중국의 법원개혁과 사법독립 = 제 1, 2, 3차 〈법원개혁 요강〉 분석

다국어 초록 (Multilingual Abstract)

This article aims at analyzing the court reforms and judicial independence in China. The roles of courts in the reform era have been continuously strengthened, and this phenomenon is especially discernable recent years. What it is important is whether this trend results in the judicial independence or not. To this end, this paper investigates the past court reforms which have started in 1999, focusing on the actual relationships between the court, the communist party, and government. It argues that Chinese courts depend on the communist party and government seriously, and court reforms have chiefly addressed the intra-court problems, excluding the judicial independence from the major goals of the court reforms. As a result, judicial independence in China will not come true in the forseeable future, although the roles of courts will continue to be strengthened.
