      『DNA 신원확인정보의 이용 및 보호에 관한 법률』에 대한 비판적 검토

      Recently with the murder and child sexual violence increasing, as of April 15, 2010, Law about the use and protection of DNA identification information-which specifies that DNA of the brutal criminals with a high second conviction rate should be taken, data-based and used for preventing crimes and arresting criminal-is being enforced. However, academic authorities and civic groups argue that the relevant crimes are too wide and collecting the accused`s DNA sample is against the Constitution`s Presumption of Innocence. Also, they indicate that the information would leak without permission, the information would be abused and it would infringe the principle of the Constitution. Accordingly, I am going to examine the problems and suggest the solution in this survey in advance of the enforcement. The first is about the title of the law. Law about The Use and Protection of DNA Identification information is aimed to collect criminals` DNA and make a database to use it for investigation and trials. but it is too wide in that we can use DNA for a paternity test and identifying disease and so on. Thus, to ft the purpose of the law it is desirable that the law should be renamed as Law about The Use and management of DNA Identification information. The Second problem is about management official responsible for the DNA identification information. If the information is divided and managed in two, we can reduce the errors through checks and balances and make the information reliable. But in the process of managing the information, several problems-such as the abuse of the information and the double investment of the budget-can occur. Accordingly The third institution separated from investigative agency should be established rather than the dual management of the police and the prosecution. The third is about the applicable crime and applicable criminals. In selecting those affected by the law, we should reduce the conflict about unconstitutionality. To do so, we should specify the applicable crime and criminals by law. If DNA information collecting is to protect the society, in consideration of the fairness, the applicable should be determined only by the court ruling. The fourth is about writ permitting DNA information collecting. If DNA information collecting is permitted without writ in the case of admission, it results in serious human right abuse. Therefore it is desirable to apply the writ policy. The fifth problem is about discarding and deleting the information. Because of the possibility of personal information leak and manipulating the information, when it comes to discarding and deleting the information, it is determined by law not by a presidential decree. The sixth problem is about Database management commission responsible for DNA identification information. The commission should be composed of experts in this field, and especially civic commissioners should hold a majority by law. The seventh is about the notice to the person directly concerned. It is desirable that the things concerned-such as collecting DNA information, recording it and deleting it-should be noticed by law. Also, the method and procedure about the notice should be defined by law. Detailed method and procedure should be defined by a presidential decree.

      DNA 정보 활용을 통한 귀화인 살인사건의 분석과 적용

      We report here the application of the worldwide forensic DNA information database search in the murder case by a naturalized citizen, which occurred in Northern District of Seoul. At August 2012, an old lady was sexually assaulted and strangled by an unknown murderer. The dead body of an old lady was found in her house. Information of the murderer was insufficient. DNA samples of a murderer were obtained from the corpse and crime scene while performing medicolegal autopsy and on-site investigation. The DNA samples including vaginal fluid, saliva, fingernail debris and bloodstain were analyzed with three forensic DNA methods (autosomal STR, Y- STR haplotypes, and mitochondrial DNA). We found the different genetic characteristics from Koreans in the worldwide forensic DNA information database. We suggested that the actual criminal could be a man closely related to the South Asian population. After few days, this information was sent to the police and DNA sample of the murderer was obtained after his arrest. DNA profile was exactly matched with those in the crime scene samples. The frequency of the CODIS DNA profile identified was estimated to be 5.28 × 10-16 in a Bangladeshi population. Our experience shows that the worldwide forensic DNA information database search may be a useful method to detect a real offender by facilitating the comparison on Koreans and other populations.

