미국의 TPP 가입철회에 따른 동아시아 주변 국가 영향 분석 : 영국의 유럽연합탈퇴와 주변국가 영향 사례

2017년 1월, 도널드 트럼프 미국 대통령이 다자 간 무역협정인 환태평양경제동반자협정(TPP) 탈퇴를 공식으로 선언했다. TPP는 미국과 일본이 주도하고 캐나다, 멕시코, 칠레, 페루, 싱가포르, 말레이시아, 브루나이, 베트남, 호주, 뉴질랜드가 참여한 아시아태평양 지역의 다자간 무역협정으로, 아시아태평양을 중심으로 한 자유무역의 상징과 같은 협정이다. 유럽연합 회원국들 중 경제적, 정치적으로 큰 영향을 미치고 있었던 국가들 중 하나인 영국이 유럽연합의 탈퇴를 결정함에 따라, 최근, 유럽연합의 다른 회원국들로의 투자가 집중되고 있는 현상을 찾아 볼 수 있다. 영국을 바탕으로 하여 비즈니스를 이어가던 영국내의 수많은 다국적기업들이 브렉시트에 따른 영국의 정치적, 경제적 요인으로부터 발생되는 시장 불안정성을 이유로 주변의 유럽연합 회원국으로 이전하는 움직임을 보이면서 주변 회원국들의 부동산 투자가 이어지고, 이에 따른 영향으로 영국 주변의 유럽연합 회원국들에서는 최근 부동산 버블 혹은 경제 버블 현상이 시작되었다고 분석되어지고 있다. 영국이 유럽연합을 탈퇴함에 따라 주변의 유럽연합회원국들에게 미치는 영향이 정치, 경제, 사회적으로 발생되어지기 시작했는데, 단기적으로는 다국적기업들의 투자 안정성을 이유로 영국의 주변국으로 투자를 옮겨가는 현상이 발생되어지면서 긍정적인 영향이 있을 것으로 분석되어지고 있지만, 장기적 관점에서는 함께하던 공동체에서 경제성장의 원동력이 되는 굵직한 회원국이 탈퇴함에 따라 기타 회원국들의 부담이 가중되어질 것이라는 부정적인 분석도 함께 보여지고 있다. 영국의 유럽연합 탈퇴처럼, TPP의 미국 가입철회에 따라서 마찬가지로 TPP에 가입 희망 의지를 보인 국가들이 단기적으로는 영향이 미미하거나 부정적인 영향은 없을것이라는 분석을 내놓았지만, 장기적 관점에서는 수출시장으로써 가장 큰 이점을 지닌 국가의 가입철회로 인하여 타 국가로부터의 투자가 불확실해지는 상황에 직면하게 되면서 국가의 경제성장발전계획등에 차질은 불가피할 것으로 보여진다. 본 논문에서는 TPP 가입 국가들 중 동아시아 국가들을 중심으로 미국의 TPP 가입철회가 미치는 영향에 대해서 살펴보고, 특히 투자분야의 변화를 분석해보고자 한다. 이를 위해 영국의 유럽연합 탈퇴와 미국이 TPP 가입철회에 관련한 정부기관들의 보고서들을 중심으로 문헌분석을 통하여 살펴보고, 실제 TPP 가입국가의 영향에 대하여 사례를 통해 시사점을 찾아보고자 한다. The main purpose of this article is to analyze the influence of Asian countries on the TPP withdrawal of the United States. With this aim, it has chosen the Foreign Direct Investment issue in Asian countries. The author argues that UK, one of the most influential countries in the European Union has led to a positive and negative impact to neighboring countries of European Union. Likewise, the withdrawal of the US from TPP, is expected to have a positive and negative impact on the other TPP member countries. As Britain withdrew from the European Union, its influence on neighboring European Union countries began to occur varios of problems politically, economically and socially. In the short term, it is analyzed that there will be a positive effect as the investment is shifted to the neighboring countries from the United Kingdom because of the investment stability of the multinational corporations. However, in the long term, there is a negative analysis that the other member countries’s burden wil be increased because of the withdrawal of a major member state which is the driving force of economic growth in the community. As the withdrawal of the United Kindom from the European Union, United States’s withdrawal from TPP is analyzed that countries that have shown their willingness to join the TPP will have negative impact in the short term. However, in the long term, it will have a negative impact on the naional economic development plan as the investment from other countries becomes uncertain due to the withdrawal of the country with the greatest advantage as an export market.
