초국가적 범죄에 대한 동북아 국가 간 경찰활동 협력체계 개선방안 = Police and Judicial Co-operation on Transnational Crime in North-East Asia

국문 초록 (Abstract)

오늘날 국가는 테러를 비롯하여 대량살상무기의 확산, 범죄, 마약, 환경오염과 같은 초국가적 위협에 의한 도전을 받고 있다. 이러한 위협 가운데 하나로 초국가적 범죄를 들 수 있다. 이러한 초국가적 범죄가 증가함에 따라 범죄의 예방, 수사, 재판 및 처벌을 위해 외국과 상호 긴밀한 협력이 요구되고 있다. 그러나 고전적 형사사법공조체계가 오늘날 세계화?광역화되고 있으며, 양적?질적으로 변화하고 있는 초국가적 범죄에 대한 실효적인 대응수단으로 역할을 할 수 있는지에 대해서 의문이 제기된다. 따라서 고전적 형사사법공조체계를 실제로 효과적이 되도록 재편해야 할 필요성이 강조되고 있다. 대부분의 선진국들이 초국가적 범죄에 대응하기 위하여 다자간의 공조체계를 구축하거나 각각의 형벌권을 일부 이양하는 방식으로 독자적인 범죄통제기구를 설치하고 있는 추세를 고려해보면, 초국가적 범죄의 위험이 수적?질적으로 높은 동북아지역에서 한편으로는 고전적 협력체계를 보다 심화시키고, 다른 한편으로는 고전적 협력체계를 넘어서, 초국가적 범죄에 대하여 사전적 및 사후적으로 보다 신속하고 효율적으로 대응할 수 있는 협력체계를 구축할 가능성을 검토해보아야 할 것이다.

Transnational threat to national security is one of the most serious challenges we face. When we identify the transnational threats, terrorism, drugs, environmental degradation, proliferation of WMD and transnational crime could be included. Transnational crime is increasing, therefore, there is a growing need of co-operation with other countries to prevent, prosecute and punish it. However, it is in question that the traditional judicial co-operation could solve the problem at hand. Thus, it is needed to reorganize the traditional judicial co-operation system. Most of developed countries have established an independent organization to combat the transnational crime. There is a need to improve the traditional co-operation more effectively. Furthermore there is also a need to establish an independent organization to respond and prevent transnational crime more flexibly and effectively.