      독일 형사소송법상 DNA 검사 - 디엔에이신원확인정보의 이용 및 보호에 관한 법률과의 비교 -

      Beim Aufsatz als einer rechtsvergleichenden Studie handelt es sich hauptsächlich um die DNA-Analyse im deutschen Strafprozessgesetz. Deutschland hat auch schon früh viel Interesse an Ermittlungsmethode mit DNA-Analyse-Technologien gehabt und hat sich unermüdlich bemüht, eine rechtliche Grundlage dafür zu schaffen. In Deutschland sind die strafrechtlichen Vorschriften für die DNA-Analyse im Strafprozessgesetz enthalten und wurden nicht auf einmal eingeführt, sondern sequenziell. Deutschland betrachtet DNA-Untersuchungen grundsätzlich als eine Art von Ermittlungsmaßnahme, und im Gegensatz zu anderen körperlichen Untersuchungen gibt es spezielle Vorschriften für molekulargenetische Untersuchungen, die getrennt von den Probenvorschriften auf dem Prüfstand sind, weil DNA-Untersuchungen eine tiefgreifende Verletzung der Grundrechte darstellen würden. Darüber hinaus werden Vorschriften für die Reihenuntersuchung und die Verwerfbarkeit von Informationen über Beinahetreffer im Rahmen der DNA-Reihenuntersuchung festgelegt. Im Vergleich zum koreanischen DNA-Gesetz gibt es auch Ähnlichkeiten mit den deutschen DNA-Gesetzen, aber es gibt mehr Unterschiede. Aus der Sicht des deutschen Gesetzes scheint das koreanische DNA-Gesetz übermäßig darauf ausgerichtet zu sein, die Datenbank der DNA-Informationen aufzubauen. Dies führt einerseits zu einer übermäßigen Verletzung des individuellen Rechts auf die informationelle Selbstbestimmung und andererseits zu einer Einschätzung, dass die molekulargenetische Technologien in bestimmten Bereichen nicht aktiv genutzt werden. Insbesondere mangelt es dem koreanischen Gesetz an Berücksichtigung der DNA-Untersuchung für das laufende Strafverfahren, da das geltende DNA-Gesetz den nicht inhaftierten Beschuldigten und seine Familie von der molekulargenetischen Untersuchung ausnimmt und die Eilbefugnis der Staatsanwaltschaft und Ermittlungspersonen nicht anerkennt. 본 논문은 비교법연구로서 독일 형사소송법상 DNA 검사를 그 주된 내용으로 한다. 독일도 DNA 분석기술을 활용한 범죄수사에 일찍부터 많은 관심을 가져왔고 이를 뒷받침하기 위한 법적 토대를 구축하기 위해 부단히 노력하였다. 독일의 경우 DNA 분석에 관한 형사법적 규정들은 형사소송법에 담겨져 있고, 한꺼번에 신설된 것이 아니라 순차적으로 도입되었다. 독일은 DNA 검사를 기본적으로 범죄수사의 한 유형으로 보고 있으며 기타의 신체검사와는 달리 DNA 검사가 가지는 기본권 침해의 중대성으로 인해 검사대상의 채취규정과는 별도의 분자유전자 검사를 위한 규정을 두고 있다. 나아가 DNA 집단검사와 집단검사에서 부분일치자 정보를 활용하기 위한 규정도 마련해놓고 있다. 한국의 디엔에이법과 비교해 볼 때 독일 DNA법은 유사점들도 있지만, 차이점들이 더 많이 발견된다. 독일법의 관점에서 살펴보면 한국 디엔에이법은 과도하게 디엔에이신원확인정보의 데이터베이스구축으로 치중되었다고 보인다. 이는 한편으로 개인의 정보적 자기결정권에 대한 과도한 침해로 이어지고, 다른 한편 일정 영역에서는 오히려 범죄수사기법에 분자유전자 기술을 적극적으로 활용하고 있지 않다는 평가로 이어질 수 있다. 특히 현행 디엔에이법은 구속되지 않은 피의자와 일정 범위에서의 피의자의 친족을 감식대상에서 제외하고 있고 영장주의에 대한 예외로서 긴급권을 인정하고 있지 않다는 점에서 현재 진행 중인 형사절차를 위한 DNA 검사에 대한 고려가 부족하다.

