Article 34, section 5 in Lawyers Act overly limits the activity of non-attorneys, punishing those non-attorneys who engage in legal consultation gainfully.
This paper points out that. the above article illegalizes the lawfulness of the service contract between the attorneys and non-attorney professionals. The Korean Bar Association irrationally attempts to punish those who share the reward/income between the contractors concerned according to a certain rate agreed upon. Such interpretation, I believe, is unconstitutional because it obstructs the freedom of occupation of non-attorneys, contradicting the rule of the free market system.
