中國의 船舶假押留制度에 관한 硏究 : 韓國法과의 比較를 中心으로
China and South Korea have been building a good relationship since the establishment of diplomatic relationship between the two countries in August 24, 1992, when China has started their own reform and openness policies and the world was plunged into the peace and co-operation era through the collapse of Soviet Union. Through the last decade, there were amazing growth of trading volumes, industrial, political and cultural exchanges between the two countries. In 2003, China became the top trading partner of Korea, followed by Japan and USA. Numerous trading between the two countries made the rapid growth of marine transportation services and increased marine conflicts as well between the clients and the shipping agencies. Therefore, Korean companies had to manage increasing number of maritime claims and ship arresting in Chinese territory, but due to the lack of understanding in the Chinese legal system, they often failed to settle the disputes quickly. There are three unique features of maritime transportation. it is exposed to natural disasters, it takes long delivery time, and it is typically liquid. Therefore, once a maritime loss takes place, it is very complicated to find out what is behind and who is responsible for the accident,and it takes a lot of time and effort to settle down the dispute. The provisional ship arrest system, therefore, is justified to settle the dispute appropriately and fairly through which the parties can protect legal rights and prevent the loss expansion. in the provisional ship arrest is a typical and very important way of maintaining a maritime claim and solving maritime disputes in China. According to the Special Maritime Procedure Law in China, Chinese Maritime Court has the jurisdiction over any maritime disputes occurred in the Chinese territory and the resulting litigation takes place in China. In addition to that, any concerned claim is a maritime one, ships can be provisionally arrested by the law. That is different from Korean legal system on the provisional ship arrest in many ways such as the legal system, the jurisdiction, the concept, the required conditions, the effect and the procedure. China has not ratified the 1999 International Arrest Convention Treaty, known as an international uniformity in the fields of the provisional ship arrest. But China was the chairman country when the treaty was specified, and they accommodated major issues in the treaty when they enacted the Special Maritime Procedure Law so that they could protect the benefits of domestic shipping industry. This dissertation is studied on the provisional ship arrest system in China, where the Special Maritime Procedure Law is already established by the code of the civil act procedure. Furthermore, the legal comparison between the Chinese provisional ship arrest procedure and the Korean civil execution law is provided and some legal and policy implications are drawn for the revision of the provisional ship arrest system in Korea. This dissertation consists of five chapters. In the first chapter, the purpose, the method and the scope of this research were stated along with an introduction. In the second chapter, the roots of law and the implications regarding the Chinese provisional ship arrest were provided. After reviewing the Chinese maritime laws and the provisional ship arrest system, I compared the differences in the legal system between China and Korea and proposed policy implications on the Korean provisional ship arrest system. In the third chapter, the required conditions for the provisional ship arrest in China and the resulting effects were discussed. In the fourth chapter, the procedure for the provisional ship arrest was studied. Some important issues from the different legal system were discussed and improvement measures were provided. In the final chapter, the dissertation summary was provided and the legalization for the Korean provisional ship arrest system was suggested as a conclusion for the dissertation.

Advances in cutting-edge technologies—such as artificial intelligence(AI), remote navigation technologies, and sensor and communication-based digital infrastructure— are bringing about fundamental changes in the field of maritime transport. At the center of these developments lies the emergence and potential commercialization of Maritime Autonomous Surface Ships(hereinafter “MASS”). The introduction of MASS goes beyond a mere technological transformation of ship operations and calls for a fundamental re-examination of the existing maritime transport law framework, which has traditionally been premised on human seafarer–centered navigation structures and corresponding schemes of liability attribution. In particular, the MASS environment—characterized by data-driven autonomous navigation systems and remote operation frameworks—raises new legal issues, as traditional regimes governing carrier liability, cargo care obligations, exemptions from liability, limitation of liability and the duty of seaworthiness cannot be readily applied without modification. Against this backdrop, this dissertation aims to comprehensively analyze the structural impact of MASS on the carrier liability regime under maritime transport law, with a particular focus on the duty of seaworthiness as a core obligation of the carrier, and to examine the possibility of reconstructing the existing liability framework accordingly. To this end, the study analyzes international discussions on MASS conducted under the auspices of the International Maritime Organization (IMO), including the results of the Regulatory Scoping Exercise(RSE), and examines the limitations of current international conventions and the domestic Commercial Act in adequately accommodating the operational realities of MASS. Through this analysis, the study finds that in the MASS environment, the conventional approach of identifying carrier liability primarily on the basis of formal contractual relationships is insufficient to explain the actual structure of operational risk control and liability attribution. Accordingly, the dissertation argues for the need to reconceptualize the notion of the carrier and the criteria for liability attribution by placing emphasis on substantive control over navigation and the capacity to manage operational risks. It further demonstrates that the traditional concept of seaworthiness—historically understood in terms of physical and human elements at the time of departure—must be redefined as an expanded notion encompassing digital elements such as software stability, algorithmic reliability, communication systems, and cybersecurity frameworks. In addition, the study points out that both the timing of seaworthiness assessment and the structure of the burden of proof should be redesigned to reflect the specific characteristics of MASS operations. Rather than maintaining the duty of seaworthiness as a one-time assessment at a single point in time, the study proposes its reconstruction as a normative standard requiring a comprehensive evaluation of whether technological, operational, and management systems have been properly maintained throughout the entire voyage—from the preparatory stage prior to departure through to the completion of navigation. Alongside this, the dissertation examines the need to reinterpret and reorganize the carrier’s duty of cargo care, as well as the regimes of exemption from liability and limitation of liability, so as to move beyond frameworks premised on the direct actions of human seafarers and to better reflect technology-centered operational structures. Based on these findings, this dissertation proposes a legislative approach that introduces a separate regulatory framework applicable exclusively to MASS. Specifically, rather than directly amending the general maritime transport provisions of the existing Commercial Act, it suggests enacting a separate regulation— tentatively titled the “Regulation on Implementation of the Provisions of the Commercial Act regarding Maritime Autonomous Ships”—to expressly define MASS and to codify differentiated cargo care obligations, carrier exemptions from liability, and the duty of seaworthiness tailored to MASS operations. Such a legislative structure is significant in that it preserves continuity with existing legal norms governing conventional manned vessels while allowing for the establishment of distinct liability standards for highly autonomous MASS in which human seafarers are entirely excluded. Moreover, it may be regarded as a practical legislative alternative that minimizes conflicts with the current legal system while enabling flexible and phased regulation in response to rapid technological developments and evolving modes of ship operation.
