grand 니prightMusic v. Warner Bros. Records 사례다. 이 사례에서 법원은 십계명 제7편 ‘도적질하지 말라!’라는 성서문구를인용하면서 저작권침해를 인정하였다. 2003년의 Newton v. Diamond의 경우, ‘최소한의 이용 원리’와 ‘실질적 유사성 기준’ 등을 적용함으로써 적법한 디지털 샘플링의 기준을 제시하였다. 그러나 2004년의 Bridgeport Music,Inc. v. Dimension Films에서는 ‘라이선스를 얻어라! 그렇지 않으면 샘플링은 금지된다’는 원칙을 내세움으로써 디지털 샘플링 자체를 엄격히 제한하고 있다. 현재 미국 법학계는 이러한 사례들을 중심으로 디지털 샘플링의 저작권침해 여부에 대한 활발한 논쟁이 이루어지고 있다.

Digital Sampling is the process of digitally recording, analyzing, manuipulating and re-recording sound. It also
refers to the practice of using a portion of a previous sound recording in a new recording. In a area of pop-songs,
especially Hip-Hap, R&B and Rap Music, digital sampling is used very popularly. But, the advent of this digital
sampling technique where creators of new music make use of protected material has raised issues of copyright
infringement. This article reviews the cases of U.S. to make a study about the rule of digital sampling.
Grand Upright Music v. Warner Bros. Records was the first major case holding that digital sampling is a
copyright violation. Quoting the Biblical commandment “Thou shall not steal”, Distrinct Judge of Grand Case held
that the use of three words and a portion of the music from the original songs was a per se copyright violation.
In Newton v. Diamond (2003), adopting the test of de minimis use and substantial similarity, the court of appeals
held that the use of the three notes was de minimis and therefore not substantially similar. But, In Bridgeport
Music, Inc. v. Dimension Films (2004), the court of appeals announced a new bright-line rule for sound recording
copyright infringement, “Get a license or do not sample!”
