본 연구는 사이버 공격 대응을 위한 예방적 자위권의 허용 가능성과 실행 방안을 살펴보고, 오늘날 이 논의가 지니는 중요성을 고찰하고자 한다. 중세 이래 정전론의 흐름을 살펴보면, 국가의 고유한 권리인 ‘자위’에는 ‘예방적’ 자위의 의미가 내재되어 있었다. 이는 캐롤라인 공식으로 확립되어 관습국제법에서 공식화된다. UN 체제에 들어오면서 ‘자위’의 개념이 명문화됨에 따라, 예방적 자위권의 허용 가능성에 대한 논란이 제기된다. 그럼에도 UN헌장 성안자들이 제51조에 남겨둔 ‘고유한 권리’라는 문구에 주목해 볼 때 예방적 자위권은 헌장상 도출되는 권리로 해석이 가능하다. 현존 국제법이 사이버상에도 적용 가능하다는 국제사회의 합의가 이뤄지면서 예방적 자위권은 사이버 공간에도 그대로 적용된다. 한편, 물리전과 사이버전의 차이로 인해 기존 물리전에서 적용되던 ‘무력공격’ 해당성 판단과 ‘임박성’ 요건의 엄격한 ‘시간적 기준’을 사이버 공간에 그대로 적용한다면 예방적 자위권 행사가 거의 불가하게 된다. 이에 따라, ‘무력공격’ 기준선의 재조정을 촉구하고 ‘물리적 파괴’의 효과보다 ‘목표 기반적 접근 방식’의 확대를 제안하며, 엄격한 시간적 기준이 아닌 ‘기회의 창’ 기준에서 ‘임박성’ 요건의 재해석을 시도하고자 한다. 무력공격의 문턱을 넘지 않는 수많은 사이버 공격에 대응하는 데 있어서 ‘누적적 사건론’은 중요한 시사점을 제공한다. 일련의 사이버 공격이 무력공격 해당성을 구성하기 직전에 ‘기회의 창’ 범주 내에서 예방적 자위권을 실행할 수 있기 때문이다. 오늘날 이 논의는 분단국가의 현실에서 안보상의 함의를 갖는다. 사이버 공격에 대한 공세적 대응에 국제법적 정당성을 부여하고 ‘사이버 억지’, ‘사이버 전자전’으로 구현되는 사이버 안보 정책에 법적 근거를 제시한다. 이 연구는 궁극적으로 사이버 공격에 대한 국제법의 역할을 확인하고, 한반도의 운명이 걸린 사이버전을 대비하기 위한 국제법적 전략을 수립하는 데 기여하고자 한다. This study examines the permissibility and implementation of anticipatory self-defense in response to a cyber-attack and considers the relevance (significance) of this discussion today. Throughout the history of the ‘just war theory’ since the Middle Ages, self-defense as an inherent right of states has had the connotation of 'anticipatory' self-defense. This was established in the Caroline doctrine and formalized in customary international law. As the concept of 'self-defense' has been codified in the UN system, the permissibility of anticipatory self-defense has been debated. Nevertheless, anticipatory self-defense can be interpreted as a right derived from the Charter, noting the phrase "inherent right" left by the drafters of the UN Charter in Article 51. Anticipatory self-defense also applies to cyberspace, as there is an international consensus that existing international law is recognized in cyberspace. However, due to the differences between physical and cyber warfare, it would be virtually impossible to exercise anticipatory self-defense if the standard for determining an ‘armed attack’ and the strict ‘temporal standard’ of the ‘imminence’ requirement as applied in physical warfare were applied to cyberspace. Therefore, I propose a readjustment of the ‘armed attack’ threshold and an expansion of the ‘target-based approach’ as opposed to focusing on the effects of ‘physical destruction’, and a reinterpretation of the ‘imminence’ requirement in terms of a ‘window of opportunity’ rather than a strict ‘temporal standard’. On the other hand, when dealing with numerous cyber-attacks that do not cross the threshold of an ‘armed attack’, the application of the ‘accumulation of events theory’ to cyberspace allows for a scenario in which anticipatory self-defense can be exercised within the ‘window of opportunity’ category just before a series of cyber-attacks constitutes an ‘armed attack’. Today, this discussion has security implications in the reality of a divided state. It legitimizes international law with regard to offensive responses to cyber-attacks and provides a legal basis for cybersecurity policies implemented as 'cyber deterrence' and 'cyber-electronic warfare'. Ultimately, this study aims to confirm the role of international law in responding to cyber-attacks and contribute to the formulation of an international legal strategy by which to prepare for cyber warfare with the fate of the Korean Peninsula at stake.
