RealDoll is a doll that simulates not only the shape of a person but also the shape of the genitals, and it became an issue when the Supreme Court recently confirmed that the administrative disposition to withhold import customs clearance for RealDoll imports should be canceled. RealDolls have RealDolls in the shape of children and adolescents and RealDolls in the shape of adults, and there are no regulations directly regulating all RealDolls in Korea, which is a problem. Currently, legal regulations related to RealDoll include the designation of harmful businesses for youth under the Child and Youth Protection Act and the Education Environment Protection Act, the crime of distributing pornography under Article 243 of the Criminal Law, and the suspension of import customs clearance under Article 243 (1) and 237. RealDolls in the form of children and adolescents are prohibited for the protection of children and adolescents. It is reasonable to prevent children and adolescents from accessing adult RealDolls. However, it is questionable that adults should completely ban manufacturing, importing, purchasing, using, and possessing adult-shaped RealDolls. As long as our court regards RealDoll as a “sexual product,” it can be described as a sexual part or act based on the Constitutional Court's decision that it is necessary to refrain from regulating RealDoll even if it is recognized as a state. The position that the use or possession of adult-shaped RealDolls should be completely prohibited is that the existence of RealDolls itself seriously undermines women's personal rights as it sexually targets women. However, it is questionable whether the existence of RealDoll itself seriously undermines women's personal rights, and rather, the full ban on adult-shaped RealDoll results in infringement beyond the constitution's restriction on individual sexual self-determination. Apart from the full ban on real dolls in the form of children and adolescents, it is necessary to minimize restrictions on individuals' sexual self-determination by regulating or punishing them only for illegal purposes such as real dolls experience rooms. 리얼돌이란 사람의 형상뿐 아니라 성기의 형상까지 모사한 인형으로 최근 대법원에서 리얼돌 수입에 대한 수입통관 보류처분을 취소하라는 판결이 확정되면서 이슈화되었다. 리얼돌에는 아동・청소년 형상의 리얼돌과 성인 형상의 리얼돌이 있으며, 우리나라에는 모든 리얼돌을 직접 규제하는 규정이 없어 문제가 된다. 현재 리얼돌과 관련된 법적 규정으로는 아동・청소년 보호법 및 교육환경 보호에 관한 법률 등에 의한 청소년 유해업소의 지정, 형법 제243조의 음란물건반포죄, 관세법 제243조 제1호와 제237조 제3호에 따른 수입통관 보류처분 등이 있다. 아동・청소년의 보호를 위해 아동・청소년 형상의 리얼돌을 금지한다거나 아동・청소년이 성인 형상 리얼돌에 접근하는 것을 막는 것은 타당하다. 그러나 성인이 성인 형상의 리얼돌을 제조, 수입, 구매, 이용, 소지하는 것까지 전면적으로 금지해야 한다는 주장에는 의문이 있다. 우리 법원 역시 리얼돌을 ‘성기구’로 보는 한, 사적이고 은밀한 영역에서의 개인적 활동에는 국가가 되도록 간섭하지 않는 것이 인간의 존엄성과 자유를 실현하는 길이 되므로, 원칙적으로 리얼돌을 규제할 필요성이 인정되더라도 이를 일반 음란물과 동일하게 취급하여 규제하는 것은 자제할 필요가 있다는 헌법재판소의 결정을 근거로 들면서, 리얼돌이 사람의 존엄성과 가치를 심각하게 훼손・왜곡하였다고 평가할 정도로 성적 부위나 행위를 적나라하게 표현 또는 묘사한 것으로 볼 수 없다는 입장이다. 성인 형상 리얼돌의 전면 금지는 헌법상 보장되는 개인의 성적 자기결정권을 침해하는 결과를 초래하므로 타당하지 않다. 따라서 아동・청소년 형상 리얼돌의 전면 금지는 별론으로 하더라도, 성인 형상 리얼돌의 경우에는 원칙적으로는 허용하되 예외적으로 리얼돌 체험방 등 불법성이 짙은 목적으로 사용되는 경우에 한하여 규제하거나 처벌하는 방식으로 개인의 성적 자기결정권에 대한 제한을 최소화할 필요가 있다.

