      • 南北韓 統一政策의 葛藤構造 比較에 관한 硏究

        Although the reunification issue has been continuously discussed since the national division and the direct discussion about it between South and North Korea has been frequent, it is the reality that the approaches to reunification by both have not made the differences narrow and as time goes by, the way to the reunification seems to be distant. When two different political systems make negotiation for something on a specific issue, the failure and success of the negotiation are almost dependent on the perception of the parties about the structural nature of it. Like this, since both Korea contains a specific issue, that is, a remarkable structural conflict in th fundamental vision of reunification, an agreement is not easy to be found. The structural conflicts in such a specific issue are originated from the basic conflicts between both parties which have fundamentally different systems and ideologies. The reasons which induce the fundamental conflicts in North and South Korea are concentrated on following factors. First, it is considered that the disputes on their orthodoxy in politics, economy, society and culture in South and North Korea result in all conflicts. Second, the neighboring powerful countries which have the interest relations in the Korean peninsula as a n international political environment induce a conflict situation in both Korea, of use the conflict situation and the pursuit of diplomatic profit gives the source of the conflict. Finally, the inconsistent reunification policy by superior political leaders in both Korea, the promotion of the crisis of security in both Korea and the instrumental means over the people brought about the conflicts between both Korea. These basic problems of conflict brought about a conflict in the side of reunification and a mutual conflicts in both Korea is appeared in establishing a basic reunification policy and pursuing it. The reunification method of the Korean race suggested by South Korea and Koryo Federal Republican System by North Korea contain too many differences about the method and goal of the reunification and the future aspect of the nation after reunification and an agreement is not easy to be found by making these differences narrow. The solution of these conflicts is started from that of general conflict and then the gradual solution of the reunification problem. Through such a gradual soltuon of conflicts, the differences of opinions between both Korea can be made narrow. Accordingly, the purpose of this study is to eliminate the conflicts between South and North Korea about reunification problem through the elimination of the basic conflict. And the whole conflict problems will be eliminated when the recovery of homogeneity from heterogenous things in fundamentally different system and ideology in both Korea, the attitudes of reconciliation and cooperation between both parties and the sense of a companion are followed. In addition, in the side of international politics, if major powerful countries wish truly the peace of the world, they must perform the role as a sincere aid for reconciliation and cooperation.

        The unification of Korea peninsula has been undoubtedly recognized as a national problem from when the Korea peninsula was divided, however, the will of unification has been weak because the generation who experienced the pain of partition have been reduced, This reality is very lamentable, so now we should reconsider the will of unification which should be completed by our generation, Especially, the way of North-South Yemen's unification is a very good example to us who forward the peaceful unification by the talks and negotiations between North and South Korea, Eventhough Yemen's unification had been broken even 4 years later, because of the tragedy of civil war. Frankly, Yemen's partition and the process of unification were not a matter of concern until when Yemen declared their unification, It was because no one could expect that the unification of Yemen which had basically the opposition of political ideas could be made by mutual agreement, and because of the lack of information about Yemen as well. Also, the U.S.A the U.S.S.R and Saudi Arabia on which Yemen was very dependent had the influencing power on the unification of Yemen, And there was almost not successful example of national unification. It made the prospect of Yemen's unification be skeptical. However, if made the prospect of the process of Yemen's unification, we can know that there are a few groundworks; the personal and material interchange, the mutual belief through the interchange, the leaders' will for the unification, the persistence of the spirit of unification by mutual agreement, and the consolidation of fine law and system for the ready of unification. We also have the basic policy that unification should be made by the peaceful and normative agreement, not by armed or absorbed unification, as if North - South Yemen forwarded. It is true that we have pronounced to all over the world that we exclude the absorbed constitution. Also, "Korean Cooperation Unification Plan"which is based on 3 principles; independence, peace and democracy, gradually comes to the perpect political unification through the middle step, "South - North Federation." The South - North unification should be completed by the way of democratic and peaceful agreement unification which both countries win together, not by the way of absorbed of unification which one of them wins or not. To do that, not the result of unification but the process of unification should be important. It can be accomplished by the "harmonized unification" of the North and South Yemen's way of agreement unification is instructive model to us, because the way is the same with our unification policy which forward the gradual and peaceful one. However, lamentably, exoerts say that there is little possibility for success The North Korea is the establishment that can only choose the North Korea - oriented unification or the maintenance of only North Korea's establishment. The North Korea can not coexist with us unless we accept North Korea's "subjective idea" which is doctrinal and absolute The democratic establishment which is based on relative idea, permit the coexistence of all kinds of ideas, unless they deny the principle of coexistence. This respect of variety is vital of democratic establishment. However, the establishment of absolutism can not include any other different ideas. So it is impossible to make a political union, if North Korea do not give up their ruling ideology, a "subjective idea." North Korea has insisted "Korea Democracy Federation" which is the last form of unification, since 1980. This federation is based on "one nation, two establishments, two governments". it means that they acknowledge different ideologies and establishments whatever it costs. Lately, the North Korea hands over the U.S.A. and Japan, and announces special plans for economic. These changes are judged of not the change of establishments which give up Leninism but the effort to maintain their present establishment. The North Korea will participate superficially in the South - North talks negotiations, and also they will make a trouble and discord carrying out economic interchange and cooperation between the South government and private corporations or between mutual corporations. The Majority of experts(56.2%) predict that pluralism establishment to accomplish a political unification by agreement for a while, if it is difficult to reform the North Korea's establishment, and also if it is impossible to raise a pro - North Korea's revolution in the South Korea. However difficult it is, all Koreans should have the strong will whatever we can overcome for the great cause of unification. It will never happen again that Korea's future is decided by the world power in spite of ourselves. It is the time that we all should have the will of unification stronger than before.

