경찰법 개정에 따른 지방정부의 자치경찰제도 도입과 운영 활성화 방안

본 연구는 경찰법 개정안의 통과를 앞두고, 향후 자치경찰제도의 도입과 운영의 활성화를 위한 지방정부의 방안을 제안하는데 목적이 있다. 국가 전체의 치안총량과 현재의 안정적 경찰활동 체계의 유지를 위한 노력의 일환으로 실시되는 자치경찰제도의 가치에도 불구하고 새로운 제도 시행으로 인한 지방자치기관의 민주적 정당성 약화와 지휘․감독체계의 혼란, 지방행정과 치안행정의 연계 및 지역특성의 반영 측면 에서 한계가 있기에 수정, 보완 및 시범실시 등을 통하여 부작용을 최소화 하여야 한다. 현행 법령에서 제시하고 있는 주요 쟁점과 논의되고 있는 사항들은 자치경찰제에 대한 책임자로서 시․도지사의 실질적 권한과 자치경찰의 자율적 운영에 대한 가능성, 시․도 자치경찰위원회와 사무기구에 대한 자율성, 시․도지사의 지휘감독권과 인사권 및 법률안 의견 제출권 등으로 정리될 수 있다. 자치경찰제 운영을 위한 광역자치 단체 차원의 추진과제는 자치권과 관련된 과제와 자치경찰제의 준비를 위한 과제들로 나누어 볼 수 있는데, 대외적 과제로서 국가경찰위원회의 자치경찰 관련 전문성을 확보하고 시․도 경찰위원회 구성에 있어시․도지사의 권한을 확대하며 시․도 경찰청 임명에 대한 시․도지사의 권한 확대와 국가지원의 확대, 사무기구 운영의 자율성 보장 등을 제시할 수 있으며, 내부적으로는 가칭 ‘광역권자치경찰추진단’을 구성하여 지방경찰청과 공동으로 사무를 구분하고 인력과 예산을 도출하는 등사무기구의 운영방안을 확정하는 과정이 필요할 것이다. The purpose of this study is to propose a plan of local government for the introduction and operation of the autonomous police system in the future, ahead of the passage of the amendment bill of the police law. The 21st National Assembly should minimize the side effects through revision, supplementation and demonstration because it is part of the efforts to maintain the total amount of security of the whole country and the current stable police activity system, weakening the democratic justification of local autonomous agencies, confusion of command and supervision system, linkage of local administration and security administration, and reflection of local characteristics. The main issues and issues discussed in the current bill can be summarized as the actual authority of the city and provincial governors as the head of the local police system, the possibility of autonomous operation of the local police, the autonomy of the city and provincial police committee and office, the command and supervision of the city and provincial governor, the right to submit personnel rights and the right to submit the opinion of the bill. 경찰법 전면개정(안)에 따른 특별사법경찰사무 고찰