Port State Control (hereinafter referred to as "PSC") inspection has been carried out aiming to protect the safety of life at sea and the marine environment from casualties by inspecting foreign ships in most harbors of the world. It has been much more tightened over the operation of substandard ships through a cooperative system called Memorandum Of Understanding on Port State Control on a regional basis recently. However, it is apt to cause serious disputes since PSC officers are most likely to have their subjective judgement for taking steps for ship detention on the spot against defects that found during PSC inspection according to the international convention. Furthermore, the disputes could cause a trade reprisal between countries, which does not suit its purpose. Although a provision on flag State's responsibility and Port State's right was adopted in the UN law of the sea and various international conventions to prevent the dispute, it is inevitable because there is no organization that can perform an unified interpretation and application of the provision and what Port States or PSC officers expound and apply it for the benefit of themselves. Therefore, this study will delve into present PSC problems and suggest a plan for improvement by researching on problems of the domestic maritime law and international conventions related to PSC to drive out the operation of substandard ships, causes and examples of present PSC dispute. First of all, this study is mainly focused on presenting a method for distinguishing between compulsory and recommendatory International Maritime Organization (hereinafter referred to as "IMO") resolution when substandard ships are detained by PSC. It is also discussed why non-contracting parties are applied in IMO convention. Besides, problems and Improvement measures of individual maritime affairs law and foreign ship PSC procedure in the intervention of PSC will be explained after studying interpretation and problems of priority application of international convention that is prescribed in national laws such as ship safety law. Secondly, this study will discuss dispute factors resulting from PSC and conflicts of interests among charterers, ships owners and consignors due to ship detention and so forth by showing those examples. Also, it is helpful to consider responsibility of any loss of lives and injuries happened during detailed PSC inspection. Finally, problems concerning current PSC system will be discussed. Also, three different solutions are presented, which are port state control study group formation, sea safety law enactment and the training of PSC specialists. PSC inspection results could be extended to diplomatic disputes associated with equability between countries since they are likely to be affected by some powerful countries. Therefore, it needs to establish an unified and consistent procedure to prevent the disputes in the process of PSC officer's inspection regardless of ship's registers and nationality. It is true that PSC disputes might be decreased fairly, if the interpretation of convention text follows an ordinary meaning of the convention according to its purpose. Also, customary practices of PSC should be considered in the application of international covention when the meaning of terminology is vague and uncertain. In the end, PSC plays a very important role in most harbors of the world. Therefore, PSC is expected to enhance it's function in the future.
중국법상 외국중재판정의 승인 및 집행의 심리기간 중 보전처분에 관한 입법론적 연구 : -해구해사법원의 대한해운 사건 판결을 중심으로-

Since China joined the New York Convention in 1987, international exchanges have increased and court judgments related to foreign arbitration also progressed. However, years of development have shown that the approval and enforcement of foreign arbitration courts are facing major problems due to the flaws in China's foreign arbitration and enforcement system. In general, litigation and arbitration procedures take a considerable time for judgment to be made by the courts and execution to be completed. If the losing party does not voluntarily fulfill the court's ruling, the winning party's rights may be protected by any compulsory execution. However, if the losing party escapes the property to avoid the execution of the court during the litigation or arbitration process or after the ruling is made, and then the ruling becomes ineffective. Therefore, in order to protect the status of the parties during litigation or arbitration and to ensure the enforcement power of the ruling, most countries give the court the power to issue a disposal authority and a temporary disposition to the arbitration division. In this paper, I reviewed the process of approving and enforcing China's overseas arbitration through the case of a dispute over a charter party between Korea Shipping and China Heahang Group. As a result, the Chinese Maritime Court approved the property preservation application filed by Korea Shipping to China Heahang Group during the hearing based upon approve and execute foreign arbitration, but the first approval was rejected later, and then it caused some problems in preserving the rights of Korea Shipping. To solve this problem, a study was conducted on the disposition of preservation during the hearing period for the approval and execution of foreign arbitration. Also this paper was to analyze the legislative status and legal practice of property preservation during the review period for approval and execution of foreign arbitration and to provide improvement measures to ensure that foreign arbitration courts are approved and executed in China. This paper briefly introduces the scope and grounds for China's approval and execution of foreign arbitration, followed by the meaning and characteristics of temporary disposition of the period during which foreign arbitration are approved and executed in China. The legal basis for the enforcement was described and compared to the temporary preservation disposition under the Chinese Civil Procedure Act, and finally, the legal basis for the preservation of property during the trial period for approval and execution of foreign arbitration courts. This paper first introduces China to the scope and grounds for approval and execution of foreign arbitration, and then describes the meaning, characteristics, and legal basis for the temporary disposition of foreign arbitration China. In addition, after a comparison with the provisional preservation disposition under the Chinese Civil Procedure Act, I proposed legal grounds for the preservation of property during the trial period for approval and execution of foreign arbitration. 중국은 1987년 뉴욕 협약에 가입한 이래 국제 교류가 증가함에 따라 외국 중재판정과 관련된 법적 실무가 증가하였지만, 수년에 걸친 발전으로 볼 때 외국중재판정의 승인 및 집행은 중국의 외국중재판정 승인 및 집행 체계의 결함으로 인해 큰 문제에 직면해 있다. 소송 및 중재절차 모두 그 판결이 내려지고 집행이 완료되기까지는 상당한 시간이 소요된다. 만약 패소당사자가 판결을 자발적으로 이행하지 않는다면 강제집행을 통해 승소 당사자의 권리를 구제받도록 해야 할 것이다. 그러나 패소당사자가 소송 또는 중재가 진행되는 동안 또는 판결이 내려진 후 집행을 위한 심사가 진행되는 동안에 재산을 도피시킨다면 판결은 아무 실효성 없는 법률 문서가 되고 말 것이다. 그러므로 소송 또는 중재가 진행되는 동안에 당사자들의 지위를 보호하고 판결의 집행력을 보장하기 위하여 대부분의 국가는 법원에 보전처분 그리고 중재판정부에 임시적 처분을 내릴 수 있는 권한을 부여하고 있다. 이와 관련하여 본 논문에서는 중국이 해외 중재판정을 승인하고 집행하는 대표적인 사례인 대한 해운과 해항그룹 간의 선박 임대 계약 분쟁 사례를 예로 들어 대한해운이 외국중재판정의 승인 및 집행을 위한 심리기간 중 제기한 재산보전 신청에 있어서 중국 해구(海口) 해사법원이 허가 및 거부 결정 반복이유에 대한 분석과 외국중재판정의 승인 및 집행을 위한 심리기간 중 보전처분에 관한 연구를 진행한다. 중국이 외국중재판정의 승인 및 집행을 위한 심사 기간 중 임시 보전처분 중의 재산보전의 입법 현황과 법적 실무의 문제점을 분석하고, 이에 대한 개선책을 제시함으로써 중국에서의 외국중재판정의 승인 및 집행을 진행할 수 있도록 보장해주기 위한 것이다. 본 논문은 우선 중국이 외국중재판정의 승인 및 집행을 위한 적용 범위, 근거 등에 대해 간단히 소개하고 그 다음에 외국중재판정이 중국에서 승인되고 집행되는 기간의 임시 보전처분의 의미와 특징, 시행에 대한 법적 근거를 기술하여 중국 민사소송법 상의 임시 보전처분과 비교한 후, 마지막으로 외국중재판정의 승인 및 집행을 위한 심리기간 중 재산보전에 관한 개념 및 절차, 동의 여부에 대한 법적 근거를 제시하고자 한다. 대한해운과 해항그룹의 사례를 심층 분석하여 중국이 외국중재판정의 승인 및 집행 기간 중 재산보전제도 인정에 있는 문제점을 제시하고, 입법을 보완하는 차원에서 외국중재판정의 승인 및 집행을 위한 심리기간 중 재산보전을 신청할 경우 그와 관련된 법적 근거를 마련됨으로써 활동이 원활히 추진될 수 있도록 보완책을 제시하고자 한다.

