This paper examines the special disaster legislation enacted by Japan following the 2011 Great East Japan Earthquake and compares it with the Korean legal framework. Through this comparison, it aims to suggest directions for improving Korea’s disaster law system. The most significant implication of Japan’s special legislation after the Great East Japan Earthquake is that, in the event of a large-scale disaster, recovery cannot be carried out swiftly and effectively under the existing general legal framework alone. Through the Act on Special Zones for Reconstruction following the Great East Japan Earthquake, Japan introduced special measures exempt from conventional legal restrictions in key areas of disaster recovery such as land expropriation, cadastral readjustment, and housing reconstruction. In addition, the Act on Support for Reconstructing the Lives of Disaster Victims established a phased and systematic support system based on different methods of housing reconstruction.
Although Korea’s disaster law system is structured around the four phases of prevention, preparedness, response, and recovery, it still shows limitations in the actual recovery process. Specifically, the system lacks mechanisms for expediting land expropriation procedures, applying special provisions for cadastral adjustment, and systematizing support for housing reconstruction. Moreover, there is insufficient legal and institutional linkage between emergency relief and permanent housing recovery, resulting in a structural problem of prolonged housing instability among disaster victims. Korea’s disaster law is also characterized by a hierarchical, central government–led management structure, which fails to adequately reflect key elements of disaster resilience such as collaborative governance, reduction of disaster vulnerability, and trauma recovery. The 2017 Pohang Earthquake case revealed the limitations of Korea’s legal response to socio-natural disasters and highlighted the need for a transitional justice perspective.
Therefore, it is necessary to accurately identify our own issues and promote legal reforms by drawing appropriate lessons from Japan’s special disaster legislation. The following sections specifically address the areas in need of improvement.
