주민자치위원회에 관한 연구 : 구성의 민주성과 운영의 자율성을 중심으로

본 논문은 주민자치위원회 구성의 민주성과 운영의 자율성에 관한 연구이다. 아울러 주민자치위원회를 활성화시키고 주민자치센터의 자치기능을 높이는데 그 목적이 있다. 주민자치센터와 주민자치위원회의 도입·운영은 지금까지 동으로 대표되던 집권적이고 관리지향적인 지방행정조직의 변화를 뜻하며, 주민자치운동의 발전과 지역공동체형성의 중요한 계기라고 할 수 있다. 특히 주민자치위원회의 도입은 지역공동체를 형성하는데 핵심적인 지역리더쉽 형성, 지역운동주체 발굴이라는 점에서 그 동안의 지방자치운동의 한계를 보완하고, 토대를 마련할 수 있다는 점에 의의가 있다. 그러나 주민자치센터의 시범 실시가 완료되고 전면적 실시를 앞두고 있는 시점에서, 그 실행과정상 나타난 효용성에 대한 많은 문제가 제기되고 있다. 운영주체인 주민자치위원의 구성 문제, 지역자원을 충분히 활용하지 못하고 있는 문제, 주민자치센터와 주민자치위원회에 대한 법·제도적 한계와 행정적 지원 문제, 주민 자치의식의 제고와 주민참여 문제 등이 제기되었다. 이러한 문제의식 중, 주민자치센터의 운영 주체이자 주민자치운동의 주체인 주민자치위원회의 위원 구성의 민주성 확보 방안과 운영의 자율성 확보 방안은 매우 중요하다. 위원 구성의 민주성이란 주민으로부터 동의와 협력을 통한, 지역자원의 동원·활용의 과정이 보장되는 것이라 할 수 있다. 이는 현재 동장에 의하여 일방적으로 위촉되어 구성되는 위원회가 주민 자발성을 후퇴시켜 본래적인 자치기능 제고에 역행한다는 점을 지적할 수 있으며, 대안이 될만한 구성방식으로는 직접선출, 단체파견, 동장위촉 방식 등이 결합된 형태가 검토될 수 있을 것이다. 또, 자율적 운영이란 행정으로부터의 지원 협조와 주민의 자발적 참여를 통한 운영으로서, 이는 행정의 지시에 익숙해 있는 주민들의 자치의식을 확대시켜 지역 주민들이 주민자치의 주체로서 나설 수 있도록 한다는 것이다. 이러한 민주성과 자율성의 확보는 법률적 개정을 통한 제도적 보장과 주민자치운동의 실천을 통해서 이루어져야 한다. 주민자치센터와 주민자치위원회는 주민자치운동을 확장시키는 제도적 장치로서 지역공동체 형성에 이바지함으로서, 우여곡절을 겪고 있는 현 지방자치의 든든한 기초가 될 것으로 확신한다. The organization of autonomy committee for residents is based on the backdrops of democratic constitution and autonomous management. This study, against the background, is intended to investigate its democratic constitution and autonomous management. This article, after all, aims at suggesting the desirable directions for promoting the community center and activating residents' autonomy committee. Through the administrative policy to transform Up, Myun and Dong office to community centers a couple of years ago, local administration systems have gone through a sea change. Those efforts provided a momentum for community movement developments. Especially, autonomy committee for residents played an important part in creating resident leaderships and scouting main groups of community movement. But the committees have many problems awaiting solution such as proper choice of committee members, efficient involvement of residents, legal limitations of community center, lack of administrative support and so on. Among them, constitution of autonomy committee is by far the most significant problem. It is no doubt that principle of local community lies in autonomous participation and autonomous management. Thus, the autonomous committee should change its way of constitution by a means of combination of direct election, commission, and representation. In addition, autonomy committee management should be driven by the residents and run democratically.

地方自治團體의 機關構成에 關한 硏究 : 民主性과 能率性에 立脚한 韓國型의 模索

Local government administration is a field of Public Administration. So the idea of the latter can be applied to the former, although some of their criteria of practical adaptation differ somewhat each other with administrative circumstances. This study is to try to research the relationship between the chief executive and council in local government body in view of administrative principles. It is carried out mainly by the two leading ideas of public administration ; democracy and efficiency. This thesis is, on the whole, composed of three main parts. First, the contents of democracy and efficiency are discussed as a broad concept. In the second part, merits and demerits in the composition of local government organ : and the examples of five foreign countries are presented. In the third part, some problems in the composition of self-government body and the reform measures are suggested in the light of logic of effective positive laws and rational criteria of the two leading principles in public administration as well.