      DNA 분석과 법과학적 증거의 활용

      우리나라는 <디엔에이신원확인정보의 이용 및 보호에 관한 법률>에 의하여 범죄자의 DNA를 분석하여 보관·활용하는 것을 규율하고 있다. DNA 분석기법은 범죄자를 식별하는 데에 매우 유용한 기법으로서 그 정확도의 면에서도 기존의 법과학적 기법과는 비교가 안될 정도로 우수하다. 하지만 개인의 사생활의 자유와 비밀을 침해할 수 있다는 우려가 지속적으로 제기되고 있으며 헌법재판소의 합헌결정에도 불구하고 대상범죄의 범위 등에 대하여 여전히 논란이 지속되고 있다. 한편 최근에는 미국이나 유럽 등에서 범죄자의 DNA 데이터베이스에 수록될 정보에 기존에 활용하던 STR 좌위들에 더하여 추가적으로 새로운 STR 좌위를 포함시키기로 하였으며 대표적인 범죄자 DNA 데이터베이스인 미국 FBI의 CODIS는 2017년부터 기존의 13개의 STR 좌위를 20개의 STR 좌위로 확장하기로 하였다. 우리나라에서도 이러한 추세에 발맞추어 STR 좌위 확장에 대한 논의가 있으며 조만간 STR 좌위의 확장이 이루어질 것으로 생각한다. 범죄자 DNA 데이터베이스에 수록할 STR 좌위의 확장은 개인의 사생활 자유와 비밀의 보호라는 관점에서 또 다른 우려를 야기하고 있다. 하지만 이에 대한 논의는 기존의 STR 좌위와 균형을 갖추는 범위에서 이루어져야 하며 지나친 낙관도 지나친 우려도 타당하지 않다고 생각한다. 범죄자에 대한 DNA 데이터베이스의 활용에서 또 다른 문제는 규율주체의 이원성 문제이다. DNA 데이터베이스의 보다 효율적인 활용을 위해서는 일원화된 관리시스템이 바람직할 것으로 생각되지만 그것이 현실적으로 어려운 경우에는 양자를 조율하고 있는 기구에 실질적인 권한을 부여함으로써 효율성을 제고할 수 있을 것이라고 생각된다. 법과학적 발전은 의생명과학의 발전 및 여타 자연과학 분야의 발전에 근거하여 이루어지게 되며 특히 인간유전학의 발전은 매우 빨리 이루어지고 있다. 이에 따른 부작용의 우려도 높은 것이 사실이다. 근거가 있는 우려는 적절한 제도적 장치를 통하여 규율하여야 하겠지만 막연한 두려움이나 무지로 인한 두려움은 과학계와 다른 분야 및 일반인들간의 지속적인 정보의 제공 및 이해를 통하여 해결하도록 노력하여야 할 것이다. DNA analysis is very powerful means to identify an individual. History of using scientific knowledge and techniques is not short. However, DNA analysis make many issues in forensic science area because of its accuracy and usefulness. Some think that we should reconsider the standard of evidence values because of this technique. However, there are many debates on using DNA analysis in criminal procedure because DNA analysis uses human biological material and its results contain genetic information of individuals. Privacy can be harmed by this technique and unequal treatment of human may occur. But, the information obtained by analyzing STR loci which are used in DNA analysis in criminal procedure and deposit in criminal DNA database is considered not to contain any genetic information. There are trend to expand the number of STR loci in criminal DNA database because of its utility. FBI has a plan to expand it from 13 to 20 after 2017. Korea will also has a plan to do. When we discuss it, we should consider not only its utility but also its side-effect. The expansion of STR loci in criminal DNA database is examined comparing existing STR loci. The ethical and legal implications of DNA analysis should be discussed under the light of the exact scientific knowledge and technique. We don`t need to be afraid of its harm based on the misunderstood information or ignorance. Also, we should carefully design ethical and legal frameworks to prevent its side-effect.