Problem und Aussichten für die Gründung der Ostasiatischen Wirtschaftsgemeinschaft

세계 경제는 3대 축으로 즉, EU, NAFTA와 아세아권 경제 등으로 구분되는데, 전자 는 선진국을 중심으로 오랜 기간 동안 점진적으로 통합되고 발전되어 온 공동체임에 비 하여 아시아에서는 경제 통합의 필요성은 인정되지만 그 청사진에 대해서는 여전히 모 호한 상태에 있다. 최근 세계화의 물결 속에서 유럽과 미국을 중심으로 하는 공동체를 아시아 영역까지 끌어들이고 있는 움직임이 APEC과 ASEM 등의 형태로 나타나고 있지 만 이는 열강들이 아시아에 대한 필요성에 의해 나타나는 것으로 풀이된다. 그러나 선진국의 경제통합 노력은 아시아인들에 의한 공동체의 생성에 자극제가 될 뿐만 아니라 그 필요성을 점차 인식되게 한다. 동남아시아에서는 1960년대 중반 동남아 국가연합(ASEAN)이 성립, 확대되어 정치, 안보에서 경제 협력으로까지의 발전을 거듭 함에 따라 동아시아 공동체가 태동되었다. 1990년대에 이르러서 동북아시아의 3국인 한, 중, 일이 이에 가세함으로써 동아시아의 협력체가 싹트고 있다. 이것은1997년 아시 아의 외환위기를 기점으로 그 속도가 가속화되고있다. 그러나 동아시아의 공동체의 형성의 주도권 문제에 있어서는 일본과 중국이 동북아의 핵심국가로서 경제에서 정치로 옮겨가면서 그 패권적인 역할을 누가 선도하느냐따라 그 향방이 결정된다. 최근 중국과 말레이시아가 주도하는 동아시아 정상회담(EAS)의 말레 이시아 쿠알라룸푸르 선언이 태동된 이후 여기에는 미국을 배제한 아세안 + 3 + 인도, 호주, 뉴질랜드 등의 16개국과 러시아가 참관인 자격으로 참가했다. 이에 따라 앞으로 역내에는 중국을 중심으로 하는 체제가 구축될 것으로 보인다. 이에 비해서 일본이 중심 이 되는 아시아의 경제동맹(EPA)을 구체화시킴으로써 여기에는 미국, 호주 등의 해양세 력의 지원 하에 가속화하고 있다. 여기에는 경제협력 이외에도 에너지, 무역, 자본, 금융 협력 등의 물질적인 교류 이외에도 역내의 제도, 규범, 법 등도 글로벌 스탠다드에 맞춰 나가려는 노력이 부각되고 있지만 이는 결국 동아시아의 헤게모니를 장악하려는 대륙과 해양세력간의 군사적인 준비까지 포함되는 내용으로 내다 볼 수 있다. 이러한 역내의 두가지 흐름은 오랜 시간 동안 아시아에서 예견된 것이기 때문에 그 귀추가 주목되는 것 이 현실이다. 우리나라의 경우 동북아의 경제 중심이라는 구호만으로는 자칫 주변국들과의 마찰만 불러 일으키고 내실은 기하지 못하는 우를 범할 수 있다. 따라서 우선 군사적으로 대륙 과 해양 세력의 중립적인 입장을 취하면서도 그 중심이 되려고 하기 보다는 한, 미 공조 체제 위에서 우리 나아갈 길을 찾아야 한다. 또한 한국경제의 세계화를 위해서는 선진국 과의 FTA를 추진하는 방향으로 나아가야 하기 때문에 이에 대한 안목을 갖추고 우리 경제의 경쟁력을 제고시키는 실질적인 대안을 마련해야 할 것이다. 물론 이에는 남북문 제의 평화적인 해결이 전제되어야 하겠으며, 이는 궁극적으로는 동아시아의 경제공동체 의 형성에도 도움이 될 것이다.

20세기 후반기 동북아시아 질서는 2차 대전 후 일본 국력의 급속한 신장, 한국과 같은 신흥공업국의 출현, 중국과 같은 미래의 초강대국의 출현으로 특징지어 진다. 이는 세계화의 성과이며 또한 이들 국가에 내재된 발전의 힘의 결과이기도 하다. 이 논문의 문제제기는 동북아시아에서 지역 열강의 위계질서가 어떻게 설정될 것 이며 이 경우 한국을 중간단계의 국가로 설정한다면 이 지역 나아가 세계 질서에서 중국과 일본을 어떻게 재설정해야 할 것인가 이다. 이 문제에 대한 답을 줄 수 있는 여러 요소들이 있다. 그 중 첫째가 에너지 수급 문제이다. 산업발전에 에너지 수급을 필수 불가결한 문제이기 때문이다. 일본은 에너지 문제에서 부존자원의 부족의 문제를 항상 겪어 왔고 현재 에너지 수입이 일본의 대외수입에서 큰 비중을 차지하고 있다. 때문에 핵 발전을 이용한 전 기생산이 일본에서는 대단히 중요하게 될 수밖에 없었다. 중국의 경우는 문제가 다르다. 중국은 모든 종류의 에너지 자원을 보유하고 있다. 지금까지 중국은 석탄에너지에 의존해 왔으나 1980년대부터 비롯된 산업화는 전기 와 석유 소비의 급격한 증가를 불러왔다. 또한 삽협댐을 비롯한 대형 댐들이 중국에 서 건설되었다. 석유와 가스자원은 아직 국내생산이 충분하지 않기에 이 분야의 에 너지 수입이 대외수입에서 중요한 비중을 차지하고 있다. 때문에 중국 석유회사들 (SINOPEC, PETROCHINA, CNOOC)의 해외진출과 투자가 급속하게 이루어지고 있다. 중국에서 핵 발전은 서구기업에 큰 규모의 시장을 제공하고 있으며 이를 통해 중국은 의존 에너지 자원의 다변화를 꾀하고 있다. 산업화에 관련한 자금조달에 관련해서, 중국은 2002년 세계 최대의 FDI 유치국가 가 되었다. 중국에 투자된 총 자금의 20%가 해외에서 조달된 자금이다. 1/3은 서방 국가와 일본에서 온 것이며, 1/3은 해외거주 화교들로부터 온 것이며, 나머지 1/3은 중국의 자금이 홍콩을 경우하여 중국에 재 투자된 것이다. 이점에서 비 중국계 외국자금의 중국내 투자비율은 전체 투자대비 1/5에 불과하 다. 중국내 산업 생산에서 외국기업의 비중은 크지 않으며 이 역시 금속과 전자산업 에 편중되어 있다. 국내저축과 무역흑자는 FDI와 더불어 중국의 산업화 자금 조달에 중요한 부분을 차지한다. 무역흑자는 일본의 자본축적에서도 중요한 역할을 하였다. 세계경제에서 동북아시아의 비중이, 이 지역 국가의 높은 경제성장에 힘입어, 확 대되고 있다. 20-30년간에 걸친 고성장이 일본, 한국에서 이루어졌고, 현재 중국에서 진행되고 있다. 일본기업은 미국기업에 비해 산업의 해외이전과 산업의 해외투자에서 뒤져있다. 중국의 경우는 어떠한가? 중국의 해외투자는 최근의 일이다. 일본이 해외에 지사 를 설치하는 것에 주력을 했다면, 중국은 외국기업과 합작 협력에 힘을 기울임과 동 시에, 정치적 지원에 힘입어, 해외 진출을 꾀하고 있다. 현재 중국에 많은 장애물이 존재하기는 하지만 중국은 아시아 지역에서 일본과 경쟁관계가 될 것이며 세계시장에서 다른 선진국과 경쟁하게 될 것이다.
