거버넌스의 관점에서 본 옴부즈만: 과제와 한계 = Ombudsman Seen from Governance Perspective: Issues and Limits

다국어 초록 (Multilingual Abstract)

In spite of the growing interests on ombudsman, informations about ombudsman is not provided well enough nether in Korea nor abroad. In order to challenge to such a paucity of information on ombudsman, it is intended to develop a perspective to embrace diverse views on the functional locus of ombudsman. Civil society centered approach, administration centered approach, nation centered approach have been identified as useful tools to understand ombudsman`s role but to integrate them all under the schematic guidance of governance is suggested most useful. Along side with such approaches, representative role, remedical role and punitive role are identified. And institutional approach and environmental approach are identified as ways of identifying such roles but to be integrated as a dynamic strategy to overcome deficiencies of each individual approach. Reviewing the role of ombudsman under such strategy, it is known that there are limitations of not to displace roles of tripartite branches of government or not to violate the principle of separation of powers even though each roles of ombudsman identified above resemble roles of such governmental branches.