ABSTRACT After the United Nations agreed the existing international law could be applied to cyberspace, efforts have been made to further clarify its method and scope of the application. In particular, the right of self–defence was a subject on which states had different opinions, leading the concept to be reflected indirectly in the fourth UNGGE report. Under current international law, where the use of force by individual states is extensively prohibited, self-defence is an exceptional cause. Especially, considering the fact that the risk of cyber operation aimed at a specific country is increasing and cyber operations by non-state actors are frequently occurring, it seems necessary to discuss the right of self-defence focused on cyber. In this sense, this dissertation examines whether the existing international law can be applied to cyberspace. This includes both discussions on whether cyber operation can come under the category of the concept of armed attack and the condition for self-defence; and discussions on responding with cyber operations against armed attacks. Article 51 of the UN Charter can be applied irrespective of the means or weapons used, therefore cyber operations can constitute an armed attack if they meet certain criteria. In addition, in determining whether the UN Charter can be applied, the 'scale and effect' criteria may be applicable to existing customary international law. Traditionally, only states have been understood as actors of the armed attack, however, as the capacity and influence of the non-state actors increase, the voice that the non-state actors should be included as the actors of the armed attack is becoming highly persuasive. Specifically, it is underscored that countries should be able to cope with the acts of non-state actors by force, considering the openness of the cyberspace and its inter-connectivity. The requirements of the right of self-defence under existing international law are also valid in cyberspace. All the substantive requirements established by customary international law – the necessity, proportionality, and immediacy - and the procedural requirements of Article 51 of the Charter of the United Nations are all required. Regardless of whether a preceding armed attack uses cyber means and whether cyber means are used during the exercise of self-defence, these requirements should be met. The right of collective self-defence is an established concept clearly identified in Article 51 of the Charter of the United Nations along with a number of treaties. In order for the right of collective self-defence to be effective, a request must be made by the victim country. The North Atlantic Treaty Organization (NATO) and the European Union (EU) have confirmed the possibility of the exercise of collective self–defence against cyber operations. The right of anticipatory self–defence is not a concept recognized in the Charter of the United Nations. However, considering the fast speed of cyber operation and the low possibility of predicting the scale of damage, its application is called for. 국 문 초 록 유엔 차원에서 사이버공간에 기존 국제법을 적용할 수 있다는 합의가 이루어진 이후, 그 적용 방식과 범위를 보다 구체화하려는 노력이 이어지고 있다. 특히 자위권의 적용 문제는 국가들 간 입장 차가 분명했던 주제로서, 제4차 UNGGE 보고서에 우회적 용어로 반영되었다. 개별 국가에 의한 무력사용이 광범위하게 금지되는 현 국제법 체제 하에서 자위권은 그 예외적 사유라는 점에서 상당한 의미를 갖는 개념이라고 할 수 있다. 특히 특정 국가를 겨냥한 사이버 조작의 위험성이 점점 증대되고, 비국가 행위자에 의한 사이버 조작이 빈번히 일어나고 있는 현실을 감안할 때 사이버에 초점을 맞춘 자위권 논의가 필요하다고 생각된다. 따라서 이 논문은 사이버공간에 기존 국제법상 자위권이 적용가능한지를 검토하였다. 이는 사이버 조작이 자위권 발동 조건인 무력공격에 해당할 수 있는지의 논의와 무력공격에 대해 사이버 조작으로써 대응하는 측면의 논의를 모두 포함한다. 유엔 헌장 제51조는 무력공격을 행하는 데 사용된 수단이나 무기와는 무관하게 적용이 가능하므로 사이버 조작 역시 일정 기준을 만족할 경우 무력공격을 구성할 수 있다. 또한 이를 판단함에 있어 기존 관습국제법상 ‘규모와 효과’ 기준이 적용 가능하다. 전통적으로 무력공격의 행위 주체는 국가로 이해되어 왔지만, 비국가 행위자들의 역량과 영향력이 증대됨에 따라 무력공격의 행위자로서 비국가 행위자도 포함되어야 한다는 목소리가 설득력을 얻고 있다. 특히 사이버공간의 개방성, 상호연결성 등을 고려할 때 비국가 행위자들의 행위에 국가들이 무력으로 대응할 수 있어야 한다는 점이 강조된다. 기존 국제법상 자위권 요건들 역시 사이버공간에서 유효하다. 관습국제법상 확립된 실체적 요건들인 필요성, 비례성, 즉각성과 유엔 헌장 제51조 상의 절차적 요건들이 모두 요구된다. 이는 선행하는 무력공격이 사이버 수단을 사용하는지 여부와는 무관하게, 또 이에 대해 자위권 발동 시 사이버 수단으로 대응하는지 여부와는 무관하게, 자위권 원용국은 이들 요건들을 만족시켜야 한다. 집단적 자위권은 유엔 헌장 제51조 및 다수의 조약들에서 확인되는 확립된 개념이다. 집단적 자위권의 원용이 유효하기 위해서는 피해국의 요청이 있어야 한다. 북대서양조약기구와 유럽연합은 사이버 조작에 대한 집단적 자위권의 발동 가능성을 확인한 바 있다. 예방적 자위권은 유엔 헌장에서 확인되는 개념은 아니며, 그 인정 가능성에 대한 의견도 다양하다. 그러나 사이버 조작의 발현 속도가 빠르고 피해 규모의 예측가능성이 낮다는 점 등을 고려했을 때 그 적용의 필요성이 요구된다.