A British Company in British India before 1945 : The Case of J. & P. Coats

본 논문은 영국의 선구적 다국적기업인 면사제조업체 제이 앤 피 코우츠(J. & P. Coats)가 1945년 이전 인도에서 어떤 기업활동을 하였는지를 고찰한다. 17세기 초 영국동인도회사(East India Company)가 인도의 동쪽 및 서쪽 해안에서 무역을 시작하면서 영국은 인도에 대한 영향력을 행사하기 시작하였으며, 18세기 중엽 이후 지배 지역을 본격적으로 확장하 였다. 19세기 중엽부터는 동인도회사를 대신해서 영국왕실에서 직접 통치하였다. 영국이 지배하는 지역 은 브리티시 인디아(British India)로 불리었으며, 20세기 초에는 전 인도 면적의 절반 이상, 그리고 전 인도 인구의 3/4 이상을 차지하였다. 버마(Burma) 또한 브리티시 인디아의 일부였다. J. & P. Coats는 19세기 후반부터 근동(Near East)에서 극동(Far East)에 이르는 약 19개의 아시아 국가 또는 지역에 다양한 면사제품을 수출하였다. 수출 대상 국가 또는 지역은 다음과 같다: 터키 (Turkey), 아라비아(Arabia), 시리아(Syria), 페르시아(Persia), 브리시티 인디아(British India), 버마 (Burma), 실론(Ceylon), 코친 차이나(Cochin China), 더치 인디즈(Dutch Indies), 사이암(Siam), 스트레 이트 세틀먼츠(Strait Settlements), 브리티시 보르네오(British Borneo), 더치 인디즈 브로네오(Dutch Indies Borneo), 호주(Australia), 뉴질랜드(New Zealand), 필리핀(Philippines), 중국(China), 일본 (Japan), 그리고 한국(Korea). 브리티시 인디아는 1920년대까지 호주, 중국 및 일본에 버금가는 큰 수출 시장이었다. 1908년까지는 브리티시 인디아가 호주, 중국 및 일본 다음의 네 번째 수출시장이었으며, 1909년부터는 일본을 추월하 여 세 번째 수출시장이 되었다. 또 1916년에는 중국을 한 때 추월하기도 하였다. 브리티시 인디아에 대 한 수출금액은 1920년에 첫 번째 절정에 달하였으며, 이후 감소하였다가 다시 증가하여 1925년에 두 번 째 절정에 이르렀다. 1920년대 후반에는 다시 감소하는 추세를 보였다. 1915년부터는 인도 전역을 중부 (Central), 동부(Eastern), 서부(Western) 등 세 구역으로 나누어 보다 효율적으로 판매를 관리하였는데, 각 지역의 거점 도시인 수도 델리(Delhi), 캘커타(Calcutta) 및 봄베이(Bombay)에는 물류기지가 설치되 었다. 버마에 대해서는 이들과는 별도로 수출금액이 기록되었다. 인도의 인구는 1901년 2억 4천 만 명이던 것이 1951년까지는 3억 2천 만 명으로 1/3 가량 증가하였다. 이에 따라, 필수품인 의류에 대한 수요가 증가하였고, 의류의 중간 재료로 사용되는 면사에 대한 수요 또한 꾸준히 증가하였다. 하지만, 면사 수요에 영향을 미치는 또 다른 두 요인인 1인당 국민소득과 면방 직공업 발달 정도는 고무적이지 못하였으며, 이에 따라 코우츠의 면사 판매 또한 순조롭지는 못하였다. 이러한 어려움에도 불구하고, 인구 크기 자체가 매우 크다는 점 그리고 영국의 오랜 식민지로서 다른 아시아 국가들에 비해 상대적으로 안정적인 시장이라는 점 때문에, J. & P. Coats는 인도시장을 지속적 으로 공략하였으며 결국 1930대 말과 1940년대 초에 제조시설을 확보하기에 이르렀다. 먼저, 1938년 수 도 델리에 소규모 제조공장을 확보하였다. 인도시장은 1930년대 후반 들어 보다 경쟁이 치열해졌으며 이 에 따라 J. & P. Coats는 1937년 11월 현지생산을 하기로 최종 결정하였다. 공장 규모는 소규모로 하고 인도 현지 방식에 따라 영국에서 수입하는 반제품을 완제품으로 가공하도록 하였다. 이 공장은 1938년 7 월까지는 완공되어 가동에 들어갔으며, 처음에는 Ball Sewings Factory로, 그리고 이후에는 Jumna Thread Mill로 불리었다. 이어, 1942년에는 봄베이에 중간재인 튜브(tube)를 제조하는 공장을 짓기로 결 정하고 델리 공장과 보조를 맞추면서 운영하기로 하였다. 또, 같은 해 인도에서 생산되는 모든 제품을 관리하기 위해 델리에 현지 자회사(Jumna Thread Mills Limited)를 설립하기로 하였다. 이 회사는 공칭 자본금은 2백만 루피(rupees)였으며, 초기 납입자본금은 1/4인 50만 루피였다. J. & P. Coats는 인도의 현지 제조시설에 대한 후속 투자를 계속하고 경영진을 지속적으로 보강하였으며, 1947년 인도가 영국에 서 독립된 이후 보다 활발하게 기업활동을 전개하였다. 본 논문은 기업 내부문서를 바탕으로 영국의 주요 다국적기업인 J. & P. Coats가 인도에서 어떤 기업 활동을 하였는지를 학계 최초로 고찰하였다. 또 본 논문은 인도에 진출했던 제조 관련 영국다국적기업들 중 최초의 사례연구이기도 하다. 하지만 자료의 제약으로 기업활동의 구체적인 모습을 제대로 밝히기에 는 어려움이 있었으며, 앞으로 보다 다양한 내부문서를 발굴함으로써 이러한 제약이 극복될 수 있을 것 으로 기대된다. J. & P. Coats의 인도 진출 사례는 1945년 이전 J. & P. Coats가 생산 또는 판매를 위해 직접투자를 한 아시아의 다른 국가들 즉 일본(만주와 한국 포함), 중국 및 호주에서의 사례와는 다른 귀 중한 경험이었으며, 이들 4개국에서의 사례들을 비교, 분석하여 J. & P. Coats의 아시아에서의 기업활동 을 재구성하면서 인도에서의 경험을 재조명하는 작업이 필요할 것으로 생각된다. 또, J. & P. Coats의 인도 진출 사례는 1945년 이전 인도에 진출한 영국 주요기업들의 활동 내용을 밝히는데 주요 비교 대상 으로 활용될 수 있을 것으로 기대된다. 당시 인도에는 다양한 산업에 종사하는 50여 개의 영국 자회사들 이 있은 것으로 파악되고 있지만, 이들에 관한 정보는 거의 없거나 매우 제약적인 상황이다. This paper attempted to construct a general true picture of how J. & P. Coats, the British leading multinational enterprise manufacturing cotton thread, did business in British India before 1945. From the late 19th century, J. & P. Coats had exported, through its British selling arm, the Central Agency Ltd., its products to some 19 countries and regions, from Near East to Far East, throughout Asia: Turkey, Arabia, Syria, Persia, British India, Burma, Ceylon, Cochin China, Dutch Indies, Siam, Straits Settlements, British Borneo, Dutch Indies Borneo, Australia, New Zealand, Philippines, China, Japan and Korea. British India was the fourth largest