      중소기업 경영자의 혁신DNA와 혁신전략에 관한 연구

      Recently, there are increasing to the interest in the organizational innovation DNA as the innovation origin and these interest mainly were approached through the case analysis of global innovative companies. The purpose of study is to investigate the applicability under the CEO of SMEs settings as global companies' cases. The research focused on the impact of innovator's DNA on innovative strategy by the empirical study that analyzed from 110 firm's data in Daegu and Gyeongbuk region. The results of empirical study, innovator's DNA has positive effects on the overall innovative strategy, especially the effects of discovery DNA are stronger than operational DNA. Included to the discovery DNA effects, operational DNA bring about negative on the product differentiation, though it has positive on the market differentiation. In terms of components of innovator's DNA, the questioning and association have strong impacts on the overall innovative strategy, and analyzing has positive on market differentiation, but specific task implementation has negative on the product differentiation. The results suggest that the logic of global innovation case is possible to the SME's CEO and need to learning efforts to promote discovery DNA for successful innovation.

      DNA법의 문제점과 위헌성 검토

      In Korea Act on the Use and Protection of DNA Identification Information(shortly, DNA Act) was enacted in 2010 for collecting and databasing DNA information from the convicted and the arrested suspects. The aim of DNA Act is said to promote effective countermeasures against the serious crimes in the future through establishment of DNA database to compare with the specimen from the crime scene. However, it is worried that DNA Act will strengthen the tendency of the so-called ``big brother society``. DNA Act allows the government to gather and database DNA information from the criminals who (are alleged to) have committed certain crimes without any estimation of their potential danger of future crimes. This policy will tighten and enlarge the control and surveillance of the government over the citizens, together with our long-continued system of all citizens` mandatory fingerprinting. Based on this recognition, this article reviews the constitutionality of DNA Act critically. First, DNA Act violates the constitutional principle of presumption of innocence, because the DNA information can be collected form the suspects and convicted simply on the basis of the easy stigmatization that they are potentially dangerous with relation to the ``not-yet occurred`` crime. Secondly, DNA Act violates the principle of warrant requirement. According to the Act, the warrant is needed for gathering DNA information. However, the warrant is automatically issued when the suspects or convicted persons have committed the listed crimes. The warrant is only a ``decoration``, therefore this situation never corresponds with the constitutional principle of warrant requirement. Finally, this study argues the violation of the principle of proportionality in several points. The listed crimes eligible to collect DNA information by DNA Act are too extensive without any consideration of their seriousness and the danger of repeat, and the preservation term of DNA information is too long. In summary, this study argues that DNA Act is totally unconstitutional, and so we should abolish it.

      Quantification of Thioguanine in DNA Using Liquid Chromatography-Tandem Mass Spectrometry for Routine Thiopurine Drug Monitoring in Patients With Pediatric Acute Lymphoblastic Leukemia

      Background: We developed an assay to measure DNA-incorporated 6-thioguanine (DNA-TG) and validated its clinical applicability in Korean pediatric patients with acute lymphoblastic leukemia (ALL) in order to improve individualized thiopurine treatment and reduce the life-threatening cytotoxicity. Methods: The DNA-TG assay was developed based on liquid chromatography-tandem mass spectrometry, with isotope-labeled TG-d3 and guanine-d3 as internal standards. This method was applied to 257 samples of pediatric ALL patients. The DNA-TG level was compared with erythrocyte TG nucleotide (RBC-TGN) level in relation to the TPMT and NUDT15 genotypes, which affect thiopurine metabolism, using Spearman’s rank test and repeated measure ANOVA. Results: For DNA-TG quantification, a linearity range of 10.0-5,000.0 fmol TG/μg DNA; bias for accuracy of –10.4% –3.5%; coefficient of variation for intra- and inter-day precision of 3.4% and 5.8% at 80 fmol TG/μg DNA and of 4.9% and 5.3% at 800 fmol TG/μg DNA, respectively; and recovery of 85.7%-116.2% were achieved without matrix effects or carry-over. The median DNA-TG level in the 257 samples was 106.0 fmol TG/μg DNA (interquartile range, 75.8-150.9). There was a strong correlation between DNA-TG and RBC-TGN levels (ρ=0.68, P<0.0001). The DNA-TG/RBC-TGN ratio was significantly higher in NUDT15 intermediate metabolizers (*1/*2 and *1/*3) than in patients with wild-type alleles (P<0.0001). Conclusions: This simple and sensitive method for measuring DNA-TG level can improve therapeutic drug monitoring for thiopurine treatment.