최근 우리사회는 경찰의 수사 재량권 확대와 검찰의 권한을 축소하는 이른바 검경수사권 조정이 이루어지고 있다. 그동안의 경찰과 검찰의 수직적 관계를 지양하고 상호협력 관계로 설정하는 것을 주목적으로 하고 있다. 또한 국가경찰 조직도 자치경찰제 도입을 위한 논의가 본격적으로 이루어 지면서 경찰법이 전면개정되고 있다. 본 연구에서는 현재 특별사법경찰 사무가 자치경찰과 중앙행정기관, 광역 및 기초자치 단체 등의 행정기관에서 운영되고 있으나 최근 국회에서 논의 중인 경찰법 개정안에서는 자치경찰의 사무에서 특별사법경찰 사무가 배제될 개연성이 나타나고 있다. 따라서 제주자 치경찰의 존치여부도 불투명함에 따라 지방자치단체에서 운영중인 특별사법경찰 사무실 태도 재점검하여 효율적인 운영방안을 제시하여야 할 시점이라 판단하였다. 본 연구의 목적 달성을 위하여 지방분권과 자치경찰제 시행을 위한 그동안의 경과를 살펴보고, 우리사회의 자치경찰에 대한 다양한 의견을 조망하면서 제주자치경찰과 수도권의 광역자치단체의 특별사법경찰 운영현황을 고찰하였다. 또한 지방자치단체에서 운영중인 특별사법경찰조직의 성과를 수합·조정하고 있는 대검찰청과 언론 보도자료, 기존 연구 자료 등을 활용하는 문헌연구를 하였다. 본 연구는 특별사법경찰 사무가 중앙정부와 자치단체의 고유사무로 운영이 예상됨에 따라 행정기관의 행정목적 달성을 위한 실질적 행정경찰 기구로 특별사법경찰 제도가 발전할 수 있도록 방향을 모색해 보고자 한다. Recently, our society has expanded the police s discretion and adjusted the so-called prosecution and police investigation authority to reduce the prosecution s authority. The focus is on avoiding the vertical relationship between the police and the prosecution and setting it as a cooperative relationship. In addition, the National Police Organization is also fully revising the police law as discussions have been made to introduce the self-governing police system. In this study, the special judicial police office is currently operated by the local police, central administrative agencies, metropolitan and local governments, but the recent revision of the police law under discussion at the National Assembly shows the probability that the special judicial police office will be excluded from the affairs of the local police. Therefore, as it was unclear whether the Jeju Provincial Police Agency would be maintained, it was decided that it was time to re-examine the office attitude of the special judicial police, which was operated by the local government, and suggest efficient operation measures. In order to achieve the purpose of this research, we examined the progress of decentralization and the implementation of the autonomous police system in our society, and examined the operation status of special judicial police by Jeju autonomous police and metropolitan and provincial governments. In addition, the Supreme Public Prosecutors Office, which is collecting and coordinating the achievements of special judicial police organizations operated by local governments, and the literature study was conducted using press releases and existing research materials. As the special judicial police office is expected to be operated by the central government and local governments, this study seeks to find ways to develop the special judicial police system as a practical administrative police organization to achieve administrative purposes of administrative agencies.

자치경찰의 확대도입을 위한 과제

전국단위로 자치경찰을 확대 도입하는 것은 현 정부의 100대 국정과제의 하나이다. 뿐만 아니라 제주특별자치도에서 자치경찰이 시범적으로 운영된 지도 이미 2년여가 경과하고 있다. 따라서 자치경찰을 확대 도입하는 것은 조만간 가시화될 정책으로 전망된다. 그러나 자치경찰의 확대도입을 위해서는 그간에 논란이 되었던 다수의 개선 과제들이 조속히 보완될 필요가 있다. 따라서 본 논문에서는 제주 자치경찰의 운영실태를 분석하고, 그에 기초하여 확대도입 시에 보완이 필요한 개선과제들을 분석하고 있다. 자치경찰의 확대도입을 위해서는 자치경찰에 대한 인식정립, 인력의 양적 및 질적 수준의 확보, 광역자치단체의 역할 및 중앙정부의 지원 등이 사전에 보완되어야 한다. The enlargement of Self-governing Police with nationwide is one of the 100 national policy tasks of this government. Also it has been passed almost 2 years since Self-governing Police launched exemplarily in Jeju Special Self-governing Province. By the way it is prospected that the enlarging the Self-governing Police will be substantialized before long. In order to enlarge the Self-governing Police, however, it is essential that the multiple reformative tasks which had been argued for a while should be complemented as soon as possible. Therefore the actual conditions on operating of Self-governing Police of Jeju Special Self-governing Province will be investigated in this study. Also the reformative problems needed to be complemented at the time of enlarging Self-governing Police will be analyzed. In conclusion, some of factors such as establishing the understanding of Self-governing Police, securing the manpower in the dimension of quantity and quality, performing the roles of regional autonomies and acquiring the support from central government will have to be accomplished previously.