market, following Australia, Chinaand Japan, for British-made Coats’s thread until 1908. However, in 1909, the export to British India surpassed that to Japan, where Coats’s thread began to be locally produced in 1907, and, in 1916, had once surpassed that to China. The export to British India reached a first peak in 1920 and, after a period of fluctuation, a second peak in 1925, having gradually decreasing in the second half of the 1920s. A first foreign direct investment by J. & P. Coats in Asia was implemented in Japan in 1907 and, by 1942, a total of 10 investments, for both sale and manufacture, occurred for the six Asian markets – Japan (3 investments), Manchukuo (1), Korea (1), Australia (1), China (1), and British India (3). By the first half of the 1930s, the British Indian market had been served by J. & P. Coats from three bases, Delhi in the north, Bombay in the west, and Calcutta in the east, which were locally supervised by British employees of the Central Agency Limited, the British selling subsidiary of J. & P. Coats. In the second half of the 1930s, the market of British India appears to have become more and more competitive and, thus, in late 1937, it was decided to set up a small factory in Delhi on the Indian model to undertake winding, ticketing etc. of twisted thread imported from Britain. By the middle of 1938, the factory, known as first the Ball Sewings Factory and then Jumna Thread Mill, had been completed and duly in operation. And, in early 1942, two important developments took place. First, it was decided to install in Bombay a plant to produce tube requirements for all India and the new plant was to be run on the lines of Jumna Thread Mill in Delhi. And, second, more importantly, it was decided to form a company, to be known as Jumna Thread Mills Limited, to handle all goods of local production. The company was to operate for its own account, while its production was to be sold by the Central Agency Limited. The authorized capital was to be 2 million Rupees, of which one fourths, 0.5 million Rupees, would be issued. This paper attempted, for the first time on the basis of the company’s internal materials, to reveal the ways in which J. & P. Coats, the leading British multinational enterprise, did business in India. Also, the paper appears to be a first detailed case study of ‘British multinational enterprises in India before 1945’. To that extent, this paper will, it is hoped, contribute to the two related studies of J. & P. Coats on one hand and the British multinational enterprises on the other before 1945. More detailed analysis is required with regard to J. & P. Coats in not only British India but also the three other countries, Australia, China, and Japan together with its colonies, Manchukuo and Korea. Then, the case studies of the individual countries could naturally lead to a more satisfactory and concrete picture of J. &P. Coats’s involvement in the Asian markets. This paper was a preliminary analysis of the subject and will be surely revised and enlarged to address more fully the origins, performance and management of ‘J. & P. Coats both in British India and in Asia before 1945’. Meanwhile, it has been suggested that, in India before 1945, some 52 subsidiaries of British multinational enterprises had been established in a variety of industries such as chemicals, processed foods, pharmaceuticals, paints, and varnishes. However, details of what these local subsidiaries looked like and how they did business have yet to be subject to research. It is expected that this paper on J. & P. Coats will a useful case study for future studies of other British multinational enterprises in India before 1945.