오랜 역사에서 인형은 생활의 일부로 존재하였다. 특히 어린이들의 성장과정에서 인형의 존재는 다양한 정서발달에 기여하는 도구로 큰 의미를 가진다. 그런데 최근에 ‘성인용 리얼돌’에 대한 사회적 논란이 커지고 있다. 성인용 리얼돌은 성적 도구로 활용할 목적으로 제작된 것으로 사람의 실제 모습과 유사하고 성적 기능을 한다는 점에서 성문화와 청소년 보호를 중심으로 논란을 초래하였다. 그리고 성인용 리얼돌의 수입통관 보류처분에 대한 대법원의 취소판결은 성인용 리얼돌에 대한 규범적 재평가를 확인하였다. 성인용 리얼돌은 이미 국내외에서 크게 확산되고 있는 것이 현실이지만, 성인용 리얼돌의 음란성 또는 반사회성에 대한 논란도 함께 커지고 있다. 도덕적 측면 또는 법적 측면에서 성에 대한 규범적 가치가 성인용 리얼돌의 형태와 기능에 대하여 여전히 사회적으로 강하게 충돌하고 있기 때문이다. 성인용 리얼돌은 과학의 발전에 따라 음성, 움직임 등 더욱 사람과 유사한 안드로이드(Android)로 진화가 이루어질 수 있지만 그 본질은 성기구의 일종으로 성적 취향에 따라 이용하는 도구일 뿐이다. 그러므로 성인용 리얼돌에 관한 사회적 논의는 성인용 리얼돌의 특성으로 새롭게 초래하는 지인형 성인용 리얼돌에 의한 인격권 등의 침해와 청소년의 성보호 위험성을 중심으로 규제를 마련하는 데 집중할 필요가 있다. 성에 대한 규범적 가치의 문제는 감성을 수반한다는 점에서 논리적이고 획일적인 규범적 기준을 제시하기는 매우 어렵다. 그러나 성인용 리얼돌 규제의 합리적인 방향성을 논의하여 법제를 마련하는 것이 시급하다고 본다. 특히 청소년의 성보호는 당사자보다 법정책에 의한 보호제도의 정비가 매우 중요한 기능을 한다는 점에서 성인용 아동 리얼돌의 제작과 유통, 소지 전반에 걸쳐 강력한 규제제도가 신속하게 마련되어야만 한다. 아청법에서 ‘아동ㆍ청소년성착취물’에 ‘아동ㆍ청소년 형상 성기구’를 포함하여 용어의 정의와 처벌규정을 정비하고, 대통령령을 활용하여 ‘아동ㆍ청소년 형상 성기구’의 기준과 인증제도를 마련하면, 청소년 아동 리얼돌을 금지하는 합리적인 법제적 기초가 바련될 것으로 본다.
리얼돌, 지배의 에로티시즘: 여성신체 유사 인공물에 기반한 포스트 휴먼적 욕망 생태학 비판

필자는 이 논문을 통해, 한국사회를 뜨겁게 달군 리얼돌이라는 사회적 쟁점을 세 가지 측면에서 고찰해 보고자 한다. 첫 번째로 리얼돌의 존재론적 위상을 살펴보자면, 리얼돌은 여성의 신체 형상을 머리부터 발끝까지 고도로 모사해낸 여성-유사물임과 동시에, 여성을 남성의 욕망규준에 알맞게 조작, 변경한 허상(illusion)이기도 하다. 즉 리얼돌은 단순히 원본과 매우 유사한 정도에 그치는 것이 아니라, 오히려 원본을 구조화하고 재조건화하는 초실재적 욕망 단위로 기능함으로써, 여성신체형상을 남성의 욕망 그릇으로 최적화하는 장치이다. 두 번째로 리얼돌은 섹슈얼리티를 궁극적으로 남성의 자위행위에 불과한 것으로 축소시킨다는 점에서, 남성의 성적 유아론을 구축하는 장치라 할 수 있다. 성적인 유아론이란 타자의 존재나 욕망, 관점 등은 모두 소거한 채, 타자를 자신의 욕망의 도구로만 여기며 오로지 자신의 욕망만을 실재하는 것으로 여기는 것을 뜻한다. 남성의 성적 유아론은 여성의 욕망과 관점의 실재성을 모두 제거하는 것으로 사물의 여성화와 여성의 사물화라는 두 가지 절차를 거친다. 세 번째로 리얼돌 수 입, 판매를 허용한 2심과 대법원 판결문은 리얼돌의 사용 주체부터 이것의 심리적, 성적, 사회적 순기능의 수혜자를 남성으로 한정하여 논의할 뿐, 정작 이것이 여성들에게 어떠한 영향을 미치며 어떠한 심리적, 물리적, 성적 위해를 낳을 수있는지에 대해서는 전혀 다루고 있지 않다. 또한 판결문에서 상정하고 있는 존중받아 마땅할 개인의 성적 자유란 남성의 성적 공격성의 확장과 보장을 의미하는 것이지, 이러한 남성의 성적 자유의 확대가 여성의 인권과 자유라는 기본권의 침해로 이어지는 것은 문제시하고 있지 않다. 이러한 관점에서, 리얼돌 수입, 판매 허가 판결은 여성 시민의 자리를 일체 소거한 남성편향적이며 불평등한 결정이라 할 수 있다. 뿐만 아니라, 리얼돌에 의해 촉발된 욕망 테크놀로지가 어떻게 A.I 섹스로봇의 개발로 이어지고 있으며 이것의 활용방식이 얼마나 포스트 휴먼적이지 않은지, 즉 얼마나 남성중심적 휴머니즘의 갱신 행위이자 남성폭력의 고착적 상상력의 재생산에 불과한가를 정치하게 드러낼 것이다. This article aims at providing a philosophical and critical analysis on the sex doll that is a political issue in Korean society. First, I will focus on the ontological status of this sex doll that is both an imitation of the female body and an illusion of the woman suitable to the economy of male desire. This sex doll is a hyper-real image that determines and conditions the original to manipulate the image of the body of women that is subjugated to masculinist and sexist desire. Second, the sex doll is what reduces the field of sexuality to male masturbation which is only a device of sexual solipsism. It means the elimination and denial of the existence of the other and the different perspective and desire of women to promote only the desire of men. It goes through the feminization of the thing and the objectification of the woman. Third, the judicial decision of the second instance and the last instance on the authorization of the importation of the sex doll is a one-sided decision that does not take into account the current situation of women and their right injured by this authorization. This judgment deals only with the sexual freedom of men and the positive aspect of this sex-doll to the detriment of women"s rights. In addition, the technology that concerns sexuality and pleasure is what produces not only the sex doll, but also the sexual robot. This technology is not post-human at all, but rather a renewal of sexist humanism. Advancing technology without questioning sexism could only reinforce male violence against women.
섹스로봇은 인격적 동반자가 될 수 있는가 ‘상징-결과 논변’에 대한 반론

