사회적 시장경제 = Social Market Economy

다국어 초록 (Multilingual Abstract)

The Constitution of Korea declares that the economic order of Korea is based on the market economy, but the state can regulate and coordinate the economic activities of individual for various purposes. Most scholars of constitutional law and the Constitutional Court called this economic order of Korea as social market economy. However this views are not appropriate, because the social market economy refers to the economic order which was established in Germany after the 2nd world war. And the social market economy has some special characters which are different from the Korean economic order.
In social market economy, the protection of competition is one of the most important duties of state, and the competition policy becomes a top priority in economic policy and is equally considered very important also in social field. The government can intervene in the market only for the order policies but not for the process policies. However the Korean economic order has not such characters.
In spite of that, it is obvious that the social market economy could be one of the alternatives for the development of Korean economic order. In order to develop the Korean economic order to the better economic order which can pursue harmony between individual economic freedom and social balance, it is necessary to research the social market economy more in depth and to find implications for the further development of Korean economic order.