Maritime litigation is a special kind of rules of litigation, especially the litigation jurisdiction of which is a rich and complicated subject. In the field of international maritime litigation jurisdiction, the coordination and settlements of the conflicts of jurisdiction is vital to the uniform of the international maritime law. This article, starting from the historical source of maritime litigation jurisdiction, amply introduces the conception, category and legal characteristics of maritime litigation jurisdiction, points out the conflicts and settlements of international maritime litigation jurisdiction, demonstrates the maritime litigation jurisdiction in International Conventions, European Union, China and Korea, and emphatically analyzes rules of jurisdiction clauses of bill of lading and maritime litigation jurisdiction on the ship-owner?s limitation cases which are the specific solutions on maritime litigation jurisdiction in Chinese laws; then, aiming at defects existing in maritime litigation jurisdiction of China, puts forward corresponding suggestions to improve the rules of maritime litigation jurisdiction for China. Chapter 1 Introduction. This chapter involves the objective, scope and method of the research. The objective is as follows: the rules of maritime litigation are special and important legal rules. But they are rarely referred to in international conventions and are undound in many countries including China. The author, as a judge engaging in maritime trial, decides to research maritime litigation jurisdiction rules due to his confusion of it in judicial practice. This article involves the history, conception, category and legal characteristics of maritime litigation jurisdiction, relative rules concerning jurisdiction of maritime litigation in international conventions and laws all over the world, conflicts and settlements of international maritime litigation jurisdiction and measures for improvement of jurisdiction rules of China. This article, firstly lengthways compares the internal development of rules of maritime litigation jurisdiction system and secondly breadthwise compares the maritime litigation jurisdiction rules of China with relative rules in international conventions and other countries. In addition, as a judge engaging in jurisdictional practice, the author also adopts the way of combination of theory and practice. Chapter 2 General Theory of Maritime Litigation Jurisdiction. This chapter firstly demonstrates the overview of maritime litigation jurisdiction. It introduces the definition, origin and historical development, jurisdictional scope of maritime litigation jurisdiction. Then it sets forth the category and legal characteristics of maritime litigation jurisdiction. This chapter secondly discusses maritime litigation jurisdiction involving foreign elements. It analyzes the fact basis and legislative authority of performance of maritime litigation jurisdiction involving foreign elements, the reasons for conflict of maritime litigation jurisdiction involving foreign elements and from aspects of legislation and judicature, points out the principles and ways of solving the conflict of maritime litigation jurisdiction involving foreign elements. Chapter 3 Comparative Analysis of Maritime Litigation Jurisdiction. This chapter demonstrates maritime litigation jurisdiction in International Conventions, European Union (hereinafter referred to as ?EU?), China and Korea in detail and compares with each other by combination of their own characteristics. In the rules maritime litigation jurisdiction in International Conventions, it introduces the importance of maritime litigation jurisdiction in procedural justice, International Conventions concerning legal rules of maritime litigation jurisdiction and the application of International Conventions concerning maritime litigation jurisdiction in China. In maritime jurisdiction rules of EU, it demonstrates the concept and characteristics, the legal basis and the legal meaning of research of maritime litigation jurisdiction of EU. As for the introduction of maritime litigation jurisdiction in Korea and China, it analyzes the connective elements for confirmation of domestic maritime jurisdiction by Korea and foundational principles and litigant logos of maritime jurisdiction exercised by Korea, which are all from aspect of the domestic maritime jurisdiction and maritime jurisdiction involving foreign elements, introduces the domestic structure of maritime jurisdiction in China including legal jurisdiction, jurisdiction by order, exclusive jurisdiction and agreed jurisdiction, legal basis and legal system of the maritime jurisdiction involving foreign elements. At last, it conducts a summary of comparative analysis on maritime litigation jurisdiction between International Conventions and China, between European Union and China and between Korea and China. Chapter 4 Specific Solutions on Maritime Litigation Jurisdiction in Chinese Laws??Rules of Jurisdictional Clauses of Bill of Lading and Maritime Litigation Jurisdiction on the Ship-owner?s Global Limitation Cases. This chapter, with reference to maritime litigation jurisdictional clauses of bill of lading, analyzes the characteristics of it in nomology, sets forth its effectiveness from the aspects of legal rules and formal condition and shows the comprehension and cognizance of America, Japan, Korea and China to it. In demonstration of maritime litigation jurisdiction on the ship-owner?s global limitation cases, it firstly demonstrates the legal meaning of maritime litigation jurisdiction on the ship-owner?s global limitation, maritime litigation jurisdiction on the ship-owner?s global limitation in pollution by ship and collision cases and the relationship of maritime litigation jurisdiction on the ship-owner?s global limitation and Forum Non Conveniens. Then, it analyzes the concept, origin and development, application, comment, and the judicial practice of Forum Non Conveniens in China. Chapter 5 Conclusions and Suggestions. In demonstration of conclusions, this chapter, with combination of the internal characteristics and developmental situation of maritime litigation jurisdiction, points out that the maritime litigation jurisdiction rules of China need further improvement to meet the new demands to maritime litigation jurisdiction. In demonstration of suggestions, this article advises that China should try their best to establish the rules of maritime litigation consistent with international conventions and customs and realize the uniform of maritime litigation jurisdiction through special and centralized jurisdiction to maritime litigation, respect of the agreed jurisdiction of the parties and establishment of the relative rules.