      디엔에이(DNA)신원확인정보의 수집 및 관리에 관한 제문제

      현대 과학기술의 발달은 범죄를 수사함에 있어 긍정적인 역할을 하기도 한다. 유죄입증을 위한 증거수집 및 분석에 있어서도 과거에는 관련기술의 부재로 증거로서의 중요성을 가지지 못했던 것들이 이제는 유죄의 입증에 중요한 역할을 하고 있다. 과거 혈액형의 동일성을 증명하였던 것에 불과하던 혈흔에서도 이제는 DNA유전자형 분석을 통해 범행을 입증할 수 있기에 이른 것이다. 이에 우리는 DNA정보가 가지는 중요성에 주안점을 두고 DNA정보 운용을 위한 디엔에이(DNA)신원확인 정보의 이용 및 보호에 관한 법률을 마련하여 시행중에 있다. 그러나 이와 관련해서는 DNA신원확인정보의 수집․관리 적용대상이 너무 포괄적이라는 지적에서부터 DNA대량검색을 통한 그물망 수사 문제 및 관련 정보의 폐기와 관련한 문제에 이르기 까지 여러 비판이 제기되고 있다. DNA정보 운용과 관련해서는 우리뿐만 아니라 세계 각국에서 관심을 가지고 있는 분야이며 그 중 미국의 경우 1990년대부터 관련 법제가 마련된 바 있다. 미국은 DNA관련 규정을 연방과 각 주에서 따로 규정하고 있으나 각 시스템이 연계되어 운용되고 있다는 특징이 있다. 뿐만 아니라 DNA신원확인정보의 대상을 확대하고 있으며 관련 정보의 폐기와 관련해서도 각 주별 관대한 입장을 취하고 있는 경우가 많아 우리와 차이를 보이고 있다. 이에 본고에서는 현재 실행 중인 디엔에이신원확인 정보의 이용 및 보호에 관한 법률에 대해 전반적으로 검토한 후 미국에서 시행 중인 DNA관련 법제와의 비교를 통해 우리 법제의 나아갈 방향에 대하여 고찰하였다. Development of science technology has a positive influence in crime investigation. Especially technology of DNA analysis gave us possibility to compare prisoners blood or body fluids. DNA information for identification is based on Deoxyribonucleic acid, it gave us to information for human identity. DNA analysis is a kind of forensic science, and it means a lot in police investigation today. DNA information raised very important thing to solve the case, so the DNA Act in Korea was enacted in 2010. It regulated method of collecting samples, warrant issues, disposal of it and delete the data etc. Nonetheless it has some problems like a including none violent crimes, collecting samples in suspects and massive collecting issues. United States is the one of the country has attention about DNA information and well regulated. Database about DNA information in US separated by CODIS and States databases, but its connected both way. It also has a feature like a expansion to none violent crime, regulations of saved DNA samples for the re-analysis, these things are huge differences between us. DNA information is very important in human life, so we have to have more caution to collecting and make databases.

