유럽 프로축구클럽으로부터 본 중국 프로축구클럽 관리의 법제도적 과제 = China Professional Soccer’s Legal Challenge and Implications of the European professional football League

다국어 초록 (Multilingual Abstract)

Based on an analysis of the development, competition system and the management of the Europe Football League, this paper reaches the conclusions that the revenues of the championship league remains in good condition, which makes its operation most successful among the secondary professional soccer leagues in the world. The income of football clubs mainly derives from tickets to the matches, radio and television broadcasting rights as well as league sponsors. Besides, venue rental and other forms of income also enjoy an increasing high status. The league is extremely popular among multitudes of fans. Both league naming rights and television broadcasting rights maintain reasonable operation. Reconstruction of stadiums and potential financial crisis exist in the league. By drawing on the successful management pattern of the league championship, four recommendations are proposed for the purpose of promoting the development of Chinese First League Football Match. They are as follows – to make television relay well – operated, to actively exploit the league naming clients, to foster the audiences in an all round way, and to set up an utterly new league system.
In order to check the stereotype of football clubs from big four UEFA leagues, statistical methods were undertaken to analyze the match performance indicators from UEFA Champions League of seasons 2009-2013. The results showed that Spanish clubs showed highest performance in goal scoring related variables, upcoming with German clubs, while Italian clubs came the last. Spanish clubs topped the attacking and organizing variable, and once again Italian clubs lay at the bottom. Italian clubs gained most fouls and yellow cards, German clubs won most tackles, while English clubs won most aerial duels, Spanish clubs lay middle in all the defending variables, Statistical results have certified almost all the stereotype.
This kind of statistical analysis can be introduced into Chinese clubs to help them prepare for the Asian Champions league and help them identify and choose foreign players.
By means of documentary, questionnair, expert interview and statistic, this article made a discussion and research on current China football issues. The result showed that there were a serial of issues such as unsolved systematic and mechanical issues, sharp collective and individual competence disadvantage, deep competitive sport crimes in football circle, football developing imbalance in different areas, deficiency in reserve resource and youth football players and obvious social and ecological issue. According to these results, the authors made some suggestions on the future development of China’s football.

국문 초록 (Abstract)

본 논문은 중국 프로축구클럽팀의 관리 및 운영의 법정책적 개선방안을 고찰하기 위해 프로축구가 가장 활성화한 유럽 프로축구리그의 사례를 제시하였다. 구체적으로는 중국 프로축구협회가주관하는 분쟁해결제도의 개선방안을 논의하였으며, 중국 《반독점법》시각에서 본 중국 프로축구리그의 법제도적 쟁점이 개선되어야 한다.
유럽 프로축구리그의 관리제도는 주로 정책적 내용에 근거하여 고찰하였다. 빅5 가운데 프랑스를 제외하고 영국, 독일, 스페인, 이탈리아 등 시장이 큰 4대 유럽 프로축구리그의 경영현황을 상세히 고찰하였으며, 프로축구의 지속적인 활성화를 위해 반드시 필요한 유소년축구 육성에 대한부분 또한 짚어보았다. 이러한 유럽 프로축구리그에 대한 법정책적 고찰은 궁극적으로 프로축구리그 운영을 뒤늦게 시작한 중국에 많은 시사가 될 것이다. 크게 중국 中甲리그와 중국의 전체 프로축구리그가 법제도적으로 개선되어야 한다.
급속한 성장을 이루고 있는 중국 프로축구리그의 법제도적 개선방안은 아래와 같은 입법 및 개정이 요구된다. 중국축구협회의 법적 지위를 분명히 하기 위해서는 첫째, 단행법으로 《중국축구법》을 제정하여 법에 따라 독립적으로 민사권리를 보유하며 민사책임을 부담하는 사회조직임을명확히 해야 한다.
다음으로 중국축구협회 내부에 스포츠중재위원회, 구체적으로 규율위원회와 소송위원회를 적극활용해야 한다. 또《중국축구협회 약관》의 내부적인 분쟁해결방식 또한 개선하여야 한다. 스포츠중재위원회가 중재를 하고, 중재결정 불복시에 소송을 진행해야 한다.
또한 중국축구협회 차원의 법제도개선의 일환으로 공청회제도를 적극 활용해야 한다.
이와 함께 영국 프리미어리그 방식을 참고하여 시합 운영 전체를 새로운 프로축구리그 관리회사에 이관하여 효율적으로 시합을 추진하고, 회사법에 따라 이사회를 조직하여 전문경영인(CEO)을선임하여 시합관리에 대한 브랜드 유지, 비즈니스 확장, 시합운영 등의 업무 책임 등을 중국 프로축구리그에 도입하는 방안을 검토해야 할 것이다.