북한의 핵 실험에 따른 군사적 대응전략 연구 : 제3차 핵실험을 중심으로
북한은 국제사회의 반대에도 불구하고 2013년 2월 12일, 김정은 정권 출범 1년에 즈음하여 제3차 핵실험을 실시하였다. 이는 취약한 권력기반을 극복하고 강한 지도자로서의 이미지를 구축하며, 한국과 미국을 포함한 국제사회에 사실상의 핵보유국 지위를 인정받기 위한 것이라 평가된다. 특히 제3차 핵실험은 고농축 우라늄탄(HEU) 제조 가능성과 대륙간 탄도미사일(ICBM) 탑재용 소형화․경량화된 핵무기 개발을 시사하고 있다는 점에서 북한의 핵위협은 이전보다 더욱 증가되었며 현실적인 문제로 대두 되었다. 북한의 핵문제는 제1차 핵위기로부터 20여년, 6자회담이 진행된 이후 10여년의 세월이 경과되었다. 그 동안 한국은 ‘한반도 비핵화 선언’등을 통해 우리의 핵 주권을 유보하면서 대북협상, 경제적 지원, 한미공조에 의한 군사적 위협 등 북한의 비핵화를 위해 다양한 노력을 기울여 왔다. 하지만 결과적으로는 북한의 핵개발을 막지 못하였고, 결국 제3차 핵실험까지 도발하게 되었다. 본 논문은 북한의 핵문제 해결을 위한 군사적 대응전략 중심으로 연구를 실시하였다. 물론 6자회담이나 다자간 회담등 외교적으로 평화롭게 북핵문제가 해결되어 한반도의 비핵화 실현이 가장 이상적이라고 본다. 하지만 김정일의 유훈에 따라 강력한 핵보유의 의지를 보이는 북한의 김정은 체제에서 그러한 결과를 기대하기는 매우 어려울 것으로 보인다. 따라서 현실적이며 실질적인 문제 해결 방법인 군사적 대응전략으로 접근하게 되었다. 먼저 북한이 핵을 보유하게 된 배경을 현실주의적 관점과 북핵문제 해결을 핵 억지 이론을 통해 살펴보았다. 그리고 북한의 제1, 2차 핵개발 진행과정과 문제해결을 하기위한 한국과 북한, 미국과 중국을 포함한 주변국들의 6자 회담의 진행과정과 한계를 분석하였다. 다음으로 제 3차 핵 실험에 대한 북한의 의도와 수준, 위협의 정도 등을 살펴봄으로서 북핵 문제의 현 실태와 위협을 확인하였고, 3차 핵실험 이후의 미국, 중국, 일본, 러시아 등 한반도 주변 강국들의 반응을 분석하였다. 북한은 핵무기를 이용하여 한국을 공격할 수 있는 능력을 보유하고 있고, 체제의 유지를 위해 절대 핵개발을 포기하지 않을 것으로 보인다. 이것은 아직도 전쟁이 끝나지 않은 휴전상태라는 점에서 본다면 국가안보의 측면에서 심각한 상황이라고 하지 않을 수 없다. 지금까지 한국은 북한의 핵개발에 대해 적극적인 대응전략을 구비하지 못했다. 화해와 협력을 통하여 평화적으로 해결하고자 하는 희망이 큰 탓도 있지만, 대응전략을 세우는 노력이 부족하였기 때문일 것이다. 눈을 감는다고 핵위협의 실체가 없어지는 것은 아니다. 한국은 외교적인 노력뿐만 아니라 최악의 상황을 가정한 실질적이고 현실적인 대책마련에 대해 심각한 고민과 노력이 필요하다. 이에 필자는 여러가지 군사적 대응전략들을 살펴보고 실현가능성과 핵 억지 효과면에서의 현실적인 북핵문제를 해결하기 위한 필요한 최선의 군사적 대응전략을 제시해 보았다.