      Diamond™ Nucleic Acid Dye와 스마트폰 카메라를 활용한 범죄현장 DNA 시각화 기법❖

      DNA collected from crime scenes and evidence is an important piece of evidence that can be identified through STR(Short tandem repeat) analysis. However, since DNA is not visible to the human eye, it is difficult to accurately collect DNA latent on the site and the surface of evidence. In this study, an individual smartphone camera, an orange filter supplied to the National Police Agency's scientific investigator, a blue light source, and Diamond™ Nucleic Acid Dye (10,000x) solution was diluted 20 times with 75% ethanol, and DD was applied to non-porous surface virtual evidence touched by four donors using a sprayer. The DNA transferred from the donor to the surface of the virtual evidence was identified as a yellow fluorescent light emitter in a smartphone camera, and STR analysis was conducted by collecting a yellow fluorescent light emitter, confirming that the DNA was stained. In addition, as a result of contrasting with the STR profile analyzed in the oral epithelial cell DNA of four donors, it was confirmed that the individual identification index and the individual identification index could be meaningful as investigative evidence to exclude those on the suspect line. In conclusion, a combination of a smartphone camera, a blue light source, an orange filter, and a sprayer can be used to identify the presence of DNA on the site of an incident, accident, and evidence to obtain effective STR analysis results. 범죄 현장 및 유류증거물에서 채취한 생체시료(DNA)는 STR(Short tandem repeat) 분석을 통해 신원을 식별할 수 있는 중요한 증거물이다. 하지만 생체시료(DNA)는 사람의 육안으로 보이지 않기 때문에 현장 및 증거물 표면에 잠재된 DNA를 정확하게 채취하기에는 어려움이 있다. 본 연구에서는 개인이 소지한 스마트폰 카메라, 경찰청 과학수사관에게 보급된 주황색 필터, 블루라이트 광원과 Diamond™ Nucleic Acid Dye(10,000x) 원액을 75% 에탄올로 20배 희석한 후 분무기를 이용하여 4명의 공여자가 만진 비 다공성 표면의 가상증거물에 분무기를 사용하여 DD를 도포한 후, 스마트폰 카메라와 블루라이트 광원, 주황색 필터를 사용하여 가상증거물 표면에 잠재된 DNA를 관찰하였다. 공여자로부터 가상증거물 표면에 전이된 DNA는 스마트폰 카메라에서 노란색 형광발광체로 식별이 되었으며, 노란색 형광 발광체를 채취하여 STR 분석을 진행한 결과, DNA가 염색된 것을 확인하였다. 또한, 공여자 4명의 구강상피세포 DNA에서 분석된 STR Profile과 대조한 결과 개인식별이 가능한 유의미한 통계결과와 개인식별 지수는 낮으나 용의선상에 있는 사람을 배제할 수 있는 수사증거로서 의미를 가질 수 있는 것을 확인하였다. 결론적으로, 스마트폰 카메라, 블루라이트 광원, 주황색 필터, 분무기를 조합하여 활용하면 사건·사고 현장 및 증거물 표면에서 DNA 존재 유무를 식별하여 유효한 STR 분석 결과를 얻을 수 있을 것이며, 그로인해 DNA DB 축적, DNA 매칭 가능성 증가로 과학수사 결과의 질적 향상을 기대할 수 있을 것으로 사료된다.