      • 南北韓 統一 後 北韓의 土地所有權 處理方案에 관한 硏究

        It is more than 6 decades since Korea was emancipated and divided into North and South. Now, Korea is the only nation divided into capitalism and communism in the world. North Korea is the most extreme communist country, while South Korea is an advanced capitalist country who is a member of OECD. Recently, North Korea came to recognize that their communism system could not support their people, showing signs of changes. Given the fact that communism has lost its value in the market of ideology and many communist nations have turned into capitalism market economies, it is expected that North Korea will not resist the current of the history. Then, the hottest bone of issue would be how to dispose all the assets nationalized or owned by cooperatives. The purpose of this study was to find the ways to resolve, after our national unification, the land ownerships among the assets confiscated by the North Korean communist region. The references most frequently used for post-unification handlings of the land ownerships may be the case of Germany who resolved the land ownerships in the former East Germany. Before their national unification, East Germany had kept most of the documents about confiscated and nationalized land ownerships after establishment of their communist regime, while having not thoroughly nationalized all the land ownerships like North Korea. The unified Germany returned the land ownerships in the former East Germany to their original owners. Such a policy of reinstation was possible because most of the documents about the land ownerships confiscated by the communist regime, and therefore, unification cost could be saved. However, such a policy could not well protect former East German people living on the land, causing a great social confusion. As for North Korea, they had cleared out all documents about individuals' land ownerships nationalized after establishment of their regime, while having thoroughly confiscated the lands owned by landlords and pro-Japanese traitors to distribute them to landless or petty farmers free of charge and then, nationalized them gradually to be owned by cooperative farms. Hence, the only way to confirm the original owners of those confiscated lands may be referral to the land ownership documents kept by the original owners who defected to South Korea after the national division. It may be possible for the unified Korea to return the land ownerships in North Korea to their original owners, or if impossible, compensate them for their losses of land ownerships. However, such a policy may blow a serious damage to the North Korean people whose living relied on the land, and may not save the enormous unification cost. Moreover, it would not be conducive to the goals of unification, namely solidarity and prosperity of the Korean people. In addition, we should be aware that many original owners were feudal landlords during Chosun dynasty or pro-Japanese traitors. Furthermore, we should be also aware that national unification will be a great challenge for our people's restoration, not a campaign for recovery of their land ownerships. So, the unified Korean government should re-nationalize the land ownerships in North Korea and then, entrust the North Korean people with them under a long-term rent contract to assure them of their living ground, and sell the land ownerships first to them when they are self-reliant. In a nut-shell, it is essential after our national unification not to allow the land ownerships in North Korea to be tramped down by the past pro-Japanese established forces or irresponsible land speculators.

        남ㆍ북한 통일은 기필코 달성해야 할 민족적 과업이며 역사적 당위성이 있다. 그러나 우리나라는 분단이 장기화되고 있으며, 경제적 수준이 발전하면서 통일을 반드시 극복해야 할 국가적 과업으로 생각하지 않고 분단된 상태에서 안정적인 경제와 민주주의적 정치를 실행해 나가는 것이 적절하다는 의식이 확산되고 있다. 또한 통일을 기필코 달성해야 할 과업으로 인식하지 않는 것은 민족적 정통성과 장차 국가의 미래를 예측할 때 바람직하지 않다. 한반도의 통일은 인과론적 전제 하 분단의 원인을 제거하는 데에서 시작되어야 한다. 한반도 분단의 원인은 대체적으로 대외적 환경요인으로 볼 수 있는데, 대외적 원인은 한반도 특성상 지정학적으로 매우 중요한 데에서 원인을 찾을 수 있다. 역사적으로 한반도는 대륙세력(中ㆍ蘇)과 해양세력(美ㆍ英ㆍ日)이 영향력을 증대하기 위하여 대립하는 각축의 장이 되어 왔다. 그에 따른 독일과 남ㆍ북한은 제 2차 세계대전 이후 강대국의 영향력에 의해 대립 속 각축의 장으로 자국의 의사결정과는 관계없이 분단되었으며, 독일과 남ㆍ북한의 분단 배경과 과정이 매우 흡사하지만 독일은 통일을 달성한 반면 남ㆍ북한은 여전히 긴장감 속에 분단 상태가 지속되고 있다. 이러한 인식 하 통일을 실현하기 위하여 분단 원인을 분석, 평가한다는 사실은 정확한 현실인식에 보다 접근성 있는 대처능력을 제시하고 앞으로 통일한국의 미래에 주변국으로부터 중립적 영향을 발휘하며 논쟁의 중심에서 평화의 중심으로 한걸음 접근하는 계기를 마련해 나갈 수 있다.