이 글은 한국사회에서 논란이 되는 리얼돌(real doll)이 단순한 성적 만족을 위한 도구 가 아닌 인격적 존재로 발전될 수 있는가에 관해 논하고자 한다. 그를 위해서 우선 리얼돌 에 반대하는 대표적인 입장의 핵심 논변인 ‘상징-결과 논변(symbolic-consequences argument)’을 비판적으로 검토해보고자 한다. ‘상징-결과 논변’은 리얼돌(섹스봇 포함)이 윤리적으로 문제가 있는 성적 규범(sexual norms)을 상징적으로 보여주며, 이는 결과적 으로 사회에 부정적인 영향을 미치므로 리얼돌의 생산 및 판매가 금지되어야 한다고 주장 한다. 본 논문에서는 윤지영(2020)의 입장을 ‘상징-결과 논변’으로 재구성하여, 그 타당성과 건전성을 검토해보고자 한다. 결론적으로 리얼돌이 여성에 대한 남성의 왜곡된 성적 인식 을 상징적으로 보여주며, 그 결과 리얼돌의 생산 및 판매가 금지되어야 한다는 이 논변은 건전하지 못한 논변임이 드러날 것이다. 끝으로 만일 ‘상징-결과 논변’이 건전하지 못한 논변이라면, 우리 사회가 리얼돌을 어 떻게 바라봐야 하는지(바라 볼 수 있는지), 그리고 철학의 영역이 끝나고 제도적, 법적 규 제가 시작되는 지점이 어디인지를 분명하게 드러내 보고자 한다. This study discussed whether the real doll, which is controversial in Korean society, can evolve into a personal being than a simple tool for sexual satisfaction. The ‘symbolic-consequences argument,’ which is a critical argument in the representative position against the real doll, was critically examined. The ‘symbolic-consequences argument’ insists that the production and sale of real dolls should be banned as they symbolize ethically problematic sexual norms (including sexbots) and subsequently harm society. This study reconstructed Yoon Ji-young (2020)’s position into a ‘symbolic -consequences argument’ to review its validity and soundness. In conclusion, the argument, ‘real dolls symbolically represent men’s distorted sexual perceptions of women, and therefore, the production and sale of real dolls should be banned,’ is proven to be an unsound argument. Finally, this study also intended to indicate how our society should (may) view real dolls if the ‘symbolic-consequences argument’ is unsound and where the philosophical domain ends and institutional and legal regulations begin.
아동형체 ‘리얼돌’ 성범죄화에 관한 영미국가 입법동향 비교 분석