자치경찰제도의 도입 단위와 모형 정립에 관한 논의 - 기초차치단체 도입단위와 이원화 모형을 중심으로 -

The autonomous police system is a product of an age request to realize the ideology of local autonomy under decentralization, and it is very important to establish an introduction unit and model for the successful settlement of the self-governing police system, which will be expanded nationwide in the future. Nevertheless, for the successful settlement of the self-governing police system, which will be expanded to the entire country in the future, the Eagle plans to focus on the introduction units of basic local governments and the dual-type independent of the national police system on the establishment of models and the introduction units of autonomous police systems consistent with the ideology of democracy and local autonomy. 자치경찰제도는 지방분권화에 따른 지방자치의 이념을 실현하고자 하는 시대적 요청의 산물로써 향후 전국적으로 확대 실시되는 자치경찰제도의 성공적인 정착을 위해서 도입단위와 모형을 정립하는 것은 매우 중요하다. 그리고 자치경찰제도를 도입하면서 그 도입단위와 모형을 정립하는 것은 자치경찰의 정체성, 조직, 사무의 배분, 독립성 등 자치경찰의 운영에 목적과 방향을 설정해주는 것으로 매우 중요하며, 절대적이다. 자치경찰제도의 도입단위와 모형은 각 장・단점이 있어 그 나라의 역사적, 정치적 특성 등을 고려해야 하지만 무엇보다도 고려해야 할 기준은 자치경찰의 ‘자치’이다. 자치는 지방분권화에 따른 지방자치이념이다. 즉, 주체가 지역주민이 되고, 지역주민의 권한과 잭임 하에 스스로 행하는 것이다. 이러한 자치의 개념에 필요한 불가결한 요소가 바로 분권성, 민주성, 자율성, 독립성 등이다. 문재인 정부는 자치경찰제도의 전국 확대 실시 공약에 따른 이행을 위하여 서울시와 세종시를 시작으로 2021년에는 전국으로 확대 시행하기로 하면서 도입단위를 광역지방자치단체에 두고 모형도 국가경찰과는 독립된 이원형으로 추진하고 있다. 그럼에도 불구하고 이글에서는 향후 전국으로 확대 실시되는 자치경찰제도의 성공적인 정착을 위해서 민주주의와 지방자치의 이념에 부합되는 자치경찰제도의 도입 단위와 모형 정립에 관하여 지역주민이 중심이 되는 기초자치단체 도입단위와 국가경찰과 독립된 이원형을 중심으로 고찰하고자 한다.