Matters on protecting the marine environment such as restricting marine pollution cannot be dealt in isolation of international law and particularly international maritime law. Moreover, in recent 20 years it has developed as an independent part of international law called as international environmental law. The subjects of this law are state responsibility in international law on international pollution, general international laws including UN Declaration on the Human Environment and general rules analogised by various international conventions on marine pollution. The main effort in developing international environmental law was international attempts on protecting the marine environment, and these attempts came into success in the 3rd Conference of the UN Convention on the Law of the Sea(UNCLOS III). Generally, the extent of international environmental law not only includes the area of protecting the marine environment but also includes protecting the national water quality on lakes or rivers, atmosphere and the outer space. Since, the sea is the terminal of all pollutions, the importance of the problem of protecting international waters has moved to problems on pollution from land-sources, and pollution from or through the atmosphere is also dealt comprehensively in the area of protection of the marine environment, it could be concluded that the most essential and practical content of international environmental law is included in the scope of international marine environmental law. Especially, the problem which cannot be overlooked in environmental protection is pollution from nuclear substances which is important in land but can be dealt by national law system while in the sea, international efforts are urgently needed to deal with this problem and the pollution's spreading effect can immediately cause serious damages world widely. Therefore, regulations of this area on environmental protection have to be included in international marine environmental law. To consider this matter in this light, international marine environmental law can be defined as a normative system which constitutes the main context in environmental law in reality which is formed of various rules, standards and procedures in international environmental law to prevent marine environmental pollution and the whole customs of restrictions and international cooperation to preserve and protect the marine environment. Such international environmental law has developed after World War II when the importance of marine environment was being emphasized and led to the modern concept of international marine environmental law. Nevertheless, this did not manage to overcome the traditional international law such as absolute state jurisdiction principle, freedom in the high seas, flag state principle in the current decentralised international society. Accordingly, environmental protection rapidly arose as a task to the whole human generation and consequently like in principle 21 of the 1972 Stockholm Declaration, each state had to introduce a new law system on taking legal responsibility on environmental damages outside its jurisdiction. The efforts on establishing a new system of international marine environmental law came to success in UNCLOS which establishes the existing declaratory and recommendatory provisions on marine environmental protection to international legal rights and obligations which became the opportunity of consolidating marine environmental protection as a new area of international law. In Particular IMO has played a major role to take root the International Marine Environmental Law over the last decades since its establishment. IMO cooperates with the MEPC as a central figure and other committees such as the MSC and the LEG to prevent marine pollution and has close relationship with IOC GESAMP, UNEP which are sub-organs of UNESCO. In addition to that, the MEPC works with member states of IMO but the working environment is quite hard since the interest of states against each other. Since IMO has long history of participating to the protection of marine environment it should be revaluated and approved as an important institution which played great roles in development of International Marine Environmental Law. IMO, therefore, would take an important part in settlement of the International Marine Environmental Law in the near future.

