헌법에 의한 한국 현실의 진단

다국어 초록 (Multilingual Abstract)

As you know the world is continuously, all the more, rapidly changing. Korea also have had the experience of fast change, which mainly consists of industrialization and democratization. 'June Struggling in 1987' made the
way into real democratization, thereafter Korean society seems to have a great leap toward the advanced nation.
Behind the colorful, various changes in the world, we could pick up 3 characteristic points, which are democratization, remarkable change toward free market economy and globalization. And with them, the neoliberalism, which advocates a thorough competition in maket place, has made a great portion in every way of human life. In the result of it, the law of jungle has been prevailed. At the time of 2009, besides the world trend of excessive competitions, Korean society sees another important gloomy aspects causing restrictions
in human rights. At first many critics contends that new government started in Feb. 2008 should have the responsibility in contraction of human rights. Freedom of speech or freedom of expression, in fact, have notably
contracted under this government, compared to the late government. But its factors or causes are diverse. We could point out 4 factors, namely, ① a legal frame restricting the freedom of speech which has been existed, ②
unreasonable restriction by this conservative government attaching importance to 'the establishment of law and order', ③ operation of private censorship especially toward expression in cyberspace, ④ lack of understanding of judicial institutes including court and prosecution. And the polarization deepening along with the latest global economic crisis creates very critical problems, so to speak, downfall of middle class, broader weakening of economic human rights connecting to ruining of all the society.