A British Business in Australia before World War II : J. & P. Coats, Cotton Thread Manufacturers

본 논문은 영국의 선구적인 다국적기업인 면사(綿絲)제조업체 제이 앤 피 코우츠(J. & P. Coats)가 1945년 세계 2차 대전이 끝나기 이전까지 호주에서 어떤 기업활동을 하였는지를 고찰한다. 모두 5개 장으로 구성되어 있다. 제 Ⅰ장(머리말)에서는 J. & P. Coats가 1914년 세계1차대전 발발 이 전까지 영국의 대표적인 다국적기업으로 성장하였고 그 이후에 더욱 활발하게 수출 및 해외직접투자를 수행하였음을 소개한 뒤 아시아와 호주에는 어떻게 진출하게 되었는지를 살펴봄으로써 본 연구의 의의 를 제시한다. 제 Ⅱ장(호주의 주요 경제지표)에서는 우선 호주가 18세기 말 영국의 식민지가 된 이후의 역사를 간략하게 정리하며, 이어 면사의 판매에 영향을 미친 것으로 간주되는 주요 요인들 즉 국내 총생 산(GDP), 인구, 1인당 GDP, 면방직공업의 발달 정도 등의 추이를 살펴본다. 제 Ⅲ장과 제Ⅳ장은 회사내 부자료에 근거하여 J. & P. Coats가 호주시장에 어떻게 진출하여 어떤 활동을 하였고 그 결과 어떤 성과 를 올렸는지를 논의한다. 제 Ⅲ장(Coats 면사의 수출)에서는 1898년 이후 1928년까지 아시아 국가 중에서 는 호주에 가장 많은 영국산 면사가 수출되었음을 소개한 뒤 호주에 대한 전체 수출금액 및 주요 4개 지 역별 수출금액의 추이를 비교, 분석한다. 제 Ⅳ장(호주시장에 대한 J. & P. Coats의 점진적인 공략)에서 는 J. & P. Coats 영국 본사의 이사회에서 논의되거나 결정된 내용을 중심으로 J. & P. Coats가 호주에 시간의 흐름에 따라 어떤 전략을 구사하면서 단계적으로 수출을 하고 해외직접투자를 수행하게 되었는 지를 고찰한다. 제 Ⅴ장(결론)에서는 앞의 논의를 정리하면서, 본 연구의 시사점 및 한계를 제시한다. 본 연구의 주요 내용은 다음과 같다. 1830년 설립 직후부터 J. & P. Coats는 당시 신흥경제대국으로 부 상하고 있던 미국에 집중적으로 수출하였으며, 1869년에는 회사 역사상 처음으로 미국에 해외직접투자를 하여 생산시설을 확보하였다. 이후 J. & P. Coats는 수출과 병행하여 직접투자를 적극 추진하였으며, 그 결과 1914년 세계1차대전 발발 이전까지 총 53회의 신규 투자를 4개 대륙(유럽, 북아메리카, 라틴아메리 카, 아시아) 15개 국가에서 수행하여 광범위한 제조 및 판매 네트워크를 구축하였다. 이로써 J. & P. Coats는 영국 최대의 다국적기업으로 부상하였다. 아시아에서는 오랫동안 19개 국가 또는 지역에 수출을 하였으며, 이들 중 호주, 중국, 인도 및 일본이 주요 시장이었다. 이들 4개국과 다른 2개 국가에 대해서는 1907년과 1942년 사이에 차례로 제조 또는 판매를 위한 직접투자가 진행되었다. 일본에 가장 많은 3회의 신규 투자가 이루어졌고, 이와 더불어 일본의 식민지인 한국과 만주에도 각각 1회씩의 투자가 행해졌다. 또 호주에 1회, 중국에 1회, 그리고 인도에 3회의 투자가 신규로 진행되었다. 호주는 18세기 말부터 20세 기 초까지 영국의 식민지였으며, 인구는 상대적으로 적었지만 대부분이 영국이민자와 그 후손들이었다. 그런 만큼 호주는 J. & P. Coats에게는 안정적인 수출대상지역이었다. 실제로 호주는 1920년대까지 아시 아 국가 중 영국에서 만든 Coats 면사를 가장 많이 수입하는 국가였으며, 중국, 인도, 일본 등의 인구대국 보다도 더 많은 영국산 면사가 판매되었다. 수출을 하는 한편으로 J. & P. Coats는 호주에 현지 생산시설을 확보하려고 노력하였으며, 특히 1920 년대 후반에서 1930년대 초반에 공장 설립 또는 현지 업체 인수를 위한 다양한 방안들이 모색되었다. 하 지만 결국 현지생산을 위한 직접투자는 수행되지 않았다. 상대적으로 인구가 적어 수요가 제한적이라는 점, 그리고 섬유업 및 관련 산업이 제대로 발달되어 있지 못한 점 등이 주된 원인이었다. 대신 J. & P. Coats는 이전부터 해 오던 수출에 더욱 주력하기로 방침을 정하였다. 이를 위해 호주시장을 전담하는 판 매자회사를 1929년 영국에 설립하였으며, 시드니(Sydney), 멜버른(Melbourne), 아델라이드(Adelaide), 퍼스(Perth) 등 호주의 주요 대도시에 물류기지를 건설하였다. This paper explores the ways in which, J. & P. Coats, the leading Brutish multinational enterprise manufacturing cotton thread, did business in Asia in general and in Australia in particular before the end of the Second World War in 1945. The paper consists of five chapters. Chapter Ⅰ (Introduction) introduces how J. &. P. Coats had grown into a representative British multinational company by the outbreak of the First World War in 1914 and, thereafter, how the company had pursued more actively the policies of both export and foreign direct investments. Also, this chapter suggests how this paper could contribute to the study of the British business in Australia and, thus, Asia. Chapter Ⅱ (Australia’s major economic indicators) first suggests a brief history of Australia after the 18th century when the country became a British colony and then discusses the main factors for the demand for cotton thread such as the size of population, the level of GDP per capita and the development of the cotton industry. Chapter Ⅲ (the export of Coats’s cotton thread to Australia) and Chapter Ⅳ (the gradual involvement of J. & P. Coats in Australia) make an in-depth analysis, on the basis of the company’s internal documents, of how the company became involved in the Australian market. through both export and foreign direct investments. And chapter Ⅴ (Conclusions) concludes the preceding discussions. Main points of the paper are as follows. Founded in Paisley, Scotland, in 1830, J. & P. Coats began to pay special attention to export to USA, the then emerging economy and, in 1869, implemented its first foreign direct investment to acquire local production facilities. Since then, the British company