한국과 중국은 지리적으로 이웃하여 오랜 기간 문화교류는 물론, 무역을 통한 교역상대국으로 함께하여 왔다. 특히, 양국은 1992년 외교수립 이후 교역이 더욱 활발해졌다. 한국은 민주주의 국가로서 자본주의시장경제체제를, 중국은 사회주의 국가로서 사회주의시장경제체제라는 서로 다른 정치형태와 시장경제체제, 그리고 경제발전단계가 다름에도 불구하고 양국의 경제 및 무역에 있어 상호 보완적인 긴밀한 관계를 유지해 왔다. 한중무역에 있어 해운산업의 발전은 한국의 지리적 여건과 북한과의 대치로 인하여 육로를 통한 교역이 불가함에 따라 비교적 물류비용이 적은 해운 쪽을 선호하게 되었다. 즉, 양국 간 교역에 있어 해상운송과 항공운송만이 허용되는데, 항공운송은 비용과 물량에 있어 해상운송보다 매력적이지 못하다. 하지만, 해상운송은 운송속도나 해난사고 등의 위험이라는 특성을 안고 있다. 이러한 한중 간의 교역에 있어 해운산업도 많은 발전을 이루었지만, 여전히 법률적으로 해결하여야 할 새로운 문제들이 발생하고 있다. 중국의 해상운송과 관련한 통계자료를 살펴보면, 중국의 국제화물운송 중 가장 많이 사용되는 방식으로 화물운송이 약 60% 이상이며, 기타 화물운송에 있어 해상운송은 전체의 90% 이상을 차지하는 것으로 나타났다. 이처럼 국제무역에 있어 선박을 이용한 해상운송은 각국의 경제교류에 있어 매우 중요한 운송수단으로 되면서 해상운송과 관련한 다양한 산업이 발전하였다. 또 해상운송의 위험성을 담보하기 위한 다양한 보험상품 및 법률도 함께 발전하였다. 이처럼 국제화물운송에 있어 해상운송은 선박을 이용하기 때문에 선박이라는 특수한 동산이 매우 중요하다. 즉, 화물운송비용 및 보험료계산 등은 물론, 선박의 가치평가에 있어서도 권리문제와 관련하여 매우 중요하다. 선박은 일반 동산과는 다른 특수한 동산이기 때문에 권리부여에 있어서도 다른 제도를 가지고 있다. 이러한 문제는 주로 선박을 담보물권으로 설정한 경우, 이후 권리분쟁에 있어 어떤 권리를 우선으로 할 것인지가 문제된다. 이에 대한 학계의 논의는 오랫동안 일치된 의견 없이 첨예하게 대립하고 있다. 즉, 선박을 담보물권으로 설정 후 권리자의 권리요구와 선박의 계속적 이용에 있어 발생하는데, 이를 선박우선특권이라고 한다. 선박우선특권은 선박물권에 있어 특수한 법률제도로 고대 유럽에서 항해중인 선박저당대출제도에서 비롯되었다고 한다. 고대에는 항해기술과 선박건조기술이 현재와 달리 발달하지 못하여서 선박을 이용한 운송은 일종의 모험이며 도박이었다. 당시 선박은 주 항구에서 다른 항구로 이동할 경우 연락할 수 있는 방법이 없었기 때문에 선주(소유자)는 항해 중인 선박의 위험을 알 수가 없었다. 이에 선장은 항해로 인해 예측불가능한 위험을 맞아 필요한 자금을 조달하고 지속적인 선박의 운항을 보장하기 위해 선주를 대리하여 선박을 담보로 대출을 하여 문제를 해결하였다. 이때 자금을 빌려준 채권자들은 선박소유자의 재산 상황을 알 수 없어 불안할 수밖에 없다. 리스크가 큰 대출의 변제를 위해서 선박의 항해에 필요한 긴급 자금을 빌려준 특정한 채권자는 선박을 특정한 채권의 담보로 할 수 있는 관습이 생기게 되었다. 이러한 관습에 따르면 선박의 항해에 필요한 긴급 자금의 대출인은 선박소유자와 선박임차인의 재산 상황을 고려하지 않아도 된다. 이 관습이 시간이 지남에 따라 법제화 된 것이 선박저당대출제도이다. 선박우선특권은 해상법에서 오래된 독특한 법제도로, 국제조약에서는 ‘Maritime Lien’이라고 한다. 이 제도는 학설의 산물이 아니라, 관습법, 판례법, 제정법과 국제조약 등이 상호 영향을 주고받으며 진화하여 온 것이다. 선박우선특권은 대륙법과 영미법이라는 양대 법계 내에서 각자 발전해 왔지만, 기존의 물권제도와 어울리지 않는다. 이론과 학설이 서로 다른 입장에서 선박우선특권에 대해 해석함으로써 기존의 물권제도와 조화를 추구하고 있다. 선박우선특권제도는 채권자평등이라는 상법의 기본원칙에서 벗어나 특정한 해사채권에 대하여 저당권자 뿐만 아니라, 일반채권에 우선하는 지위를 부여하고 있다. 선박우선특권제도의 기능은 사회의 변화에 따라 점차 확충되고 강화되고 있다. 전통적인 선박우선특권이 개인 이익을 특별하게 보호하는 것이라면, 20세기의 선박우선특권은 주로 국가 및 항만의 이익을 보호한다. 이와 같이 해상법 상의 선박우선특권의 기능이 확대되면서 (1) 목적물의 종류와 범위, (2) 채권으로서 선박우선특권의 기타 채권(선박유치권, 선박저당권 등)과의 우선순위, (3) 파산절차에서 선박우선특권의 법적 지위, (4) 소멸 등이 법적 문제로 되고 있다. 하지만, 중국의 경우 현행 「중화인민공화국 해상법(中和人民共和国海商法)」(이하 「중국 해상법」)이 1992년 11월 제정 이후 약 30여 년 간 해운산업의 중요한 역할을 하여왔지만, 앞서 언급한 선박우선특권에 관하여는 여전히 명확한 법률을 마련하고 있지 않다. 이에 「중국 해상법」 상 선박우선특권에 관한 법률상의 문제를 해결하고 개선할 필요가 있다. 이러한 문제의식에 기초하여 본 연구는 총 6장으로 구성되어 있다. 제1장은 연구의 배경 및 목적과 필요성 등 연구 전반의 문제의식을 제시하고, 이를 해결하기 위한 연구방법 등을 제시하였다. 제2장은 선박우선특권에 관한 일반이론을 분석한다. 이에는 선박우선특권이 해상운송의 역사에서 발전한 기원과 발전경과를 함께 검토한다. 또 선박우선특권 및 인정채권에 대한 중국 해상법의 규정과 선박우선권채권과 기타 담보물권에 대한 중국 해상법의 규정을 분석하였다. 제3장은 선박우선특권에 대한 비교법적 분석을 진행한다. 중국은 대륙법계에 속한 국가이다. 선박우선특권의 기원과 해상운송업의 발전에 따라 중국의 해상법도 바뀌어야 한다. 구체적으로는 주요 해사국들의 국제조약, 목적물의 종류, 인정채권과 일반채권 간의 변제순위를 비교 분석해 중국 해상법의 현안을 조정해야 한다. 이러한 문제의식에 기초하여 본 장에서는 각국 및 국제협약 상의 선박우선특권의 목적물 및 인정채권의 우선변제순위 등을 비교 분석한다. 제4장은 중국 해상법에서 선박우선특권제도의 법률 문제점을 분석한다. 중국 선박우선특권이 중국 해상법 상 어떻게 발전하였는지를 검토하고, 법률 상 선박우선특권의 목적물과 인정채권의 변제순위 및 이로 인한 법적 충돌을 분석하였다. 제5장은 제4장에서 제기된 문제점에 대한 해결책을 제시하고, 주요 해사국가의 입법례뿐 아니라, 판례의 입장도 분석하였다. 중국의 실정과 맞물려 중국 특색 사회주의에 가장 적합한 방안을 찾아 그에 맞는 법률개정을 제시하였다. 제6장은 결론으로, 이상에서 논의한 중국 선박우선특권제도의 문제점과 개선방안 및 한중 간 선박우선특권제도의 통일 가능성에 대하여 서술한다. 주제어 : 선박우선특권, 해상무역법, 목적물, 인정채권, 우선순위, 해상법.