한국국회의 원내교섭단체 개선방안 연구

본 연구의 직접적인 동기를 부여해 준 것은 2001년 초에 한국정치에서 벌어졌던 하나의 정치적 해프닝이었다. '의원꿔주기' 혹은 '의원임대'라 표현되었던 민주당 의원들의 자민련으로의 이적은 국민들에게 또 한번의 실망을 안겨주었을 뿐만 아니라 한국의 민주주의에도 퇴보를 가져다 준 사건으로 기록되었다. 언론과 국민 여론으로부터의 비난은 '의원꿔주기'가 또 하나의 정계개편 전략이라는 데 주로 초점을 맞추었지만, 이 사건의 핵심은 다른 데 있었다. 바로 '자민련교섭단체만들기'가 그 핵심이다. '의원꿔주기'는 '자민련교섭단체만들기'를 위한 하나의 방편에 불과했던 것이다. 본 연구에서는 '자민련의 원내교섭단체 구성'이라는 정치적 행위가 각 정당들에게 왜 그렇게 중요한 의미를 가질 수밖에 없었는지, 그리고 과연 원내교섭단체가 한국의 정치과정에서 어떠한 권한과 역할을 담당하고 있으며, 그 정치적 위상은 어떠한지를 살펴보았다. 그 결과 한국정치에서 원내교섭단체는 국회내적 영역에서 뿐만 아니라 국회외적 영역에서도 강력한 영향력을 행사하고 있었으며, 정당들에 있어 원내교섭단체의 구성이라는 정치적 행위는 정당의 발전과 경쟁력 강화, 보다 궁극적으로는 정당의 생성과 소멸까지를 좌우할 만큼 절대적인 의미를 갖는 것이었다. 그런데 이렇게 중요한 의미를 지는 원내교섭단체의 구성요건이라는 것이 너무나 높게 책정되어있어, 국민들로부터 상당한 지지를 받는 정치세력들이 원내에 진출한 이후에도 그 활동에 있어 커다란 제약을 받고 있다. 과도한 원내교섭단체 구성요건은 선거법 상 규정된 봉쇄조항과 마찬가지로 국회내에서 또 하나의 봉쇄 조항으로 기능할 수 있으며, 현재의 구성요건이 논리적 타당성을 갖고 있지 못하다는 점에서 개선이 요구된다. 원내교섭단체가 의회정치과정의 핵심을 이루고 있다는 현실을 고려할 때, 원내 교섭단체의 제도 및 운용의 개선은 궁극적으로 국회개혁의 단초가 될 것이라는 점에서도 커다란 의미가 있다. 원내교섭단체의 구성요건 및 관련제도의 개선은 민주성과 효율성의 조화를 최대화시킬 수 있는 방향으로 이루어져야 하며, 그 과정에서 다른 제도 및 요소들과의 상관관계에 대한 충분한 검토와 고려가 필요하다. 본 연구의 의의를 찾아보자면, 그 동안 많은 연구들이 정당-의회 관계에 있어 정당 쪽에 보다 큰 비중을 두어왔으며, 의회정치를 연구함에 있어서도 오랜동안 간과해 왔던, 그러나 실제적으로 의회정치과정의 핵심적 역할을 담당하고 있는 원내교섭단체를 학문적 관심의 대상으로 끌어 올렸다는 것이라 할 수 있다. 또한 원내교섭단체제도를 채택하고 있는 다른 국가들의 경우를 함께 살펴봄으로써, 현재 한국의 원내교섭단체가 내포하고 있는 제도 및 운용상의 문제점을 상대적으로 비교·고찰해 볼 수 있었다는 점도 작은 의미를 부여할 수 있을 것 같다. What gave me the direct motive about this study is the political happening of year 2001 in Korean Politics. The transfer of registration of MDP (the Millennium Democratic Party) Assemblymen to ULD (the United Liberal Democrats), which is expressed as 'Assemblyman Lease', not only made the Korean people disappointed again but also brought about a backward step to Korean Democracy. Criticism of the press and the public opinion mainly focused on 'Assemblyman Lease', but the point of this affair was another place. 'Making ULD PPG (Parliamentary Party Group)' was the core. 'Assemblyman Lease' was just a means of 'Making ULD PPG'. In this study, I tried to answer such questions as "Why the registration of PPG has great meaning to political parties?", "How much power and relative importance does the PPG have in the Korean Politics?". In the result I came to the conclusion that the PPG has mighty influence on external sphere of the National Assembly as well as internal sphere, and that a political behavior of constituting of PPG has so absolute meaning to the parties as to determine their destiny, such as rise and fall. By the way, the requirements of constituting PPG is appropriated so high, therefore the political groups receiving considerable support from a nation are under many restrictions for political activity even after entering the Assembly. Excessively high requirements of constituting PPG could be another threshold clause to the rising political groups within the National Assembly. And the standard of the present doesn't have any logical adequacy, so it should be revised. In due consideration of the fact that PPG is the core of th process of parliamentary politics, it is very necessary to improve an institution and operation of PPG, which can be a starting point for reform of the National Assembly. The reforms have to be accomplished in the direction to maximize the harmony of 'Democracy' and 'Effectiveness', and sufficient deliberation and examination is also needed in the process. To estimate significance of this study, it is to lift up the PPG, which has been overlooked in the academic world, even to the scholars, studying parliamentary politics for a long time, to the subject of academic interest. Moreover it seems to be so meaningful to investigate foreign cases and compare them with Korean ones, which can be contributive to improve the Parliamentary Politics of Korea in the matter of institutions and operations.
