자동차보험법상 보험사고시 중고부품사용가능성에 대한 소고 - 해외사례를 중심으로 - = Consideration of the possibility of using the used parts in accidents in Auto Insurance Law - Focusing on the overseas cases -

다국어 초록 (Multilingual Abstract)

In the case of total loss due to a car accident, if the insurance company pays as much as the price used. However, in the case of partial loss offender is put back into a state of the car just before the accident. It is due to this principle of restitutio in integrum. Essential prerequisites to the use of a car used parts is a professional quality management for used parts. And transparency must be the premise of the market with respect to the distribution of quality control components. Used parts tracking system should be established.
Systems should be established to prove liability in liability issues relating to defects in used parts and, specifically, the repair shop should be in charge of responsibility management system. And ways to solve this problem is through business liability insurance and guarantee insurance are presented. The car used parts used are environmentally and economically meaningful in terms of the premiums can be discounted basis. If using a new increase in the exchange value of the vehicle insurers, as in the case of Germany shall apply to the insurance scheme that pays for the repairs after deducting it. This is because in accordance with the principle of compensation indemnity. It will also be introducing an insurance scheme to take off in the way of premiums, subject to repair used parts, as in the case of the United States.

국문 초록 (Abstract)

자동차사고로 인하여 전손에 이른 경우라면 중고가격에 해당하는 교환가액만큼을 보험사가 지불하게 되지만 분손에 이른 경우에는 자동차의 수리로 사고 직전의 상태로 되돌려 놓아야 한다.
이러한 것은 원상회복의 원칙에 의한 것이다.
자동차중고부품의 사용에 있어서 필수적인 선제조건은 중고부품의 전문적인 품질관리가 우선선행되어야 한다. 그리고 품질관리가 된 부품의 유통에 관하여 시장의 공정화 및 투명화가 반드시전제되어야 하는데 이를 위하여 중고부품의 추적시스템이 완비되어야 한다. 중고부품의 하자에 관한 책임문제에 있어서 증명책임체계를 정립하여야 하고 구체적으로 자동차를 수리하는 공업사에게소비자와의 관점에서 책임관리체계에 책임의 상대방이 되도록 하되 이 문제는 영업책임보험과 보증보험을 통하여 해결하는 방안을 제시해본다. 이러한 자동차중고부품의 사용은 환경적으로나 경제적인 측면에서 의미가 있으며 보험소비자의 보험료 할인의 근거 및 동기가 될 수 있다.
만일 중고부품이 아닌 신제품을 사용하여 해당 차량의 교환가치가 증가한 경우 독일의 경우와같이 보험사는 이를 공제하는 방식을 취하여 공제분을 제외한 수리비를 보험금으로 지급하는 방식도 엄격하게 실천적으로 적용하여야 한다. 이는 실손보상의 원칙에 부합하는 것이기 때문이다. 또한 미국의 경우처럼 중고부품으로 수리를 전제로 하는 보험료의 할인의 방식을 취하는 보험제도도도입하여야 할 것이다.