This study deals with legal aspects for the enhancement of international regulation on maritime crimes at sea. In these studies, maritime crimes at sea means piracy, armed robbery and maritime terrorism threatened marine transportation and international society. Piracy, any acts for private ends by other ships or aircraft on the high seas, could be punished by any country in accordance with the 1982 United Nation Convention Law of the Sea(UNCLOS). Armed robbery consisting of pirate acts in maritime jurisdiction of a State has occupied 64% of annual piracy statistics and occurred mostly in Southeast Asia. But there is no way to punish it appropriately by international regulation. It is hard to find the general definition of maritime terrorism. The definition of maritime terrorism given by the 1988 Convention for the Suppression of Unlawful Acts Against the Safety of Maritime Navigation(SUA Convention) consists of specifically enumerated types of crimes. Traditionally terrorism has considered acts which is the military actions of various political parties, but now the factor conducive to the development of terror can be divided into economic, cultural, ideological and motivational, and social-psychological categories. But the important definition of the terrorism is still political ends. To control maritime crimes at sea, many international organizations have been involved to do so. International Chamber of Commerce International Maritime Bureau (ICC IMB) established Piracy Reporting Center(PRC) in October 1992 in Kuala Lumpur for preventing and suppressing of piracy and armed robbery against ship. Annual report of PRC has shown two third of acts of piracy occurred by armed robbery aimed at ships in berthing or anchoring in territorial waters of State. But because a new concept, armed robbery has not been included in the definition of piracy in the 1982 UNCLOS, it has become matter of concern and International Maritime Organization(IMO) has carried out preventing and suppressing system against armed robbery. In 1993, IMO Maritime Safety Committee(MSC) issued two conclusions - Recommendations to Governments for preventing and suppressing piracy and armed robbery against ships(MSC/Circ.622) and Guidance to ship owners and ship operators, shipmasters and crews on preventing and suppressing acts of piracy and armed robbery against ships(MSC/Circ.623). And IMO has conducted regional seminars and workshops on piracy and armed robbery against ships in Brazil(20 to 22 October 1998) and Singapore(3 to 5 February 1999). Also, IMO has revised the SOLAS to impose obligation to fit the Universal Ship-borne Automatic Identification System(AIS) and force International Ship and Port Facility Security Code(ISPS Code) to companies, ships and port authorities. According as a IMO recommendation, the Asian countries adopted Tokyo Appeal and Regional Cooperation Agreement on Combating Piracy and Armed Robbery against Ships in Asia(ReCAAP) through several regional seminars and workshops on piracy and armed robbery against ships. And then UN, IMO and International Labor Organization(ILO) conduct many works to treat international terrorism at sea. The States have concentrated their efforts to maritime security by introducing AIS and ISPS Code, and reinforcing Port State Control(PSC). After 9.11 international caution has reached to a climax, the 1988 SUA Convention is revised to extend definition contained new offenses and insert boarding and search authority of the State in 2005. But there are some difficulties in controling maritime crimes at sea. First armed robbery is not included in the definition of piracy in the 1982 UNCLOS and corrupted government officials in the Southeast Asia and Africa in which a large number of attacks occur, have protected or hid piracy and armed robbery. Second, because the maritime terrorism is not a hostis humani generis like a piracy, all the States can not arrest and prosecute terrorists, and have to extradite them to the States authorized to do. Third, the extradition is not mandatory. So, some of the States protect terrorists for political aspects. Finally, the 1988 SUA Convention refers not a punishment but a prosecution. Thus there is serious worry about creating a vacuum of terrorists punishment. These days, piracy and maritime terrorism have become similar each other in respect of factors and way of preventing or suppressing them. So, the writer introduces a newly comprehensive treaty of maritime crimes at sea to regulate them efficiently. A new treaty defines corruption, piracy, armed robbery and maritime terrorism and regulates juridical management of each category to reinforce law enforcement. Corruption has to be punished by the State. Armed robbery has to be treated firstly by the State, secondly by the flag State of a ship or nationals State received serious harm to people, and lastly international organization be forming newly for charging exclusive responsibility of maritime crimes at sea, i.e. international coast guard. Piracy and maritime terrorism not covered by the States has to be defined as a hostis humani generis. It is possible for any State to seize them by its warships or military aircraft, or other ships or aircraft clearly marked and identified as being on government service and authorized to that right. Maritime terrorism covered by the State has to be treated preferentially by the State in whose waters an attack has occurred, secondly by the flag State of a ship, the State affected serious harm to national security or people, terrorists State or residence State of stateless terrorists, and lastly international organization like a international coast guard. And legal vacuum must be minimized by imposing international obligation to the States to punish criminals related safety and expressing clearly that the principle of non-extradition of political criminals does not apply to maritime crimes at sea. 본 논문은 해상안전범죄에 대한 국제법상 규제강화방안에 대해 연구하였다. 해상안전범죄라 함은 해상운송과 국제사회를 위협하고 있는 해적, 해상무장강도와 해상테러를 의미한다. 해적은 공해상에서 사적인 목적으로 다른 선박 또는 항공기를 이용한 공격을 말하며, 국제적으로 1982년 유엔해양법협약에 의해 어떠한 국가도 이들을 나포하고 처벌할 수 있도록 하고 있다. 그러나 전형적인 해적형태와는 달리연안국의 관할권내에서 정박중이거나 접안중인 선박을 대상으로 해적행위가 난무함에 따라 이들을 해상무장강도라 하고 국제적 논의대상으로 삼게 되었다. 해상무장강도는 전체 해적행위의 64%에 달하고 있으나 1982년 유엔해양법협약의 규제대상에서 제외되므로 이들을 적절히 규제할 수 있는 국제적 규제가 마련되어 있지 않다. 이와 달리 해상테러는 일반적인 정의조차 찾기 힘들다. 해상에서의 테러행위를 규제하는 1988년 항해의 안전에 대한 불법행위의 억제를 위한 협약(Convention for the Suppression of Unlawful Acts Against the Safety of Maritime Navigation: SUA협약)에서는 제3조에 규제대상이 되는 범죄의 종류를 나열하고 있을 뿐 해상테러에 대한 일반적인 정의를 내리지 못하고 있다. 