had pioneered in foreign direct investments for local production and sales and, by 1914, grew to become one of the most important British multinationals by carrying out a total of 53 fresh investments in 15 countries in Europe, North America, Latin America, and Asia. For the Asian markets, J. & P. Coats had exported its cotton thread to some 19 countries or regions from Near East to Far East. Of them, four countries– Australia, China, British India, and Japan–stood up and, together with two other countries, had one by one received fresh foreign direct investments, 10 in total, from J. & P. Coats between 1904 and 1942: three investments for Japan and one each for her colonies, Korean and Manchukuo; one for Australia; one for China; and, three for British India. Australia was a British colony from the late 18th century to the early 20th century and her population, though relatively small in size, largely consisted of British immigrants and their descendents. To that extent, the country served as a safe and easy market for Coats’s cotton thread, which began to be exported from Britain in the middle of the 19th century. Australia remained the largest destination of British made Coats’s thread until the 1920s, far surpassing the most populated countries such as China, British India, and Japan. While pursuing the policy of export, J. & P. Coats also attempted to began local production and, in the late 1920s and early 1930s, every effort had been made to secure manufacturing facilities either by building a mill or by acquiring a local company. However, the idea of local production had been abandoned by the early 1930s, presumably because of the relatively small size of population and the underdevelopment of cotton and related industries in Australia. Instead, J. & P. Coats decided to strengthen the earlier policy of export by establishing a selling subsidiary solely in charge of Australia, called Central Agency (Australia) Ltd., in Britain. Furthermore, the British company opened depots in the major Australia cities such as Sydney in New South Wales, Melbourne in Victoria, Adelaide in South Australia, and Perth in Western Australia.
독일 사회통합의 방해 요인으로서의 인종차별과 미흡한 반차별법 고찰

나치 시기와 비교할 때 많이 완화되었지만 현재에도 UN과 유럽의회 등에서 독일에서의 인 종차별에 대한 비판이 완전히 사라지지는 않았다. 최근에는 인종차별 행위를 처벌하기 위한 형법 개혁과 독일연방의 반차별 부서의 재정 확대, 인원 확충이 촉구되고 있다. 본 연구에서는 이러한 문제의식을 배 경으로 우선 독일에서 사회통합과 차별이 지니는 의미에 대해 알아보고, 특히 차별의 중요한 무대가 되 는 노동시장에 주목하였다. 이에 따라 우선 인종차별을 판단할 수 있는 근거에 대해 살펴본 후 교육과 주거에서의 차별 외에도 노동시장에서 나타난 주요 차별의 경험적 사례를 알아보았다. 마지막으로 이러 한 차별을 시정하기 위해 필요한 독일 사회의 법적 조치들이 유럽연합의 반차별법과 비교하여 어떤 부 분 이 미흡한 지에 대해 고찰했다. 이 연구를 통해 독일에서 여전히 이주 배경을 가진 사람들이 토착 다수사회의 삶의 중심에 접근할 수 있는, 공정한 기회가 부족하다는 점이 확인된다. 하지만 공정한 주택시장, 정당한 노력에 의한 업적과 성 취를 지향하는 노동 세계의 약속은 그 사회의 매우 중요한 부분이다. 인종에 의한 불평등 대우는 사회통 합 과정에서 큰 방해 요인이 된다. 차별적 대우는 정서적 통합을 파괴하며 교육, 주거, 노동 분야 등에서 구조적 비통합을 심화시키게 된다. 따라서 차별에 반대하는 투쟁은 독일 사회 통합정책의 가장 우선적 목표가 되고 있다. 수년 전부터 유럽에서는 모든 차별 행위에 대해 수평적 지침에 의한 통일된 보호를 논의해왔다. 이미 2008년에 ‘유럽연합위원회(Eu-Kommission)’는 종교, 세계관, 장애, 나이, 성적 정체성 과 연관해서 보호 기준과 적용 분야의 지침을 발표했다. 그동안 세력이 많이 약화되었지만 독일 사회의 배후에는 유럽연합의 지침을 방해하는 세력들이 아직 남아있다. 하지만 현재 내각의 많은 부서가 차별로 부터의 포괄적인 보호를 계속 추진하고 있으므로 이 배후 세력들과 정치적 대치 상황에 있다. 예를 들어, 유럽연합 지침 2000의 5조는 장애인들이 노동시장에 방해받지 않은 채 접근할 수 있도록 적절한 예방 조치를 요구하고 있다. 유엔 협약에 의해 이 요건은 오래전부터 독일의 연방법에 포함되어 있으며 현재 유럽연합의 법에 맞추어나가는 과정이다. 독일은 유럽연합과 비교할 때 예를 들어, 육아휴직 등의 분야 에서 모범적 역할을 수행해왔다. 이제 이 모범적 역할을 독일의 반차별법이 수행해야 할 시기가 되었기 때문에 ‘보편적 평등대우법’의 광범위한 수정이 이루어져야 할 시점이다. 