한국상법상의 전자선화증권 모델의 특징과 활성화 = The Characteristics and Activation of Electronic Bill of lading in Korean Commercial Law

국문 초록 (Abstract)

화물이 선화증권보다 먼저 도착하고 있는 경향이 있어 수입업자는 선화증권없이 물품을 인수할 수 없다. 이러한 문제를 해결하기 위해 CMI는 1990년에 전자선화증권에 관한 CMI규칙을 제정하였고 볼레로 규약집에 근거하여 볼레로 서비스는 전세계적으로 안전하고 전자적인 상거래정보의 전자적 이전을 위한 사업간 플랫폼에 의해서 제공되고 있다. UNCITRAL은 일부 또는 전부 해상에 의한 국제해상운송계약에 관한 새로운 협약을 준비하여 왔다.
한국은 2007년에 전자선화증권을 규율하기 위해 상법 제5편에 있는 해상법을 개정하였고 상법의 전자선화증권 규정에 관한 시행령이 권리등록소의 요건과 절차 그리고 전자선화증권의 발행과 유통을 다루기 위해 제정되었다. 본 논문은 국내외의 전자선화증권 법률과 규정 그리고 국제협약을 다루고 있으며 본 논문의 목적은 국내적으로 전자선화증권의 이해와 활성화에 기여하는 것이다.

다국어 초록 (Multilingual Abstract)

There is a tendency that the cargo arrives ahead of the B/L. In this case, the importer cannot take delivery of the cargo without the B/L. For solving this problem, CMI enacted CMI Rules for Electronic Bill of Lading in 1990 and on the base of RuleBook, Bolero Service is provided by a cross industry utility platform for the secure, electronic transfer of commercial trade information world wide. UNCITRAL has prepared the new convention on contracts for the international carriage of goods wholly or partly by sea.
Korea revised Maritime Law in Korean Commercial Law Section 5 to govern the Electronic Bill of Lading in 2007 and Enforcement Decree of Electronic Bill of Lading Section of Korean Commercial Law was enacted to cover requirement and procedures of the Title Registry and issuance and negotiability of Electronic Bill of Lading.
This paper deals with Rules and Regulations on Electronic Bill of Lading in Korea and abroad and international convention and the purpose of this paper is to contribute to development of Electronic Bill of Lading in Korea and aborad.