지방분권과 광역단위 자치경찰제 도입에 관한 법적 검토

In regard to the police system, the Korean government has operated a centralized national police force. As a result, even though the policing efficiency is high, the police system has been operated in a uniform fashion without considering regional characteristics. As a result, citizens’ wants and needs have not been properly reflected. To address this issue, a metropolitan self-governing police system has been promoted allowing the police system to be more democratic and to strengthen the policing activities. Self-governing police forces should be formed in a resident-friendly way to improve crime-prone environments through the cooperation between the police and local authorities while reflecting the locals’ demands. Furthermore, self-governing police forces should actively respond to citizens’ requests and have the authority and manpower to maintain their identity. According to the Special Committee Draft for Self-governing Police Systems, which was discussed at the Self-governing Police Systems Committee under the Presidential Committee on Autonomy and Decentralization held in November 2018, the metropolitan autonomous police system would be launched in 2019 and implemented nationwide by 2022. This study attempted to investigate the autonomous police system in the Jeju Special Self-governing Province which has been operating since July 2006, analyze a plan to introduce the Special Committee Draft for Self-governing Police System, examine how to establish the local authority’s roles through this new system, and to find a specific plan to implement it. The Special Committee Draft for Self-governing Police Systems is only a framework for the long-discussed advancement to autonomous police forces. In other words, there should be continued efforts to push through a government bill finalized through public hearings and have the self-governing police system implemented through a legislative process. After all, it appears that the introduction of a metropolitan self-governing police system and its successful implementation would establish grassroots democracy leading to another step toward actual decentralization. 우리 경찰제도는 그동안 중앙집권적인 국가경찰을 운영하고 있어 치안효율성은 높지만 상대적으로 경찰운영이 지역특성을 고려하지 않고 획일적으로 운영되었으며 주민들의 요구를 제대로 반영하지 못하고 있는 실정이다. 이러한 배경에서 광역단위 자치경찰제는 지방자치단체인 시·도 소속으로 자치경찰을 운영하여 경찰체계를 보다 민주적으로 변화시키고 주민밀착 치안활동을 강화하기 위해 추진해온 사항이다. 자치경찰은 지역의 안전을 위하여 경찰과 지방자치단체가 협력하여 범죄 취약환경 등을 개선하고 경찰활동도 주민들이 요구를 반영하는 주민 친화적으로 이루어져야 한다. 또한 자치경찰은 지역마다 다른 다양한 지역주민의 치안수요에 적극 부응하여야 하고 그에 상응하는 권한과 조직 및 인력이 주어져야 그 정체성도 담보될 수 있다. 지난 2018년 11월에 공개된 자치분권위원회 산하 자치경찰위원회에서 논의된 결과인 ‘자치경찰제 특별위원회안’에 따르면 광역단위 자치경찰제를 2019년부터 시범실시를 통하여 단계적으로 추진하며 2021년에는 전국으로 실시하고 2022년에는 단계적으로 자치경찰사무를 확대하도록 하고 있다. 본 연구는 자치경찰을 2006년 7월에 도입하여 시범적으로 운영한 제주특별자치도의 자치경찰제에 대한 운영현황을 살펴보고 ‘자치경찰제 특별위원회안’인 광역단위 자치경찰제 도입방안을 분석하여, 향후 자치경찰제를 통한 지방자치단체의 역할 정립과 자치경찰제의 세부실행 방안을 모색해보고자 한다. 특히, ‘자치경찰제의 특별위원회안’은 그동안 논의된 진일보한 자치경찰의 모델을 담고 있는 것은 사실이지만, 아직은 기본적인 틀을 공개한 것에 불과하다. 향후 자치경찰제 도입과 운영에 관한 공론화 과정을 통해서 자치경찰제 도입방안이 확정되어야 한다. 이후 입법절차를 거쳐 시행될 시범운영기간에도 자치경찰제가 올곧이 정착되도록 지속적인 노력이 경주되어야 한다. 결국 광역단위 자치경찰제의 도입과 성공적인 정착은 실질적 지방분권을 위한 풀뿌리 민주주의의 시금석이 되리라 본다.