아울러 차별로부터의 광범위한 보호를 위한 약속과 실행은 유럽연합 차원에서도 함께 이루어져야 할 것이다. Compared to the criticism of the Nazi regime, its strength has weakened much, but the criticism of racial discrimination in Germany has not completely disappeared in the United Nations and the European Parliament. In recent years, there has been a call for reform of criminal law to strictly punish racially motivated acts, financial expansion of anti-discrimination departments in Germany. This paper first examines the implications of social integration and discrimination in Germany, and in particular the problems in the labor market, the main stage of discrimination. After reviewing the rationale for judging racial discrimination, the empirical case of discrimination in education, housing and labor markets was reviewed. Finally, this paper compares the anti-discrimination law of the European Union and looks at the insufficiency and incompleteness of German legal measures against discrimination. What this study reveals is that there is a lack of fair opportunities for people with migrant backgrounds to access the center of life in a majority society. But the labor world’s commitment to achievement by fair housing markets and legitimate efforts is a very important part of the society. Treatment of inequality by race is a major obstacle in the process of social integration. Discriminatory treatment destroys emotional integration in terms of acceptance of emotions and deepens structural non-integration in the areas of education, housing and labor. The struggle against discrimination, therefore, should be the first priority of the policy of German social integration. For many years there has been discussion at European level about uniform protection through a horizontal guideline for all discrimination features. As early as 2008, the EU Commission presented the draft of a directive that was supposed to adapt the protection standards and areas of application with regard to religion and belief, disability, age and sexual identity. To this day, Germany is the driving force behind preventing the directive-albeit very quietly now. The background is likely to be a political stalemate, as some ministries are striving for comprehensive protection against discrimination, while other actors, according to the experience with the adoption of the AGG(Allgemeines Gleichbehandlungsgesetz: General Equality law), are little further than frightening business and civil law theory. For example, Article 5 of Directive 2000/78 / EC already requires reasonable accommodation to enable people with disabilities unhindered access to the world of work. The corresponding requirements have long been considered federal law by the UN Convention on the Rights of Persons with Disabilities and, moreover, there will be a European legal act on accessibility. In a European comparison, the Federal Republic has so far limited its role model to maternity protection and parental leave. Now it is time for a German anti-discrimination law worthy of the name, and thus for a comprehensive revision of the AGG. And the fulfillment of the promise of comprehensive protection should also be promoted at European level.
What Explains China’s GEM Market? Evidence from the Five Factors

본 연구에서는 Fama-French 5요인 모형과 3요인 모형을 이용하여 중국의 GEM (Growth-Enterprise- Market) 시장에 상장된 주식의 자산가격을 분석한다. GEM 시장은 기술 섹터 중소형 주식 위주로 이루 어진 주가지수이다. 본 연구는 Fama-French 5요인의 설명력을 계산하는 방법론으로 1요인 분석, 다중 요인 분석, 그리고 다중 요인 모형 회귀분석을 사용한다. 본 연구의 결과로는 ‘Robust Minus Weak’ 요 인이 GEM에 상장된 주식의 가격을 5요인 중 가장 잘 설명한다는 것이다. 3요인에 비해 5요인에 새로 추가된 요인인 ‘Robust Minus Weak’ 요인은 또한, ‘Size/Book to Market’ 요인의 설명력을 약화시킨다. ‘Size/Book to Market’ 요인의 약한 설명력은 중소형 주식이 대형 주식보다 size에 대한 민감도가 높아서 이기 때문이라고 결론낸다. We investigate the applicability of the Fama-French five-factor model and three-factor model on China’s Growth Enterprise Market (GEM), which is a small-mid capital equity-based proxy in technology industries. We calculate the explanatory powers of the five factors by contrasting them against single-factor tests, multi-factor tests, and multi-factor model regression. We argue that in GEM, the ‘Robust Minus Weak’ factor best predicts stock price, whereas such profitability factor weakens the potential of ‘Size/Book to Market’ factor. The weakness of size factor is due to the high sensitivity of small-size enterprises on size factor.