There are policy concerns on so-called child-like sex doll, or real-doll, or sex-robot as they may pose threats to children as a way of child sex exploitation or child sexual abuse. Whilst adult-like sex doll or sex may be on dispute regarding freedom of expression and privacy, child-like sex doll or sex robot should be prohibited as child pornography material, and thus punished as serious crime. According to the U.S. Curbing Realistic Exploitative Electronic Pedophilic Robots Act of 2017, the term ‘child sex doll’ means an anatomically-correct doll, mannequin, or robot, with the features of, or with features that resemble those of, a minor, intended for use in sexual acts. The Act recognizes that there is a correlation between possession of the obscene dolls, and robots, and possession of and the participation in child pornography. The dolls and robots not only lead to rape, but they make rape easier by teaching the rapist about how to overcome resistance and subdue the victim. The dolls and robots are intrinsically related to abuse of minors, and they cause the exploitation, objectification, abuse, and rape of minors. According to the Australian Combatting Child Sexual Exploitation Legislation Amendment Bill 2019, child-like sex doll is an object that is three-dimensional, resemble children and has imitation orifices intended to be used for simulating sexual intercourse. Amendment Bill of the Act on The Protection Of Children And Youth Against Sex Offenses in September, 2019 also proposes criminalisation of child-like sex toys. In the long term, there would be more risk of child sex exploitation as new technology is exploited as sex doll or sex robot. For protecting children against sexual abuse and assisting them to become sound members of society, as the Act defines, there should be effective policies against child-like sex dolls. 최근 이른바 ‘리얼돌’혹은 ‘섹스돌’ 문제와 관련해서 특히 아동신체를 모사한 물품이나 기구가 아동대상 성착취 목적으로 제작, 유통, 사용될 경우 이를 금지하거나 규제해야 할지 논란이 되고 있다. 아동형 섹스돌(child-like sex doll) 문제는 미국, 영국, 캐나다, 호주 등 국가에서도 최근 사회문제가 되면서 형법적 제재가 추진되고 있다. 본 논문에서는 형법적 규제대상으로서 성적 착취대상 아동신체형상물의 법적 개념과 제재에 관한 미국, 영국, 캐나다, 호주 등 영미국가의 최근 관련 입법동향을 비교분석하고, 현재 우리 국회에서 논의 중인 입법안과 관련하여 검토해 본다. 무엇보다 아동신체와 매우 유사한 형태 물건이 적절한 법적 규제가 없는 상태에서 성적 만족, 또는 소아성애적 만족 목적으로 제작, 유통, 판매, 소비된다면 아동에 대한 성적 착취 위험성과 관련성이 예상가능하다. 따라서 미국과 호주는 엄격한 금지 입법을 추진하고 있으며, 영국, 캐나다는 수사기소지침과 판례를 통한 규제정책을 도모하고 있다. 아동형 섹스돌이 현행법체계상 아동·청소년의 건전한 성적 성장과 성적 자기결정권 보호를 직접적으로 침해하는 범죄에 해당되지 않을지라도, 우리 사회가 그동안 아동·청소년 보호와 성보호 법제를 통해 강화해 온 아동보호의 사회적 책무에 반할 뿐만 아니라, 사회풍속 저해는 물론 아동청소년에 대한 직접적 성착취로 이어질 위험성이 인정될 수 있다.따라서 아동형 ‘리얼돌’ 규제 문제는 현행 아동청소년성보호법 등 아동보호법제 개정도 필요하지만, 장기적으로는 가상현실, 인공지능 기술과 결합되면서 섹스인형, 섹스로봇 등으로 그 위험성이 다양화되고 증폭되면서 법적 대응이 더욱 어려워 질 것이므로, 장기적으로 법적 대응 체계를 마련해야 할 필요가 있다.

One of the main arguments against the development and use of real dolls and sex robots is that the use of these artifacts results in an invasion of humanity. In this paper, I will discuss that this argument is based on contingent symbolism, not claims based on real grounds, and therefore we may not confirm that these artifacts do infringe on humanity. Through this, I will argue that we may not depend on such arguments that are strongly based on highly arbitrary and contingent symbolic meanings of objects, and that human dignity should be prepared from practical grounds, not based on symbolism of objects. 리얼돌과 섹스로봇의 개발과 사용을 반대하는 주된 논의 중 하나는 바로 이러한 성적 인공물의 사용이 결과적으로 인간성의 침해로 이어지게 된다는 것이다. 이 논문은 이들의 논증은 실재적 근거에 의한 주장이 아닌 우연적 상징성에 근거한 주장으로 이루어져 있음을 먼저 지적한다. 이를 바탕으로 리얼돌이나 섹스로봇의 개발과 사용이 어떠한 결과로 이어지게 될 지는 이러한 우연적 상징에 기반한 논증으로 명백히 평가될 수 없고, 인간의 존엄성 역시 사물에게 부여된 우연한 상징성에 기반한 것이 아닌 실천적 근거로 부터 마련되어야 함을 주장할 것이다.