지방자치강화를 위한 자치경찰제의 확대에 관한 공법적 검토

Administrative Appeals batch is to be revised by-laws of the Police Act. 근대의 산업사회는 국가의 총체적인 역량을 모두 중앙에 집중하여 정부 주도로 경제성장을 이룩하였다. 우리나라 역시 정부가 중심이 되어 모든 권한과 역량을 집중하는 시스템을 통해 경제개발을 이끌었으며, 오늘날과 같은 성장을 달성하였다. 그러나, 경제가 일정한 괘도에 다다른 오늘에 있어서는 과거와 같은 정부주도의 시스템을 가지고는 더 이상의 성장을 담보할 수 없게 되었다. 세계적인 흐름도 분권화, 다핵화로 가고 있고, 사회 각 영역이나 각 지역의 자율성을 인정하고 각자의 처지에서 최고의 역량을 발휘한다면 결국 국가 전체의 경쟁력도 제고된다는 것이다. 이처럼 지방분권은 자기 지역의 일을 자신이 처리하게 함으로써 민주주의의 실현에도 기여할 뿐만 아니라 오늘날 경제성장의 관점에서도 더 이상 선택이 아닌 필수적인 요소가 되어 가고 있다. 우리나라도 지방자치를 확대해 나가고 있는데, 지방자치의 중요한 제도중 하나인 자치경찰제의 확대에 있어서는 구체적이고 전면적인 시행이 미루어져 오고 있다. 선진외국사례를 검토한 결과, 현 단계에서 우리가 취할 수 있는 최선의 자치경찰제 도입모형은, 시․도 단위 광역자치경찰제와 국가경찰의 조정통제 기능을 효과적으로 결합시키는 것이어야 하며, 국가경찰과 지방자치경찰 모두 대표성을 갖춘 민간인으로 구성된 경찰위원회의 관리 하에 두되 구체적 법집행과 경찰업무 수행에 대한 시도단위 경찰지휘자의 독자적 지휘권을 확보해 줌으로써 공정하고 효율적이며 지역실정에 맞고 주민의 요구에 부응하는 치안서비스를 제공할 수 있도록 하여야 할 것이다. 또한, 현행 제주자치경찰제는 제주자치경찰단의 사무에서 극히 제한적 권한만 부여되어 현장업무수행이 곤란하다는 문제점이 지적되고 있기 때문에, 자치경찰의 사무와 부합하는 수사권과 권한이 주어짐으로써 직무수행을 함에 있어 당하는 어려움을 최소화시킬 필요가 있다. 이처럼 정치적 중립성을 확보하기 위한 위원회중심의 광역단위로 하여 수사 및 정보업무를 자치경찰에 부여하는 것을 골자로 하는 자치경찰법안을 마련하게 되면, 사무이관에 따라 자치경찰제의 확대를 위한 재원의 문제도 국가경찰의 사무가 대폭 줄었기 때문에 국가경찰의 재원을 재분배하고, 과태료나 범칙금 등을 자치경찰로 이관하는 형태로 원칙을 가져간다면, 국가나 지방자치단체에 큰 부담은 없으리라 판단된다. 그밖에 ‘자치경찰제’를 전국적으로 확대하면서 정비되어야 하는 법률에는 경찰법․경찰공무원법․정부조직법․지방자치법․지방재정법․지방공무원법이 있고, 위의 6개 법률은 별도의 개정절차로 개정되어야 할 것이고, ‘시․도 경찰재정교부금법’은 새로 제정해야 할 법률이다. 그밖에 도로교통법․행정심판법 등 20여개의 법률은 경찰법의 부칙으로 일괄 개정하여야 할 것으로 보인다.

특별사법경찰의 자치경찰화 방안 연구

The special judicial police enforce on violations of administrative regulations. They are government officials, not a police officer. They have professionalism in special judicial police duties. They have control over pollution discharge industries, food sanitation inspection system. indicate system of origin and that sort of things. This paper is a study on measure to improve the efficiency of the special judicial policing. Measures to improve the efficiency of the judicial police special action is to convert to local autonomy police. In this context, This study proposes a method that special judicial police converted into to local autonomy police. we consider a question in all its aspects. This paper proposes an solution in the four aspects, that is installation unit, composition of organization, personnel management, distribution of affairs. In view of the installation unit, the autonomus police should be installed on the Provincial Government. In composition of organization, the local autonomy police is to install more than section level. In terms of human resources management, the autonomus police employs a national police officer or special judicial police officers to autonomus police officer. From the viewpoint of distribution of affairs, Autonomous police should perform the following office work; the security of citizen life, traffic police work, Police guard work, desk job of special judicial police, unique police work in the region. 본 연구는 지역주민의 생활안전과 각종 위해․위험으로부터 주민의 안전한 생활을 보장하기 위해 각 지방자치단체별로 수행되고 있는 특별사법경찰의 기능을 보다 활성화하여 자치경찰화 하는 방안에 대한 연구이다. 이러한 맥락에서 본 연구는 특별사법경찰과 자치경찰의 관계, 양자의 유사점과 차이점에 대해서 살펴보고, 우리나라 광역자치단체 특별사법경찰의 운영 실태를 설치단위, 조직구성, 인사관리, 사무범위의 4가지 측면에서 분석한다. 그리고 특별사법경찰의 자치경찰화 방안을 제주특별자치도 자치경찰제, 소방자치, 외국의 자치경찰과 비교하면서 설치단위, 조직구성, 인사관리, 사무범위의 측면에서 제안하였다. 그 결과, 특별사법경찰의 자치경찰화는 광역단위의 자치경찰 설치를 전제로 하여, 조직구성은 최소한 과 단위 이상으로 하고, 자치경찰공무원의 충원은 내부임용과 외부임용을 병행 실시하여 자치경찰공무원과 일반직 등 공무원으로 임용한다. 사무범위는 국가경찰사무의 일부인 생활안전, 교통, 경비사무를 수행하고, 지역의 고유한 사무, 그리고 특별사법경찰사무를 수행하도록 한다.