특허가 부여되기 위해서 발명은 새롭고 진보적이어야만 한다. 즉, 발명은 해당 전문가들의 입장에서 이미 진부한 기술적 방법으로 발명된 것이 아니어야 한다. 따라서 특허부여 여부가 문제되는 발명은 기술적 영역에서의 검토를 필요로 하며, 구체적으로 특허를 받기 위해서는 다음의 요건을 충족시 켜야 한다. 먼저 해당 발명이 산업상 이용 가능해야 한다. 아무리 뛰어난 발명이라 하더라도 특허법의 목적인 산업 발전에 이바지할 수 없다면 특허를 받을 수 없다. 여기서의 산업은 반복생산이 가능한 모든 분야를 가리 키므로, 공업, 광업, 농수산업, 목축업, 어업 등 뿐만 아니라 이것들을 뒷받침하는 보조산업도 포함(운송 업, 교통업)하지만 보험업이나 금융업과 같은 단순한 서비스업은 여기에 포함되지 않는다. 다음으로 발명이 특허를 받기 위해서는 신규성이 있어야 한다. 즉, 특허를 받을 수 있는 발명은 지금까 지 없는 “새로운 것”이어야 한다. 신규성 판단은 특허출원시를 기준으로 그 때까지 없는 것이어야 한다. 신규성이 없는 경우로 인정되는 것은 첫째, 특허출원 전에 국내외에서 公知되었거나 公然히 실시된 발 명, 둘째 반포된 간행물에 게재된 발명, 셋째 전기통신회선을 통하여 공중이 이용가능하게 된 발명이 여 기에 해당한다. 그러나 발명이 公知된 경우에도 신규성이 상실되지 아니한 것으로 보는 다음과 같은 예외가 있다. 먼저 발명을 시험하거나 간행물에 발표하거나 전기통신회선을 통해서 발표하거나 학술단체에서 서면발 표한 경우로 이 때는 6개월 이내에 특허출원하면 신규성이 있다고 보게 된다. 다음으로 자기의사에 반해 서 신규성을 상실한 경우인데 발명자 자신은 특허출원 전에 비밀을 유지하려고 했지만, 타인의 협박이나 사기, 강박 혹은 절취에 의해서 알려진 경우가 여기에 해당한다. 마지막으로 발명을 박람회에 출품함으 로써 신규성이 상실된 경우로서 이상의 모두 6개월 이내에 출원하면 신규성이 인정된다. 발명이 특허를 받을 수 있는 두 번째 요건으로 진보성이 있다. 즉, 과학기술의 진보에 공헌하지 않는 누 구나 용이하게 행할 수 있는 발명에는 특허를 부여할 가치가 없다고 본다. 이러한 진보성 판단의 전제로 어떤 발명의 진보성을 판단하기 위해서는 산업상 이용가능성과 신규성이 있다고 판단된 뒤에 비로소 하게 된다. 또한 진보성 판단의 기준은 당해 발명이 속하는 기술분야에서 통 상의 지식을 가진 자, 즉 당해 분야에서 평균수준의 기술적 지식을 가진 평균적 전문가를 기준으로 한다. 독일법상 발명은 특허법 제1조 제1항에서 규정하고 있는 특허부여의 요건을 충족시켜야 하며, 이 요건들 에 관한 개념과 내용은 특허법 제3조 이하에서 상세히 묘사되고 있다. 우리 특허법 제29조에서 규정하고 있는 특허부여를 위한 요건 즉, 산업상 이용가능성, 신규성, 진보성은 독일 특허법 제1조 제1항의 요건들 에 상응한다. 그러나 우리 특허법에는 독일 특허법 제3조 이하의 규정에 상응하는 규정은 존재하지 않는 다. 그 때문에 특허심사과정에서 우선적으로 그러한 요건들의 해석을 위한 기준을 마련해야 하는 어려움 이 발생하게 된다. 따라서 특허신청된 발명이 특허부여를 위한 요건들을 충족시켰는가 여부에 대한 일관 적인 판단을 위해서는 해당 요건에 관한 개별적인 규정의 신설이 필요하며, 이를 위해서는 독일 특허법 제3조 이하의 규정이 귀감이 될 수 있다고 본다. A person shall be entitled to a patent unless the invention was known or used by others in country, or patented or described in a printed publication in this or a foreign country, before the invention thereof by the applicant for patent, or the invention was patented or described in a printed publication in this or a foreign country or in public use or on sale in country, more than one year prior to the date of the application for patent in country, or he has abandoned the invention, or the invention was first patented or caused to be patented, or was the subject of an inventor’s certificate, by the applicant or his legal representatives or assigns in a foreign country prior to the date of the application for patent in country on an application for patent or inventor’s certificate filed more than twelve months before the filing of the application in country. A patent may not be obtained though the invention is not identically disclosed or described as set forth in Patent Law, if the differences between the subject matter sought to be patented and the prior art are such that the subject matter as a whole would have been obvious at the time the invention was made to a person having ordinary skill in the art to which said subject matter pertains. Patentability shall not be negatived by the manner in which the invention was made. Inventions have to be new and progressive so that patents can be granted to. That is to say, inventions should not be something to be invented with old and outdated technical methods. Therefore, inventions, in connection with the grant of patents, need to be reviewed in the field of technology. Under German Patent Law, new inventions have to satisfy the conditions of patents that are stated in article 1, section 1 of Patent Law and the concepts and contents of the conditions are described in detail in the subsequent article 3 of German Patent Law . The conditions of patent granting under article 29 of Korean Patent Law, namely industrial utility, novelty, progressivity correspond with the conditions of article 1, section 1 of German Patent Law. However, there do not exist Korean regulations in accord with article 3 of German Patent Law. Accordingly, difficulty of establishing the specific standards for interpretation of these conditions occurs in process of reviewing patent applications. Therefore, individual regulations for the relevant conditions have to be enacted so as to judge consistently whether the patent applications meet the conditions of patent granting and in this point of view, it is thought that article 3 of German Patent Law can provide a model.
