제주해녀문화의 보전과 활용을 위한 관련 협약과 법률, 조례 적용

국문 초록 (Abstract)

이글은 유네스코의 『무형문화유산 보호 협약』(2003)과 한국의 『문화재보호법』(2015 일부개정), 『무형문화재 보전과 진흥에 관한 법률』(2015)의 지향성과 차이점을 분석한 후, 제주특별자치도 『해녀문화 보존 및 전승에 관한 조례』(2009)와 『해녀문화산업 진흥 조례』(2014 전부개정) 등을 기반으로 인류무형문화유산 제주해녀문화의 보전과 활용을 위한 관련 조례 제정과 민관산학연단의 협력의 필요성을 제시하였다.
해녀 공동체 성원들의 관점에서 『제주특별자치도 해녀 진료비 지원 조례』와 『제주특별자치도 해녀박물관 설치 및 운영조례』가 인류무형문화유산 제주해녀문화의 보전과 활용에 이바지하고 있음을 인식해야 한다. 가칭 『제주특별자치도 무형문화유산 보전과 진흥을 위한 조례』, 가칭 『제주특별자치도 유형․무형유산 문화산업 진흥 조례』, 가칭 『제주특별자치도 해녀어업 관리 및 활용을 위한 조례』관련 조례의 제정과 시행을 체계적으로 추진하기 위해서는 제주특별자치도의 문화체육대회협력국, 관광국, 해양수산국, 제주특별자치도의회 부처간 상호 협력과 민관산학연단의 지속가능한 연계망 구축, 공동체 성원들의 세대간 전승력 강화가 반드시 필요하다.

다국어 초록 (Multilingual Abstract)

This article suggested the necessity of cooperation among citizens, governments, industries, colleges, institutions and groups, and of establishing the related ordinances for the preservation and utilization of the Culture of Jeju Haenyeo (Women Divers) inscribed on the Representative List of Intangible Cultural Heritage of Humanity based on the Ordinance of Conservation and Tradition of the Culture of Haenyeo (2009), the Ordinance of Promotion of Culture Industry of Haenyeo of the Jeju Special Municipal Government (2014 the Fulfil Amendment), etc. after analyzing the orientation and differences among the Convention for the Safeguarding of the Intangible Cultural Heritage (2003), the Law of Cultural Properties Protection (2015 the Partial Amendment), and the Act of Intangible Cultural Properties Preservation and Promotion (2015).
In terms of the members of Haenyeo community, it should be recognized that the Ordinance of Support of Medical Treatment Fee, and the Ordinance of Establishment and Management of Haenyeo Museum of Jeju Special Municipal Government are being served to preserve and utilize the Culture of Jeju Haenyeo (Womne Divers) inscribed on the Representative List of Intangible Cultural Heritage of Humanity. In order to systematically push ahead with establishment and execution the tentatively named Ordinance of Preservation and Promotion for the Intangible Cultural Heritage of the Jeju Special Municipal Government, the tentatively named Ordinance of Promotion for the Tangible and Intangible Heritage Culture Industry of the Jeju Special Municipal Government, the tentatively named Ordinance of Management and Utilization for the Haenyeo Diving Fisheries, it must necessarily need the inter-cooperation among the Bureau of Culture, Sports and Outsider Cooperation, the Bureau of Tourism, the Bureau of Ocean Fisheries of the Jeju Special Municipal Government, and the Council of Jeju Special Municipal Government, the sustainable network building, and the enhancement of viability of the members of Haenyeo community from generation to generation.
