고전기 아테네의 종교적 추방자에 관한 연구: 추방이유와 복귀 상황

국문 초록 (Abstract)

고전기(기원전 480년-기원전 338년) 아테네에서는 12차례의 불경죄 재판이 열렸는데, 비극시인 아이스퀼로스, 철학자 아낙사고라스와 디아고라스, 소크라테스, 조각가 페이디아스, 엘레우시스비의 우롱사건, 헤르메스상 파손사건, 연설가 안도키데스, 사제 아르키아스, 일반시민 테오게네스 및 라케다이모니오스의 누이, 테오세베스가 그것들이다. 이 재판에서 헤르메스상 파손자들과 비의우롱 관련자들, 소크라테스는 사형에 처해졌고 아르키아스도 중형판결을 받았으며, 아낙사고라스, 페이디아스, 디아고라스, 테오세베스는 추방되거나 판결 이전에 미리 도망했다. 그들이 도망한 것은 추방형 이상의 중형 판결이 내려질 것을 우려해서였다. 헤르메스상 파손자들과 비의우롱 관련자들 중에서 도망하여 사형을 모면한 자들도 많았다. 테오게네스와 아이스퀼로스는 고의적이지 않았다는 가벼운 형을 받았던 것 같고 라케다이모니오스 누이는 무고로 석방되었다. 안도키데스는 10여년 이상의 해외생활을 감안하여 방면되었던 것 같다. 그렇다면 불경죄재판에서는 모르고 저지른 행위였거나 거짓 고소한 경우를 제외하고는 추방이나 사형 등의 중형이 내려졌음을 알 수 있다. 이는 고전기 아테네인들이 불경죄를 심각한 위협으로 여겼음을 말해준다.
중형을 피해 도망한 자들은 귀환하지 못했거나 장기간 해외에서 고생한 후 어렵사리 귀환했다. 아낙사고라스, 페이디아스, 디아고라스, 테오세베스는 귀환 여부가 확인되지 않고 있다. 헤르메스상 파손자들과 비의우롱 관련자들 중에는 30여명의 도망자가 있었는데, 가장 먼저 귀환한 알키비아데스도 8년의 해외생활 후에야 귀환이 허용되었다. 알키비아데스는 군사적 능력을 인정받아 귀환했지만, 그의 귀환을 반대하는 세력이 여전히 존재했다. 나머지 도망자들도 기원전 403년의 대사면령을 계기로 귀환하여 정상적인 시민생활로 복귀했다. 아테네의 역사상 이처럼 대대적으로 종교적 도망자들이 귀환한 사례는 없었다. 그것은 펠로폰네소스전쟁과 심각한 정치적 내분이라는 특수한 상황 속에서 가능한 것이었다. 아테네의 종교적 추방자(도망자)들의 해외체류 기간과 귀환상황을 살펴보면, 당시 아테네에서 종교적 불경에 대한 반감이 매우 컸음을 짐작할 수 있다. 그것은 신앙이 아테네인의 정체성 형성에 중요한 역할을 했음을 보여주는 것이라 하겠다.

다국어 초록 (Multilingual Abstract)

This article intends to examine the cases of religious exiles in classical Athens and find out some characteristics shown in them. As far as extant sources permit, the list of those who were certainly accused of impiety are as follows: (1)Aischylos, (2)Anaxagoras, (3)Pheidias, (4)Diagoras, (5)those who were involved in the profanation of the Mysteries(415 BC), (6)those who were implicated in the mutilation of the Hermai(415 BC), (7)Andokides, (8)Sokrates, (9)Archias, (10)Theosebes, (11)Theogenes, (12)a sister of Lakedaimonios. Among them, some of (5), some of (6), and (8) were sentenced to death. (9) must have been given a decision of heavy penalty, and (2), (3), (4), some of (5), some of (6), and (10) were banished or fled abroad in order to avoid heavy punishments. On the other hand, (12) was given a verdict of not guilty and acquitted, and (11) was punished with a small fine, and (1) and (7) might be released or delivered judgements of light penalty.
Those who fled from Athens on account of religious impiety had few opportunities to return to their home country or only could return after so long stay in foreign lands. As far as I confirm, only those exiles who were involved in the profanation of the Mysteries and the mutilation of the Hermai were permitted to return to Athens. Some able men such as Alkibiades and Adeimantos could return earlier than other persons, after 8 years' exile. Athenians allowed their return, hoping that Alkibiades and his colleagues could win brilliant victories in the Peloponnesian War. Great anxiety about the gloomy future of their country made Athenians allow their return irrespective of wrongs done by them. Other exiles could return as a result of the general amnesty decree in 403 BC, after 12 years' stay abroad. Exceptional conditions that made the return of Alkibiades and other exiles possible, and very long period of stay abroad show that Athenian usually put great importance on the matter related to their religious faith and ceremonies.