      DNA신원확인정보의 실효적 보호에 관한 연구: 개인정보자기결정권 보장을 중심으로

      DNA identification information as biometrics is information that is most closely related to the bodies of individuals and unlike other personal information, it cannot be changed while the individual is alive and it can be used not only to identify an individual, but also information on blood relationships of the individual. Therefore, it must be protected at levels of protecting sensitive information. However, many disputes have been raised on Korea’s DNA Act even before its enactment because by excessively collecting and process DNA identification information, which are biometrics of individuals, for the purpose of improving the efficiency of crime investigation agencies and to prevent crimes, it could violate the basic constitutional rights of individual human rights and the right to self-determination of personal information. The fact that the Constitutional Court recently made the ruling that in relation to Article of the DNA Act that it was a violation of the constitution as it did not guarantee the procedural rights of the claimant was significant. DNA identity information is ‘personal information’ that can be used to identify an individual, and therefore, the subject of the information should be able to exercise his or her right to self-determination of personal information, which is the right to control how much information to whom his or her information would be shared with. However, the right to self-determination of personal information can be limited by laws in the cases needed to guarantee national safety, maintain order, or for public welfare pursuant to Article 37 Paragraph 2 of the Constitution. This means that regardless of the intent of the subject of information, DNA identification information can be used lawfully by the authorities for the purpose of public interest for criminal investigations or crime prevention. Related to this, a provision was also provided to allow investigative agencies to collect, use, store, etc. DNA identification information for the purpose of criminal investigation and crime prevention in the DNA Act. However, the current DNA Act excessively violates the freedom to one’s own body, the right to self-determination of personal information, etc. due to several issues such as the massive scope of applicable crimes, lack of regulations to guarantee the procedural rights of subjects, and unlimited storage of information, etc. Accordingly, revisions should be made for the DNA Act considering the peculiarity of DNA identification information, reason for ruling of being unconstitutional by the Constitutional Court, and the various potential violations of the Constitution that are being suggested. In detail, some areas for reform would be to minimize the crimes for collecting the information, adding conditions for risk of recurring crimes, deleting regulations on consent to collection, guarantee of right to state opinions, providing a clear basis for non-compliance procedures, indication of storage period, guarantee of rights to claim for deletion, etc. 생체정보로서의 DNA신원확인정보는 개인의 신체와 가장 밀접하게 관련된 정보이고, 다른 일반 개인정보와 달리 개인이 살아 있는 동안에는 변경이 불가능하며, 이를 통해 개인을 식별할 수 있을 뿐만 아니라 개인의 혈족관계에 관한 정보까지도 파악할 수 있어, 민감정보의 보호수준으로 보호될 필요가 있다. 그러나 우리나라 DNA법은 제정되기 이전부터 많은 논란이 있어 왔는데, 그 이유는 수사기관이 범죄의 효율성 및 범죄예방이라는 목적을 위해 개인의 생체정보인 DNA신원확인정보를 과도하게 수집 및 처리함으로써 개인의 인격권, 개인정보자기결정권 등의 헌법상 기본권을 침해한다는 것이었다. 최근 헌법재판소는 DNA법 제8조와 관련하여 청구인들의 절차적 권리를 보장하고 있지 않다는 이유로 위헌결정을 내렸다는 점에서 의미가 있다. DNA신원확인정보는 개인의 신원을 확인할 수 있는 ‘개인정보’에 해당하기 때문에, 정보주체는 본인의 DNA신원확인정보가 언제 누구에게 어느 범위까지 처리될 것인지 스스로 통제할 수 있는 권리인 개인정보자기결정권을 행사할 수 있어야 한다. 다만, 개인정보자기결정권은 헌법 제37조 제2항에 따라 국가안전보장·질서유지 또는 공공복리를 위해 필요한 경우에 한하여 법률로서 제한될 수 있고, 이는 정보주체의 의사와 상관없이 DNA신원확인정보가 범죄수사 또는 범죄예방 등 공익목적을 위해 정당하게 공권력에 의해 처리될 수 있다는 것을 의미한다. 이와 관련하여 DNA법에서는 범죄수사와 범죄예방을 위하여 수사기관이 DNA신원확인정보를 수집, 이용, 보관 등을 할 수 있도록 근거조항을 마련하고 있다. 그러나 현행 DNA법은 대상범죄의 광범위성, 대상자의 절차적 권리 보장에 관한 규정 부재, 정보의 무기한적 보관 등 여러 문제로 인해 대상자들의 신체의 자유, 개인정보자기결정권 등을 과도하게 침해하고 있다. 이에 따라, DNA법은 향후에 DNA신원확인정보의 특수성을 고려하고 헌법재판소의 헌법불합치결정의 취지와 현재 제기되고 있는 여러 가지 위헌소지가 있는 조항들을 개선할 필요가 있다. 구체적으로 개정사항으로는 채취 대상범죄의 축소와 재범 위험성 요건 추가, 채취 동의 관련 규정 삭제, 의견진술권 보장 및 불복절차에 관한 명시적 근거 마련, 보관기간 명시 및 삭제청구권 보장 등이 있다.