자치경찰제도 도입 방안 전면적 재검토 방향 제시

In order for local autonomy to be settled systematically and to realize the welfare of residents, it is necessary to introduce an autonomous police system that can secure local safety. The autonomous police system is a system where local governments protect themselves through voluntary decision making by themselves. Depending on the rights granted to these local governments, the autonomous police system should be introduced accordingly. The introduction of the autonomous police system should be implemented in terms of the rights of local governments given by the Constitution. The autonomous police system, which is the last system to complete local autonomy, should be introduced in accordance with the institutional purpose of local autonomy. In order for the autonomous police system to be settled properly, it is necessary to provide full security services to the residents by establishing it in full authority over police affairs and in all local governments. In addition, in order to secure the political neutrality of the autonomous police system, it should be institutionalized so that residents' intentions to the autonomous police committee can intervene. When the autonomous police system is properly established and implemented, institutional completion of local government can be achieved. Therefore, this study reviewed the proposed system from the standpoint that it is necessary to reset the autonomous police system through a review of the government's plans to introduce it. 지방자치가 제도적으로 정착되어 주민의 복리를 실현하기 위하여는 지역의 안전을 확보할 수 있는 자치경찰제도 도입이 필요하다. 자치경찰제도는 지역의 치안을 지방자치단체가 스스로 자주적인 의사결정을 통하여 주민을 보호하는 제도이다. 지역의 안전을 지방자치단체가 자기의 책임으로 사무를 수행할 경우 지역의 치안은 확보될 수 있다. 지방자치를 구현하기 위하여 자치경찰제도 도입에 대한 논의가 계속되었으며, 현 정부는 자치경찰제도를 도입하겠다고 하여 그 안을 제시하였다. 정부가 제시한 자치경찰제도는 제주특별자치도에 시행하고 있는 자치경찰제도를 기반으로 하여 약간의 발전된 형태라 할 수 있다. 자치경찰제도는 그 제도적 취지가 주민이 안전한 지역사회에서 생활할 수 있도록 치안서비스를 제공하는데 그 의의가 있다. 자치경찰제도는 지역의 안전을 확보할 수 있도록 헌법상에서 주어진 지방자치의 제도적 보장 또는 고유한 권리라는 입장에서 이를 해석하여야 한다. 헌법에 의해 주어진 지방자치단체에 보장된 권리는 자치사무에 대한 전권한성과 지방자치단체 보장 등이다. 이러한 지방자치단체에게 부여된 권리에 따라 자치경찰제도도 이에 부합되게 도입되어야 한다. 헌법에 의해 주어진 지방자치단체의 권리라는 관점에서 자치경찰제도 도입이 이루어져야 한다. 또한 지방자치를 완성시키는 마지막 제도인 자치경찰제도는 지방자치의 제도적 취지에 부합되게 도입되어야 한다. 자치경찰제도가 제대로 정착되기 위해서는 경찰사무에 대한 전권한성과 주민에게 균등한 치안서비스를 제공하도록 모든 지방자치단체에 설치되어야 한다. 또한 자치경찰제도의 정치적 중립성 확보를 위해 자치경찰위원회에 대한 주민의 의사가 개입될 수 있도록 제도화 되어야 한다. 자치경찰제도가 제대로 정착되어 시행될 때 지방자치의 제도적 완성이 이루어질 수 있다. 따라서 본 연구는 자치경찰제도의 도입에 대한 정부가 도입하려는 방안에 대한 재검토를 통하여 자치경찰제도 재설정이 필요하다는 입장에서 그 제도안을 검토하였다.