전통적으로 테러는 정치적 목적을 가진 집단 혹은 개인의 공격이라고 여겨져 왔고 현재 테러를 유발하는 요인은 경제, 문화, 이데올로기, 사회심리학적 요인 등 다양성을 띠어가고 있으나 여전히 테러의 중요요소는 정치적인 목적임에 틀림없다. 해적, 해상무장강도 및 해상테러를 규제하기 위해 많은 국제기구가 앞장서고 있다. 국제상공회의소 산하 국제해사국(ICC IMB)은 해적행위 예방 및 규제를 위해 1992년 말레이시아 쿠알라룸푸르에 해적신고센타를 설치하였다. 해적신고센타는 매년 연간보고서를 발행하고 분석하는 등 해적 및 해상무장강도를 예방하고 규제하는 시스템을 수행하고 있다. 국제해사기구(International Maritime Organization: IMO) 해사안전위원회(MSC)에서는 1993년 선박에 대한 해적과 해상무장강도에 대한 예방 및 억제를 위한 정부권고안(Recommendation to Governments for preventing and suppressing piracy and armed robbery against ships: MSC/Circ.622)과 선박에 대한 해적과 해상무장강도 행위 예방 및 억제를 위한 선주, 선박회사, 선장과 승무원에 대한 지침서(Guidance to shipowners and ship operators, shipmasters and crews on preventing and suppressing acts of piracy and armed robbery against ships: MSC/Circ.623)를 마련하여 IMO회원국들이 도입토록 하였다. 또한 1998년 10월 브라질과 1999년 2월 싱가폴에서 해적 및 해상무장강도행위에 대한 처벌 및 심각성을 경고하고 이에 대응하기 위해 지역세미나와 워크샵 등을 개최하였다. 그리고 해상에서의 인명의 안전에 관한 협약(International convention for the Safety of Life at Sea: SOLAS)를 개정하여 모든 항해선박에 선박자동식별시스템(Universal Ship-borne Automatic Identification System: AIS)을 설치토록 하였고 선박회사와 선박, 항만당국에 해상보안규칙(International Ship and Port Facility Security Code: ISPS Code)를 도입하였다. 이에 따라 아시아지역에서도 수차례의 세미나와 워크샵을 통해 도쿄선언(Tokyo Appeal)을 채택하고 아시아에서의 해적과 해상무장강도 행위에 대응하는 지역협정(Regional Cooperation Agreement on Combating Piracy and Armed Robbery against Ships in Asia: ReCAAP)을 체결하였다. 해상테러에 대해서도 UN, IMO, ILO 등을 중심으로 테러방지활동이 활발하다. 연안국들은 AIS, ISPS Code, 항만국통제(PSC) 등을 통해 그들의 해상보안강화에 주력하고 있다. 9.11테러 이후 테러에 대한 국제사회의 긴장이 고조됨에 따라 2005년에는 1988년 SUA협약을 개정하여 제3조에 포함되는 테러의 정의를 확대하고 혐의선박에 대한 승선검색을 실시할 수 있도록 하였다. 그러나 현재의 국제법으로 해상안전범죄를 규제하는 것에는 많은 어려움이 있다. 첫째 해상무장강도의 개념이 해적규제협약인 1982년 유엔해양법상의 해적의 정의에 포함되지 않고, 많은 해적공격이 발생하는 동남아시아와 아프리카 지역에서는 부패한 정부관료들이 해적과 해상무장강도 공격을 조장하고 보호하기도 한다. 둘째, 해상테러는 해적과 같이 인류공동의 적으로 인정되지 않아 모든 국가가 테러범을 체포하거나 처벌을 위해 권한있는 기관에 기소를 할 권한을 갖는 것이 아니므로 관할권이 설정된 연안국에 이들을 인도해야 한다. 셋째, 이러한 범죄인 인도조항이 국제적 의무규정이 아니므로 일부 국가에서 자국의 정치적인 성향에 따라 테러범을 비호할 가능성이 크다. 마지막으로 1988년 SUA협약에서 테러범의 처벌의 의무를 명시한 것이 아니라 단순히 기소의무를 규정하고 있는 것도 테러범처벌의 공백이 발생할 우려가 크다. 여러 국제전문기관 및 전문가들이 21세기를 해양의 시대로 선포한 바와 같이 바다는 자원의 보고인 동시에 전 세계 물동량의 75%를 운반하는 생명선이기에 해적, 해상무장강도 및 해상테러는 세계무역과 해상안보의 큰 위협이다. 또한 해적 및 해상무장강도와 해상테러에 대한 국제적 대응제도나 원인 등에 공통부분이 있어 서로 유사성을 띠고 있으며 단순테러지원도 테러범과 함께 처벌하는 것이 국제적인 추세이므로 해적과 해상무장강도의 경우도 그 비호세력과 함께 규제하는 것이 효율적이다. 그러므로 해상안전범죄를 효율적으로 규제하기 위해서 해적, 해상무장강도와 그에 대한 부정부패, 그리고 해상테러를 포괄하는 하나의 협약을 제정해야 한다. 해상안전범죄에 대한 포괄적 협약에서는 각 범죄에 대한 재판관할권을 설정하여 대응공백을 최소화해야 한다. 항만관료의 부정부패는 연안국의 관할권만이 인정되는 것이 당연하다. 해상무장강도는 최우선적으로 연안국의 관할권을 인정한다. 그리고 해상무장강도에 대한 연안국의 처벌능력이 부족하거나 처벌을 회피하는 경우에는 미국의 CSI구상처럼 국제기구의 주재관이 파견되거나 양자 또는 다자간 협약이 체결된 국가에 한해 해당 국제기구 또는 협약체결국인 피해선박의 기국, 피해선원의 국적국에 2차적 관할권을 인정하여 해적소탕의지가 미약한 일부국가의 역할공백을 메우도록 해야 한다. 해적은 1982년 유엔해양법협약상의 내용을 원용하여 보편적 관할권을 인정하고 해상테러에 대해서는 발생장소를 기준으로 관할권을 달리 인정한다. 공해 및 국제항행용해협에서의 해상테러는 해적행위와 같이 보편적 관할권을 인정하여 어느 국가의 군함과 정부선박에 의해서도 나포할 수 있도록 한다. 단, 나포권을 행사할 수 있는 선박과 조건을 세분하여 나포권 남용이라는 오해가 없도록 해야 할 것이다. 그 외 연안국의 관할권내에서의 해상테러범죄는 최우선적으로 발생지국인 연안국에서 관할토록 하고 피해선박의 기국, 테러범국적국, 피해자국적국, 무국적자인 경우 테러범상주국 순으로 관할권을 인정하여 편의치적제도나 테러지원국에 의해 야기되는 관할의 공백을 최소화해야 한다. 그리고 범죄인 인도와 관련하여 ‘기소 또는 인도’의 원칙을 ‘처벌 또는 인도’로 강화하여 범죄인을 인도하지 않을 경우 당사국에서 형사처벌을 해야 하는 의무를 부과하고, 해상테러범은 정치범불인도의 예외임을 명확히 명시해야 한다. 또한 국가간의 처벌법규의 상이함에서 오는 불합리한 점을 없애기 위해 테러범처벌에 대한 국내법의 모델을 제시하고 권고해야 한다. 그리고 국제해양경찰기구와 같은 전담기구를 창설하여 해적, 해상무장강도 및 해상테러를 포함한 해상안전범죄를 최종적으로 관할토록 하여 해상안전범죄를 규제하는데 일말의 공백이 없도록 해야 한다.

Regarding the purpose of the Ships Act of Korean, it is stipulated in article 1 that the first is relating to the nationality of ships, measurement and registration of tonnage of ships and the second is ship registration system, and the last is to maintain the maritime order, protect the interests of the state and contribute to the improvement of the national economy. However, the main purpose of the Ships Act of Korean is to require ship registration and registration as a necessary condition to issue a ship nationality certificate in order to establish the legal definition of ship and to establish the rights and obligations as a Korean ship. In this way, Korea's ship registration system consists of ship registration and registration. Ship registration is a private act in the civil law, and it has the effect of disclosing the private rights relation to the ship. Registration is an administrative act to the government. As a result of which, Korea's ship registration system is divided into legal registration and registration in government, and legal regulating it are scattered not only in maritime law but also in ship registration law, real estate registration law, and international ship registration law. Under the above circumstance, the ship registration system is divided into legal registration or registration in government according to the size or use of the ship, causing confusion to the interested parties about the ship. However, these different registration come from hindering speed trading of vessels and consuming additional costs, and resulting in unnecessary economic waste. There are some countries such as the United States, the United Kingdom, and the Netherlands, which are executing a single registration system for the administrative convenience of each country, and but some countries such as Japan and France, which have implemented dual systems like as Korea. This is because the ship disclosure system is a legal policy issue. This paper is composed of 5 chapters in total. Chapter 1 describes the background and purpose of the study, its content and method of research. In Chapter 2, We analyzed the purpose and history of the Ship Act of Korean, the definition of the ship in this article, and the definition of the ship in the other maritime regulations. We also examined the registration system of automobile, construction machinery and aircraft saw. In Chapter 3, Supreme Court Decision 2014 d 21410 Decision 2015 March 12, 2015, the relevance to ship registration system and implications were examined. In Chapter 4, the problem of ship disclosure system in the current ship law is found out by looking at the foreign ship disclosure system, and suggested ways to improve the ship disclosure system. Finally, Chapter 5 summarizes the previous review and describes the problem of the ship disclosure system in the current ship law and the necessity of improvement plan. Finally, we review the issues related to the dualization of ship registration system in the Ships Act, and analysis the registration system of automobiles, construction machinery and aircraft, and comment on the decision of the Supreme Court Dec 31. And finally to suggest ways to improve the registration system of Ship Act through the above foreign countries registration system.