Sex doll production process and online male communities show a male desire for “controllable women” observed in the South Korean sex industry. This article examines the South Korean sex doll (also referred to as RealDoll) research positions the realdoll industry and its relationship to the sex industry. For this study, Korean sex doll manufacturers, experience room operators, and individuals who have owned sex dolls between 2019 and 2022 were interviewed. Additionally, two online RealDoll forums were observed. First, the Korean RealDoll industry seeks to depoliticize criticism on sex dolls by dissociating it from the sex industry. However, the sector selectively associates with the sex doll market, indicating that the rhetoric around RealDolls is inherently political. Second, the RealDoll production process and the operation of the sex doll experience rooms adopt the Korean sex industry’s image of ‘intimate’ women. The image of a ‘controllable woman’ is materialized through the use of TPE, silicone, or the experience space. Third, online communities and forums serve as a central hub that attracts players within the Korean sex doll industry, and are also reproduced through the male homosocial dynamics among members. Online communities facilitate relationships among individuals involved in the industry, allowing those who own sex dolls to reinforce their sense of masculinity create connections between industry participants through dolls, and users reaffirm their masculine ego through produced images and reaffirm a male-homogeneous society.

This article conceptualizes the “real doll” as a sex-doll complex constituted by techno-progressivism, techno-nationalism, women extractivism, and the commodification of experience. Within this complex, the real doll functions as a feminizing dispositif that both enacts the ideal women and positions the women’s body as divisible and reassemblable. It is stabilized through differentiation from mannequins, illicit objects, and childlike forms, and regulated through the boundary politics of place across public/private, legal/illegal, and national/international lines. Such regulation privileges external markers of obscenity over contexts of use, thereby fixing women’s representations as objects of control and expulsion. The article calls for moving beyond morality- or obscenity-based debates to examine how women’s bodies and lives are incorporated into regimes of governmentality.

Focusing on the Supreme Court precedent, this study analyzes the primary issues of the Real Doll's import clearance controversy and examines several problems related to the Real Doll from the perspective of sexual ethics. The controversy for the Real Doll import clearance includes a issue of whether Real Doll would be considered as pornography or as a sex tool. And this influence on the position for national intervention and regulatory about the Real Doll. In addition, there are issues that different observers make different evaluations when deliberating against Obscenity for real dolls and that lack of social consensus on the definition and perception of the Real Doll. Finally, the controversy includes issues that whether it can be distinguish an Adult Real Doll and a child one, and that national regulatory should be different according to the distinction. From sexual ethics, this study shows that a series of issues are related on the epistemological and ontological problem for what the Real Dolls are, the semantic problem that the allowing of the Real Dolls cause sexual objectification and the empirical problem that the use of the Real Dolls are close to sex crimes.

This paper approaches the ethical and legal issues surrounding human-shaped dolls, known as "real dolls," created for sexual satisfaction, focusing particularly on child-like real dolls. Real dolls can be categorized into adult and child forms, with the latter generally presenting more complex legal challenges. Child-like real dolls raise ethical controversies related to the sexual objectification of children and underscore the need for legal grounds for regulation. Additionally, the paper analyzes the current bills proposed in South Korea. It discusses how the production, distribution, and possession of child-like real dolls could be regulated under the current framework of Korean criminal law, examining the possibility of criminal penalties from a criminal law perspective. Specifically, it explores whether real dolls depicting children's bodies realistically are regulated as child exploitation materials, emphasizing the risk that the existence of child-like real dolls could reinforce the potential sexual objectification of children. Through case law and legal interpretation, the paper proposes necessary legal amendments to clearly regulate child-like real dolls within the Korean legal system.support this discussion, the paper also reviews the background of the amendment to German criminal law that recognized the limitations in the criminal provisions regarding child pornography and established a provision to regulate child-like real dolls. Tentatively, the study concludes that child-like real dolls hold potential to severely harm children's human dignity and that the current legal means for effective regulation are insufficient. Therefore, it is deemed urgent to establish concrete regulatory measures, including bans on the manufacture, distribution, and possession of child-like real dolls, to enhance child protection and prevent the sexual objectification of children. However, considering issues from a legal perspective, such as distinguishing between child-like and adult forms and respecting individuals' private spheres, simply establishing laws to ban the distribution, sale, and possession may not be a complete solution.