자치경찰제도의 발전방안에 관한 법적・제도적 연구

It has been more than 100 days since the autonomous police system was implemented nationwide. In the meantime, the autonomous police system has been piloted in Jeju Island since 2006 in order to realize decentralization of autonomy. In the case of the Jeju Autonomous Police, it was separated from the Jeju National Police Agency and a separate Jeju Autonomous Police Corps was operated. However, the autonomous police system, which will be implemented nationwide from July 1, 2021, has been criticized for adopting a method of dividing affairs among existing police organizations without establishing a new organization. The current autonomous police system is a system in which the national police organization performs the duties of the autonomous police. This leads to overload and confusion in the work of front-line police officers. In the process of carrying out their duties, the Autonomous Police Committee is experiencing operational problems because it is not properly consulted with local governments on the issues of personnel and budget rights of the police. The autonomous police system is divided into the national police, investigation police, and autonomous police, and the national police handles information, supplementary affairs, and foreign affairs. The police are in charge of daily life-related affairs such as safety, transportation, women, school violence, and sexual violence. However, in this system, one organization handles state affairs and autonomous affairs, and the police station, a state institution, is under the direction and supervision of the autonomous police committee in the process of handling autonomous affairs, so many problems are exposed in the implementation process. In addition, centralized laws and practices are still maintained, and police officers in the field do not realize the self-governing police. The job of the police is to maintain public well-being and order. Therefore, it is necessary to clarify the authority of the self-governing police committee and to realign the status of the police officers in charge of autonomous police affairs in order to provide a police for residents and a self-governing police suitable for the era of localization. In addition, it is necessary to overcome the disconnection of communication by forming a consultative body for business cooperation between the police agencies performing autonomous police affairs and general administrative agencies. 자치경찰제가 전국적으로 시행된 지도 벌써 100여 일이 지났다. 그동안 자치경찰제가 자치분권의 실현을 위해서 2006년부터 시범적으로 제주도에서 실시하였다. 제주 자치경찰의 경우 제주경찰청과는 분리되어 별도의 제주자치경찰단 조직이 운영되었다. 그러나 2021년 7월1일부터 전국적으로 시행되는 자치경찰제는 새로운 조직을 신설하지 않고 기존의 경찰조직에 사무를 나누는 방식을 채택하여 무늬만 자치경찰제라는 비판을 받고 있다. 현재의 자치경찰제는 국가경찰조직이 자치경찰의 업무를 수행하는 제도이다. 이는 일선 경찰관의 업무의 과중과 혼선을 초래한다. 자치경찰위원회는 업무수행과정에서 경찰의 인사・예산권에 대한 문제에 대해서 자치단체와 협의가 제대로 되지 않아 운영상의 문제가 발생하고 있다. 자치경찰제는 국가경찰과 수사경찰, 자치경찰로 사무를 나누어 국가경찰은 정보・보완・외사 등의 사무를 처리하고, 수사 경찰은 경찰청 국가수사본부의 지휘를 받아 사건 수사에 관한 사무를 처리하며, 자치경찰은 생활안전・교통・여성・학교폭력・성폭력 등 생활밀착형 사무를 담당한다. 그러나 이러한 시스템은 하나의 조직에서 국가사무와 자치사무를 처리하고 국가기관인 경찰서는 자치사무를 처리하는 과정에서 자치경찰위원회의 지휘와 감독을 받고 있어 시행과정에서 많은 문제점이 노출되고 있다. 여전히 중앙집권적인 법제와 관행이 유지되고, 현장의 경찰관들은 자치경찰을 실감하지 못하고 있다. 경찰의 임무는 공공의 안녕과 질서를 유지하는 것이다. 따라서 주민을 위한 경찰과 지방화시대에 적합한 자치경찰을 위해서 자치경찰위원회의 권한을 명확히 하고, 자치경찰사무를 처리하는 경찰관 신분의 재조정이 필요하다. 아울러 자치경찰사무를 수행하는 경찰기관과 일반행정기관과의 업무협조에 대한 협의체를 구성하여 의사소통의 단절 현상을 극복해야 한다.

