아동권리협약 채택 20주년의 의미와 과제 = A Significance and Task the 20<SUP>th</SUP> Anniversary Convention on the Rights of the Child

국문 초록 (Abstract)

아동은 앞으로 미래를 이끌어갈 중요한 자원이며 자산이다. 아동은 잘 성장하고 자신의 잠재력을 최대한 발달시키면서 성장할 권리를 가지며, 사회나 성인들은 이를 지원할 의무를 가지는 것이다. 따라서 이들에게도 독립적인 인간으로서 성인과 동등한 권리가 있다는 것이 유엔 아동권리협약의 지향점이다.
아동의 권리보장 문제는 아직 우리 사회에서 그리 익숙한 개념은 아니지만 국제적으로는 아동권리에 대한 관심이 매우 높은 것이 현실이다. 특히 아프리카 일부 국가에서의 아동이 처한 모습을 보면, 그 나라의 사회문화적인 수준을 알 수 있을 정도이다.
현대사회에서는 수동적인 아동보호에서 능동적인 아동권리 보장이라는 적극적인 아동권리사상이 발달하였지만 아동이 보호의 대상에서 권리의 주체로 인식되기까지 높은 벽을 지나야 했으며 앞으로도 무한한 인내가 필요할 것이다.
아동의 인권을 침해하는 것은 헌법에서 보장하는 국민의 기본권을 위반하는 것이다. 동시에 정부가 아동의 인권 보호를 소홀히 하는 것은 명백히 국제법의 위반이기도 하다. 아동권리협약’ 제19조 제1항은 “당사국은 아동이 부모, 후견인, 기타 아동 양육자의 양육을 받고 있는 동안 모든 형태의 신체적 · 정신적 폭력, 상해나 학대, 방임 또는 유기, 성적 학대를 포함한 혹사나 착취로부터 아동을 보호하기 위하여 모든 적절한 입법적 · 행정적 · 사회적 및 교육적 조치를 취하여야 한다”라고 규정하였다.
따라서 정부는 아동권리협약이 채택된 20주년을 기념하고 그 숭고한 이념을 보급하기 위하여 협약에서 규정한 권리 내용을 전 국민들에게 보급할 수 있는 방안의 마련과, 기존 국내법이 아동권리협약의 내용과 배치될 경우에는 개정을 위하여 노력하여야 할 것이다.
아동의 권리를 지키고 실현시키는 일은 정부, 비정부, 국제기구, 가정, 학교를 망라한 우리 모두의 책임이기 때문이다.

다국어 초록 (Multilingual Abstract)

Children are important resources and assets to lead the future. Responsibility for the rights of children will ultimately hinge on the translation of agreed principles into national laws, plans of action, and allocation of resources. Children have a privilege to develop their potential capacities while growing up, so that the society or adults will have the obligation to support them. Therefore they are also independent humans what shall enjoy same privileges as adults. This is the convention on the Rights of the Child.
The problem with the rights of the child is the society not being familiar with the concept in which it only draw interests in the international scene. In particular, if you see a child in a critical condition in any country in Africa, it could be associated with culture.
In modem society, protecting children from passive to active rights of children that rights of child idea is developed positively. However, it must pass through high walls and it will need infinite perseverance before the target of protection of child recognizes to the subject of rights. Infringing the constitutional rights of child is to guarantee people's basic rights are violated. At the same time, the governments neglect of the child's human rights protection is clearly a violation of international law.
The Convention on the Rights of the Child, article 19 para. 1, clearly states that, "States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse, while in the care of parents, legal guardians or any other person who has the care of the child."
Therefore, the government should stipulate right information and action plan to all people, and exert more efforts if the existing laws placed with contents of convention on the rights of child for revision, as well as celebrating 20th anniversary the convention on the rights of child for which was adopted by governments to bring about noble ideas.
To protect and work to realize the rights of a child is not only our responsibilitybutalsothegovemments, non-government and international organizations, home and school.