선박가압류는 세계적인 법률문제이다. 선박가압류의 법률관계를 조정하기 위하여 세계 주요 해운국은 자체의 선박가압류법률제도를 구축하였으며, 국제적으로는 각국의 선박가압류제도를 통일하기 위하여 1952년 선박가압류국제협약과 1999년 선박가압류국제협약이 채택되었다. 중국과 한국은 중요한 무역 및 해운대국으로 각자 특색의 선박가압류제도를 구축하고 있는데 최근 양국간 경제무역의 급증으로 선박가압류사례가 급증하는 추세를 보이고 있다. 이러한 배경하에서 본 논문은 중국 선박가압류 법률제도 기준으로, 선박가압류국제협약 및 한국법과의 비교를 통하여 선박가압류의 법률문제를 연구 분석함으로써 관련규정과 제도의 공통점과 차이점을 지적하고 입법적 개선방향을 제시하고자 한다. 본 논문은 소정의 목적을 달성하기 위해 비교법학적 방법, 법학이론과 법률실무적 관점, 실체법과 절차법의 결합의 방법 및 역사적 분석방법을 이용하였다. 본 논문은 다음과 같이 구성되었다. 제1장은 서론으로서 연구목적, 범위 및 방법에 대하여 언급하였다. 제2장에서는 선박가압류와 연관되는 기본개념, 즉 선박과 선박가압류의 개념, 선박가압류의 성격과 작용, 선박가압류제도의 역사발전에 대해 중점적으로 소개 및 분석하였다. 제3장에서는 선박가압류의 두 가지 기본조건, 즉 선박가압류를 할 수 있는 채권과 가압류를 할 수 있는 선박에 대하여 비교분석하였다. 제4장에서는 선박가압류절차 즉 선박가압류의 관할권, 선박가압류의 청구와 법원의 결정, 선박가압류의 집행, 선박가압류의 해제 및 가압류선박의 경매방식과 채무상환문제를 중점적으로 비교 분석하였다. 제5장에서는 선박가압류와 연관되는 두 가지 특수문제 즉 선박가압류의 착오 혹은 부당한 선박가압류에 따른 책임과 선박가압류 청구를 위한 담보와 선박가압류 해제를 위한 담보문제에 대해 비교분석하였다. 제6장은 결론 부분이다. 중국의 선박가압류제도는 대륙법계와 영미법계의 선박가압류제도를 통합하고 동시에 선박가압류에 관한 국제협약을 참조하여 제정한 것이다. 한국의 선박가압류제도는 영미법계와 달리 대륙법계의 가압류제도와 매우 유사하다. 중국의 船舶가압류제도는 한국의 선박가압류제도와 비교하면 주로 다음과 같은 점에서 차이점을 찾을 수 있다. 첫째, 중국에서는 해사특별소송법으로 선박가압류에 관한 법률관계를 규율하고 선박가압류에 관한 사건을 다루는 해사특별법원이 있지만 한국에서는 보통법(민사집행법)으로 선박가압류에 관한 법률관계를 규율하고 일반 법원에서 선박가압류사건을 처리한다. 둘째, 중국에서는 영미법계의 ?대물소송?(action in rem) 제도를 참조하는데 한국에서는 ?대물소송?제도를 배척하고 있다. 셋째, 중국에서는 선박가압류를 신청할 수 있는 채권은 해사채권만 한하는데 한국에서는 특별한 제한을 두고 있지 않다. 넷째, 중국법에 있어서는 가압류할 수 있는 선박을 특정선박과 자매선으로 나누고 있으나 한국에서는 이와 같은 규정이 없다. 다섯째, 항해준비완료 선박에 대하여 중국법에서는 가압류할 수 있지만 한국에서는 가압류할 수 없다. 여섯째, 선박에 대하여 가압류를 한 법원이 당해 사건에 대하여 관할권이 있으나 한국에서는 가압류한 법원에 대하여 관할권을 부여하지 않고 있다. 마지막으로는 선박가압류에 관한 절차 및 방법에 있어서도 많은 차이가 있다. 중국 선박가압류제도는 다음과 같이 보완하여야 된다고 생각한다. 첫째, 선박가압류에 관한 국제협약을 그대로 수용하는 것이 아니고 중국 실정을 고려하여 수정해서 받아드려야 한다. 둘째, 선박을 가압류할 수 있는 채권의 범위를 적당히 확대하여야 한다. 셋째, 가압류된 선박이 경매된 경우에 당해 선박에 관한 채권에 대하여 변제할 때에 가압류를 신청한 자의 채권에 대하여 특별한 보호를 하여야 한다. 넷째, 선박을 해방하기 위하여 채무자가 선박의 가액을 초과하지 않는 범위에서 담보를 제공하여야 한다는 것은 부당하므로 관련 채권의 액수만큼 담보하여야 한다. 그리고 한국의 선박가압류제도도 국제협약과 중국의 선박가압류제도를 참조하여 다음과 같이 개정하는 것이 바람직하다. 첫째, 선박가압류의 복잡성과 전문성을 고려해서 따로 가압류에 관한 법률을 제정하거나 전문적인 지식을 갖춘 판사로 하여금 이러한 社건을 처리하게 해야 한다. 둘째, 영미법계의 대물소송에 관한 합리적인 부분을 흡수하여야 한다. 셋째, 항해준비완료 선박에 대한 가압류금지 규정을 삭제하여야 한다. 넷째, 선박을 가압류한 법원에 대하여 관할권을 부여하여야 한다.