광역단위 자치경찰제의 민주적 운영을 위한 과제

본 연구는 현행 「제주자치경찰제」와 2018년 발표된 정부의 「광역단위 자치경찰제 도입 방안」의 주요내용을 검토·평가하여 향후 광역단위 자치경찰제가 도입되어 단계적 또는 전면적으로 시행될 경우 광역단위 자치경찰제의 민주적 운영과 관련하여 노정될 수 있는 문제들을 개선하기 위한 방안을 선제적으로 검토하여 제시하는 데 그 목적이 있다. 이를 위하여 우선 자치경찰제의 의미와 역사, 법적 근거, 자치경찰제의 논쟁 등 자치경 찰제에 관한 기본적 이론을 논의하여 본 논제의 대상과 범위를 설정하였으며, 이어서 현 행 「제주자치경찰제」와 정부의 「광역단위 자치경찰제 도입 방안」의 주요내용을 검토·평 가하였고, 다음으로 「광역단위 자치경찰제 도입 방안」에 대한 평가를 바탕으로 하여 광 역단위 자치경찰제의 도입 이후 자치경찰제의 민주적 운영을 위한 과제(개선방안)가 무 엇인지 분석하였다. 분석결과는 광역단위 자치경찰제의 단계적 또는 전면적으로 도입함 에 있어서 선결적 과제(개선방안)로서 자치경찰기관의 정치적 중립의 확립, 자치경찰공무 원의 신분보장 강화, 자치경찰의 사무수행의 효율성 제고, 국가경찰과 자치경찰 간의 대 등·협력 관계 수립 등의 방안을 우선적으로 강구할 필요가 있는 것으로 분석되었다. There is a repeatedly raised argument that with the current national police system, it is impossible to respond to a periodic change in the era of democracy and decentralization of power and to actively deal with significantly different demand of public security. As such, there is a national consensus asserting that it is necessary to establish a new concept of police that co-exists with local people and to introduce an autonomous police system under the control of local people within a close distance. In consideration of such atmosphere, the Moon Jae-in administration has decided to promote the metropolitan autonomous police system selected as a national project along with the democratic reform of authorities by phase through model implementation from 2019 and plans to expand such system nationwide in 2022. In this sense, the purpose of this study is to proactively examine and present a measure to improve potential issues regarding the democratic operation of metropolitan autonomous police system in case such system is introduced and fully implemented in future by reviewing and evaluating the main contents of the current Autonomous Police System of Jeju Special Self-Governing Province and the Metropolitan Autonomous Police System Introduction Plan announced by the government in 2018. For such purpose, target and range of the subject were set by describing the basic theories of autonomous police system such as meaning, history, legal grounds of autonomous police system, and arguments over such system. In addition, the main contents of the Autonomous Police System of Jeju Special Self-Governing Province and the Metropolitan Autonomous Police System Introduction Plan announced by the government were reviewed and evaluated, and then tasks for democratic operation of autonomous police system after the introduction of metropolitan autonomous police system were specifically presented based on the evaluation of the Metropolitan Autonomous Police System Introduction Plan as the following: securing of political neutrality of autonomous police agency, guarantee of autonomous police officer’s status, execution of autonomous police business, and re-establishment of relationship between national police and autonomous police.
